No it surely must not be. Have HMRC challenged a previous CVA? If not then for the FL this is an exceptional circumstance. It may well be that HMRC challenge every one from now on, in which case the FL would need to do something. Perhaps that is HMRCs game plan? I base my assertion that HMRC would have challenged regardless on the amount of money in the pot for creditors and what that would have been were the football debts in there too. In that context the higher the %, the more HMRC were losing out on. I believe you are a lawyer Rick? Can you tell me if HMRC have any legal right to more money than they got via administration? Given the first CVA was scrapped and therefore null & void? How can they possibly be influencing matters now?
