[AsburyPark] Special BOE meeting tonight

2007-11-07 Thread asburycheech
Tonight (Wednesday) at 6:30 PM at the Thurgood Marshall Elementary
School (the site of the old Bond Street School), the BOE will hold a
Special Meeting to discuss in public the QSAC report – that's an
acronym for Quality Standards Accountability Compliance, or
something like that, I think. It is a public meeting, and you are
welcome to be there. Also scheduled to be there is the NJ
Commissioner of Education, Lucille Davy. She is reportedly going to
introduce to the Board and the public the person the State has chosen
to be their official monitor who supposedly will have veto power over
anything the Board or the Acting Superintendent can do, creating in
effect an Uber-Superintendent in my opinion (since I do not speak
for the Board). If you have an opinion one way or another on this,
you are welcome to come to the meeting tonight.

Frank D'Alessandro,
BOE member

2007-11-07 Thread 2fine4u
The problem with you Werner, is YOU make TOO much sense! You lay it
all out plain and simple! No double talk, double entendre's, nada!
Plain old english, the way I like it. If I could repeat my post to
you, I would. If I could apologize for the actions, taken against
you, I hope you know, that this group, is in your corner. You have
been the voice of reason, of good common sense, a person who REALLY
cares and knows what this City was and now, what it is. I've learned
so much through you, Frank, Mario, Dan, Glenn, Jack, Maureen, God
Bless her, the short salespro, the bikeman, the couple and if I missed
someone, I didn't mean to leave you out! Really, I thought I knew
about AP; yeah, I've been reading negative stuff about this town,
since I landed here, but I was taught, Believe NONE of what you hear,
and HALF, of what you see!

I knew that there must be something awfully valuable here, because
EVERYBODY, want a piece! Like the Big Apple, I ain't never got a
bite! Let me back up a bit; Thanks to the legal eagle, JR and all of
the real estate people! Know what else? I don't agree with everyone,
all the time, but I respect the fact that I just may be wrong, as
perfect as I think I am! After a hard election, where lots of mud was
flung, we're still here. Werner, thanks for your knowledge and I wish
I had done my homework, like you have. Just wanted to give you 2
thumbs up!

As hard as it is to feel this way, I don't think MM can be saddled
with the sins of the past and be forced to play catchup, either by
working 5 times faster or by somehow being forced to deal with the
shortfall in taxables caused by Partners lack of progress. My
opinion is that you have to look at MM's entry as the starting point
for them and judge what they are able to do in a reasonable timeframe
apart from justifyable frustrations that should be directed to
Partners. It is never wise to punish the son for the sins of the
father. Judge MM on what they are doing as though the slate with
them is clean. Again, nobody will always agree with what they do but
overall they seem to be investing and things are getting done. I
wish we had five years back but we don't and it wasn't their fault.
 ===

Just some clarification as to the responsibilities/positions of the
 parties involved.

Asbury Partners has the development rights in the entire Redevelopment
Area (I'll give the boundaries if anyone is interested)

They are responsible for assembling large parcels of property in the
RA and selling them to 'real' developers.

They own everything east of Ocean Ave due to the sale of public
property by the City. That property is not in the RA and has not been
 rehabilitated as was promised.

Madison Marquette is a partner of Asbury Partners with Asbury Partners
holding the majority say. MM is in for the retail component along the
 beachfront (E of Ocean Ave).

Then there's Paramount (N of BCH) Metro (C-8) and Westminster (Wesley)
all of which are developing property that Asbury Partners received
title to from the Carabetta settlement. No ED was used to acquire them.

The point of all this - just to put it all in perspective while
figuring out who to blame/praise for what's going on.

(Ultimately, isn't it the City Council?)

[AsburyPark] donating art to AP benefits

2007-11-07 Thread lindagriggsartist
I saw the notice for the Little League and, being an artist, I don't
have any money to donate but I'm always happy to donate art for any AP
benefits.

So those of you who coordinate benefit auctions, raffles, etc. please
keep my email address handy.

I've done some nice black walnut ink drawings from historic AP sites
that aren't on the website but I'll get them up there later this week.
I made the ink from the nuts that barraged my back yard on 4th Ave.

[AsburyPark] Re: Just a Thought from Outside the Box

2007-11-07 Thread rook782
The problem is also the amount of money the four council members
took from Asbury Partners in the last election. Tens of thousands
of dollars. And mostly from New York and California people. Go to
the New Jersey Election Committee web site and look at the reports.
Can anyone upload them to this site? Mario or Dan?

You want this to change, elect others. Keep Keady. Not sure on
Johnson. The End.

use
emminent domain AGAINST the Partners and to allow MM to take it
all
  over by themselves?

