It is impossible for OpenSSL to dual license under the GPL.  The
current maintainers of OpenSSL do not have the rights to alter the
license to the code derived from the original SSLeay contribution.
Therefore, they cannot add a new license to code derived from the
original contribution.

Note, there is nothing in the OpenSSL
license that prevents it from being distributed in source form.
