I agree with point one, but not the second two - however I also think
what they intended shouldn't matter so much to us except as legal
trivia.  I think it's our responsibility to make our own decisions
with that as guidance.

Just like military regulations and officers.

It's a piece of genius - anything to get the power our of the federal
gov't, but I think your solution definitely meets the 80/20 rule
overall.
