I had a similar problem. I wanted a plated through hole on a 2 layer
board but only placed a pad on the top layer. There was a ground plane
on the bottom layer, and the hole shorted to it. DRC did not detect the
problem, and the board houlse did not catch it. On the next design I
placed a bottom layer pad having the same diameter as the hole, and the
polygon plane poured around it correctly.

I will try very hard to avoid having that condition arise in the
future...
however, Protel needs to add that check to the DRC program to deal with
the potential error condition so we don't make bad boards. I have to say
this is the first time I have run across something the DRC didn't catch
or flag, it has been a pretty reliable program but this is defiantly a
bug that needs looking into and resolution. 

Protel are you listening?