I have written and spoken about this for a couple of years. I have
advised (or tried to) on this matter. The WRA prohibits the City
from
condemning property in the redevelopment zone without Partner's
approval. That is so Partners cannot be forced to take and pay for
property before it wants to. It would include Partners properties
as
well. However, what I told the city, is that it cannot
contractually
agree to limits its inherent sovereign power. Thus, nothing could
stop
the city from violating that provision. Only the state legislature
can
limit a local sovereign's power of eminent domain. However, that
being
said, while nothing could stop the city from taking property
contrary
to that provision, Partners might be able to sue for breach of
contract. However, another possibility is that the court could find
that the provision limiting the city's power of eminent domain was
contrary to the public good and thus, the provision is not only
unenforceable but void ab initio (never existed).

All of this is an invitation to litigation. No one wanted it,
especially after being held in purgatory by the bankruptcy court.
However, I believe that ultimately a tiger cannot change its
stripes
and litigation will be necessary. While I wish it did not have to
happen, perhaps the city leaders will finally reach the breaking
point
and decide that we have to tighten our belts and go to the
mattresses.
That litigation could grease the skids for Partners' exit.

I thought someone from the city was to report to JCPL when the light
poles are out. This particular situation with the park should have
been reported by the police to someone to get them fixed.

This is irresponsible and symbolic of public servant apathy. Who else
from city government is roaming the streets at night except for the
police. They would be the ones to notice what areas of the city are
without working light poles. The ball is clearly in their court to
report this information up the ladder.

I don't know about that. They seem to have a full plate. Typically
governments have to rely on citizens to inform them of things like
this. What would be an issue is how the reports by citizens are
handled. But that being said, perhaps, we can ask the chief to remind
officers that when on patrol, and time affords, that they should note
any streetlights that are not working and notify the city.

[AsburyPark] Economy

From Crain's. The implications of the Chinese stop buying dollar
denominated investments and US treasuries is frightening. Interest
rates will escalate.

The 13-nation euro hit a fresh record against the dollar -- rising to
$1.4729 -- before falling back. The dollar fell not only against the
euro but in Asia following a report that a senior Chinese political
figure said China should diversify its $1.43 trillion foreign exchange
reserves into the euro and other strong currencies.

OT, but thought some would enjoy this with your nightcaps, morning

52ab2245c2dex=121005excamp=mkt_at1pagewanted=all One
afternoon in early September, an architect boarded his commuter train
and became a cellphone vigilante. He sat down next to a 20-something
woman who he said was blabbing away into her phone.
She was using the word `like' all the time. She sounded
like a Valley Girl, said the architect, Andrew, who declined to
give his last name because what he did next was illegal.
 And some of the
letters in response are even better. Like: 1. As my fellow riders
rolled their eyes and gritted their teeth, I turned my head slightly
over my shoulder and yelled (I have a pretty strong yell), Shaddup
already!2. Could you speak just a bit louder — they
can't quite hear you in Brooklyn.3. You want to talk real
loud about, like, nothing? You can do that at home as much as you want.
Oh, you don't want to waste your time at home talking about nothing?
O.K., then save it for work. No one expects anything else of you there
anyway.Excerpted from letters: Click here: When Your Cellphone Is

ROBEN FARZAD, Editor, BusinessWeek: Citigroup is a far bigger
animal than Merrill Lynch is. Merrill Lynch is an icon of Wall Street;
Citigroup is that 300,000 strong, 100-nation financial supermarket. And
it is the largest U.S. bank in terms of asset size. So its tentacles
reach out everywhere around the world, so any time something like this
happens, naturally the entire sector is very nervous.
The worry is that it's the tip of the iceberg, because we know plus or
minus $55 billion in mortgage-related securities sit on Citigroup's
books.

Anyone who was part of a caretaker board -- and, by the way, it's not
just him. It's people as diverse as Dick Parsons, the CEO of Time
Warner. You had C. Michael Armstrong, who helped run ATT into the
ground at the audit committee.

I think it's becoming abundantly clear that the board was asleep at the
switch, and they allowed the CEO to take ever larger amounts of risk and
embolden the troops to do as much. And, obviously, they're paying for it
in spades.

[AsburyPark] Tonight's Special BOE meeting

2007-11-07 Thread asburycheech
Tonight's Special BOE meeting could not be held since adequate
notice had not been sent to the newspapers of record. Instead, the
regular monthly meeting for November, scheduled for Wednesday, Nov.
28, will begin at 6:30 PM to give the Commissioner of Education and
the public the extra time necessary to discuss the State monitor's
report. Had we held the meeting without adequate notice, we would
have been in violation of the Open Public Meetings Act. We try to
observe all laws, even Murphy's. Tonight the local ministers from
Neptune/Asbury had neatly lettered signs denouncing the BOE and
claiming we were hurting the children, and former Board member
Antoinette (Toni) Ross passed around hand written petitions demanding
that most BOE members (including yours truly) be removed. The Board's
attorney made the announcement concerning the inability to proceed
with the meeting and the apologies to the people assembled. All in
all it was a very Asbury experience. Speaking for myself, I likened
it to an amateur performance of Waiting for Godot. Beckett would
have been proud.

 Frank D'Alessandro, BOE member
