Re: [AI] SC: Differently abled can’t claim quota in promotion
When SCs/STs can have reservations for promotions, why not the disabled persons? its sucidal on those suggesting the disabled not to fight for reservations for promotions. Infact, disabled should have more reservations than the reserved castes/tribes. - Original Message - From: "Ketan Kothari" <muktake...@gmail.com> To: "AccessIndia: a list for discussing accessibility and issues concerningthe disabled." <accessindia@accessindia.org.in> Sent: Thursday, September 03, 2015 11:15 AM Subject: Re: [AI]SC: Differently abled can’t claim quota in promotion Dear Friends, I am sure what I am going to write is not going to be popular but all the same: We must fight for non-discrimination at the time of promotional examinations on the basis of disabilities. Reservation at the time of promotion is going to not solve our problem. What George said about providing of appropriate work environment, technology etc. is the right approach rather than always clamouring for reservation. I think we all (including me) tend to look for easy way out and then keep complaining when these demands go unfulfilled. We have had friends (some of them on the list) who have overcome their disability and risen to great heights. I fail to understand as to what is so shocking in the judgment? We cannot expect every citizen of this country to look at us in a way that will suit us. If we have followed ADA litigation, courts have become weary to give judgments in favour of the disabled and we fortunately have been very lucky in India. I may add that although Maharashtra government was compelled to give appropriate aids and appliances vide a directive of 2011, many disabled employees have shown their reluctance to claim these. So let us also introspect and then comment. With best wishes, Ketan On 9/2/15, Vikas Kapoor <dl.vi...@gmail.com> wrote: SC: Differently abled can’t claim quota in promotion Amit Anand Choudhary,TNN | Sep 2, 2015, 05.36 AM IST NEW DELHI: Differently abled persons can claim benefit of reservation in government jobs only at the time of appointment and cannot get the benefit of the affirmative policy in promotion, the Supreme Court said on Tuesday while clarifying its earlier verdict. A bench of Justices Ranjan Gogoi and N V Ramana said the apex court's 2013 verdict did not hold that the reservation policy could also be extended to promotion in jobs and stressed that the disabled could claim benefits only at the time of recruitment. The SC had in 2013 directed the Centre and all state governments to provide three per cent job reservation to disabled persons in all their departments, companies and institutions under Persons with Disabilities (Equal Opportunities, Protection of Rights and Full Participation) Act which came into force in 1995. The Centre submitted that the court had not, while passing order for three percent reservation, dealt with the issue of reservation in promotion and the disabled could not be allowed to claim the benefits. Although the Court had directed that all vacancies under 3% reservation be filled up within three months, the governments failed to comply with the order in the last two years and there are still 10,000 vacant posts in central government. Solicitor General Ranjit Kumar assured the court that all vacancies would be filled up by the end of this financial year. http://timesofindia.indiatimes.com/india/SC-Differently-abled-cant-claim-quota-in-promotion/articleshow/48766783.cms Vikas Kapoor, Mobile: (+91) 9891098137, 9013354994 Skype Id: dl_vikas Register at the dedicated AccessIndia list for discussing accessibility of mobile phones / Tabs on: http://mail.accessindia.org.in/mailman/listinfo/mobile.accessindia_accessindia.org.in Search for old postings at: http://www.mail-archive.com/accessindia@accessindia.org.in/ To unsubscribe send a message to accessindia-requ...@accessindia.org.in with the subject unsubscribe. Same is happening with me. My case is well-known for many more people. My college has provided me all aids & uplyances as per the HC order. But, now they are not ready to provide me any kind of work. Dear all, I feel the issue has been selectively reported by the TNN and is not true. The issue of reservation in promotion for persons with disabilities was not there for consideration before the court in the instant matter. I agree with George sir, even in IAS cadar sc & st people have reservation in promotions, but for disabled persons promotions from class 3 to class 2 is denied, here I read somebody saying that reservations in promotions is not necessary for disabled persons, what a funny thing, On 9/2/15, George Abraham <geo...@eyeway.org> wrote: > We need to now fight for employers to provide Work and appropriate > technology and accessible work environment for disabled people employed in > Govt/PSU etc. This will empower PWDs to get promotions in the routine. > > -Original Message- > From: AccessIndia [mailto:accessindia-boun...@accessindia.org.in] On Behalf > Of Asudani, Rajesh > Sent: 02 September 2015 10:52 > To: AccessIndia: a list for discussing accessibility and issues concerning > the disabled. > Subject: Re: [AI] SC: Differently abled can’t claim quota in promotion > > Well, it was on expected lines. > > Reservation in promotion for SC/ST had to be introduced by a constitutional > amendment. > So, I was not at all hopeful of the same for PWD from the beginning. > > > > सादर / With thanks & Regards > राजेश आसुदानी Rajesh Asudani > सहायक महाप्रबन्धक AGM > बाजार आसूचना ईकाई MIU > भारतीय रिजर्व बैंक Reserve Bank of India > नागपुर Nagpur > > 0712 2806846 > > President > VIBEWA > Co-Moderator > VIB-India > > A-pilll = Action coupled with Positivity, Interest, Love, Logic and > laughter. > > -Original Message- > From: AccessIndia [mailto:accessindia-boun...@accessindia.org.in] On Behalf > Of Vikas Kapoor > Sent: Wednesday, September 02, 2015 8:02 AM > To: AccessIndia: a list for discussing accessibility and issuesconcerning > the disabled. > Subject: [AI] SC: Differently abled can’t claim quota in promotion > > SC: Differently abled can’t claim quota in promotion > > Amit Anand Choudhary,TNN | Sep 2, 2015, 05.36 AM IST > > NEW DELHI: Differently abled persons can claim benefit of reservation in > government jobs only at the time of appointment and cannot get the benefit > of the affirmative policy in promotion, the Supreme Court said on Tuesday > while clarifying its earlier verdict. > A bench of Justices Ranjan Gogoi and N V Ramana said the apex court's 2013 > verdict did not hold that the reservation policy could also be extended to > promotion in jobs and stressed that the disabled could claim benefits only > at the time of recruitment. > > The SC had in 2013 directed the Centre and all state governments to provide > three per cent job reservation to disabled persons in all their departments, > companies and institutions under Persons with Disabilities (Equal > Opportunities, Protection of Rights and Full Participation) Act which came > into force in 1995. > > > The Centre submitted that the court had not, while passing order for three > percent reservation, dealt with the issue of reservation in promotion and > the disabled could not be allowed to claim the benefits. > > Although the Court had directed that all vacancies under 3% reservation be > filled up within three months, the governments failed to comply with the > order in the last two years and there are still 10,000 vacant posts in > central government. I totally agree with George sir. Now the time has come to fight for real equality. Either pwd should also get same benefits in promotion like sc/st, or their benefits should also be stopped. Re: [AI] SC: Differently abled can’t claim quota in promotion
Dear Friends, I am sure what I am going to write is not going to be popular but all the same: We must fight for non-discrimination at the time of promotional examinations on the basis of disabilities. [AI] SC: Differently abled can’t claim quota in promotion
SC: Differently abled can’t claim quota in promotion Amit Anand Choudhary,TNN | Sep 2, 2015, 05.36 AM IST NEW DELHI: Differently abled persons can claim benefit of reservation in government jobs only at the time of appointment and cannot get the benefit of the affirmative policy in promotion, the Supreme Court said on Tuesday while clarifying its earlier verdict. Re: [AI] SC: Differently abled can’t claim quota in promotion
I think, this reporting is a caricatured version of actual pronouncement of SC on the date... The SC was hearing plea for disobeying court's order for filling 15000 vacant posts. SC dismissed the plea saying that implementation is under way and accepted Center's reply that it will be completed by 31st March 2016... In this context, SC clarified that it had not instructed Center to fill all vacancies including on promotional basis, but had only instructed to fill vacancies lying unfilled on entrance level... However by saying this, I must admit here that I never had strong belief that SC has given a clear verdict that government has to give promotional reservation on backlog basis, rather it had given its opinion read with PWD Act 1995 that "reservation" in job applies to to "promotion" as well... But with no explicit instruction to implement it within certain timeframe! Experts, please correct me, if there is something else in this judgement! Will have to read the judgement, but it seems SC was clarifying that its October 2013 verdict which is now the landmark for reservation for PWD does not include reservation in promotion. सादर / With thanks & Regards राजेश आसुदानी Rajesh Asudani सहायक महाप्रबन्धक AGM बाजार आसूचना ईकाई MIU भारतीय रिजर्व बैंक Reserve Bank of India नागपुर Nagpur 0712 2806846 President VIBEWA Co-Moderator VIB-India A-pilll = Action coupled with Positivity, Interest, Love, Logic and laughter. -Original Message- From: AccessIndia [mailto:accessindia-boun...@accessindia.org.in] On Behalf Of Himanshu Sahu Sent: Wednesday, September 02, 2015 10:55 AM To: AccessIndia: a list for discussing accessibility and issues concerning the disabled. Subject: Re: [AI] SC: Differently abled can’t claim quota in promotion I think, this reporting is a caricatured version of actual pronouncement of SC on the date... Re: [AI] SC: Differently abled can’t claim quota in promotion
Well, it was on expected lines. Reservation in promotion for SC/ST had to be introduced by a constitutional amendment. So, I was not at all hopeful of the same for PWD from the beginning. सादर / With thanks & Regards राजेश आसुदानी Rajesh Asudani सहायक महाप्रबन्धक AGM बाजार आसूचना ईकाई MIU भारतीय रिजर्व बैंक Reserve Bank of India नागपुर Nagpur 0712 2806846 President VIBEWA Co-Moderator VIB-India A-pilll = Action coupled with Positivity, Interest, Love, Logic and laughter. -Original Message- From: AccessIndia [mailto:accessindia-boun...@accessindia.org.in] On Behalf Of Vikas Kapoor Sent: Wednesday, September 02, 2015 8:02 AM To: AccessIndia: a list for discussing accessibility and issuesconcerning the disabled. Subject: [AI] SC: Differently abled can’t claim quota in promotion SC: Differently abled can’t claim quota in promotion Amit Anand Choudhary,TNN | Sep 2, 2015, 05.36 AM IST NEW DELHI: Differently abled persons can claim benefit of reservation in government jobs only at the time of appointment and cannot get the benefit of the affirmative policy in promotion, the Supreme Court said on Tuesday while clarifying its earlier verdict.
