It's not. However, what makes Apple different from other companies is
the length they go into to make customers/users happy. But apparently,
they can help you out if you loose a big library, so that's a moot
point.

If you break a physical CD the record labels make you buy another one.
If I lose a paperback book, I can't just waltz into the nearest BN,
snag another copy and back out without paying for it again
Comparing physical CDs/books to files (where the content is decoupled
from the medium) doesn't make much sense, therefore I'm not even gonna
comment on this.

Excuse me? Simply decoupling the data from the medium does not impose
an obligation on the seller to provide a replacement copy of the data
in perpetuity.

That was my point.
I think people are assuming a false dichotomy between downloads and
'physical' music.

In reality, whether you buy a CD or you download an album from ITMS, or
even a book, you're paying for the same thing: one copy of the data
contained within the medium.

After all, the material costs of a book are pretty much the same,
whether it's a $300 textbook or a $14.95 potboiler. A CD is a CD is a
CD whether it has Britney Spears or Beethoven on it.

In the download case the medium is wherever you store it, and unlike
books you can make a functionally identical backup copy of the data.

That doesn't change the fact that you paid for *a* copy of the data
with specific usage rights.

The medium you purchased the data in is largely irrelevant within the
context of the contract between the purchaser and seller.

The complications with electronic data all come regarding the ease of
reproducing the data by the purchaser, something that was some problem
with CD's and is an acute problem with electronic copies. (A problem,
that is, from the point of view of the publisher.)

I find it ironic that people disparage Apple for their 'restrictive'
DRM, when it's far, far more open than CD's or books.

After all, how many books come as 5 complete hardbound copies, and
unlimited portable paperback copies?

That's what you get with ITMS music. (at the very moment, I'm copying,
legally, my entire music collection to my wife's powerbook.)

Bruce, I had tons of these kind of discussions before and I really
do not need a repetition. I *do* think the dichotomy exists, and iTMS
is the living proof -- would we need it if there was no difference?

But that wasn't my point. I do not have any problems with Apple's DRM
as it is, and I never called it restrictive -- you seem to suggest
that. And I never suggested that Apple *should* offer a free
replacement. I just wanted to point out that Apple says Own It Forever
And A Day and For just 99 cents each, you get high-quality AAC music
files that won't disappear at the end of the month, or ever on its
website. You can read into it a little bit more than Apple wants. I
know I did.

And this, and only this is what I wanted to say. No need to start
another debacle.

Re: Oh mega crap

2005-01-07 Thread mray
As a courtesy most places (at least in my experience) that allow
electronic downloads will provide a means to re-download the file(s).
Though a few state something to the effect of it your responsibility
to secure you downloaded file(s)... they will allow the original
purchaser (with some kind of proof of purchase to re-download the
file(s), while others simply won't.

The cost to download a purchasers lost electronic file would appear to
be: storage space, bandwidth and and good public perception (yes I
realize there is a cost, but the files reside on the server regardless,
and providing there isn't a huge rush to replace a lot of files,
bandwidth should not be an issue, and keeping a customer happy is an
investment). Whereas the cost of a physical item has an actual
monetary cost to the Seller. Some companies will for a cost (and proof
of ownership) replace broken or lost items (Maglite, Fruit-Of-The Loom,
Symantec of my experience) with-in reason.

Sometimes you are just out of luck, I had a Photodisc that my computer
just could not read anymore, I called to see if i could get a
replacement, the disc was discontinued. Oh well, should of made a
back-up, which is a whole other common-sense vs. legal conundrum.

The moral? Know what the policies are, keep receipts, back-up when
possible, and breathe in, breathe out, repeat as necessary

No it's primarily a Please, RIAA and Justice Department, don't sue us
out of existence measure.

Apple planned the ITMS and iPod as a linked business from the start.
Pissing off the record labels by essentially making and selling a 20GB
piracy device would have put a mild crimp in their negotiations with
the labels.

I mean look at the freakout the record label folks did over the Rip,
Mix, Burn ad campaign, and it was very careful to state Don't steal
music.

The side effects are inconvenience, and then only if you assume (and
remember what our teachers taught us about that word!) it works 'just
like your Palm'.

In fact, the iPod manual warns about this.
Absolutely nothing about iTunes prevents you from backing up your music
collection, only using your iPod as the backup.

You want to rant about this, aim the rant at the right folks: the
recording industry, the media giants and their tame congresscritters
(or parliamentcritters, depending on where you're at).

Well, if you have a backup just drag the music folders and drop them on
iTunes. It will reload them into iTunes, make a new iTunes data file
and they will be there to load on the iPod the next time you connect.
Worked like a charm for me yesterday. Now, if you didn't back up your
data before doing the clean install

JeffW.
Well that's just dandy. Absofreakinlutely dandy.

Well, I have a partial backup, so I'm not completely screwed, just
partially. I think about 75% of my itunes library is on my iMac, so
that should help a great deal in the recovery process.
I honestly assuemd that my iPod would work the same as my palm pilot

computer files, and adds to whichever database needs it in order to
make them match. It doesn't delete things unless you do it manually.

Nope, this is a piracy prevention measure, so you can't plug a full
iPod into an empty computer and suck 30GB of music into the computer at
once.

Of course, about 3.2 seconds after the iPod was released, people had
programs out allowing exactly that.

At least you have the CD's...Someone with a sizeable ITMS collection

Brian,
I think that it would not have erased the files IF you were set to
manually manage playlists. There are c couple of utilities that will
load music files from an iPod to the computer. I think most of theme
have links at iPodLounge. But a backup is always best. I would NOT want
to have to redo mine as I not only have 300+ CD's but also a lot of
music from analog sources (vinyl or tapes) and they are a major pain to
get done just because of the time involved.

starting with hard copies whenever possible. Too bad there's not a

I believe it's the compromise that Apple came up with to appease the

Hmmm, nope, sorry. Once it's been downloaded, you have to purchase it again
if you want to download it again. Or if there is a problem with it, you can
contact the iTunes Music Store customer support and they will usually credit

computer glitches. Your typical electric utility draws its line current out
of the big generators with a pair of coil taps located near the top of the

clean them up, and use special auxiliary taps on the bottom of the coil.
Now, this is a problem, because when they do that they get not ordinary or

settle to the bottom of the generator. These flow down ordinary wires just

via), they're apt to get stuck. This is what causes computer glitches.

Re: Oh mega crap

2005-01-05 Thread Michael Hackett
My pal lost his music collection - almost 700 songs downloaded from
iTMS - when the XP upgrade mucked up his system royally. He called
them and they gave him everything back. I guess it all depends on how
big a client you happen to be.

I believe you can redownload everything you purchased as many times as
  you want, free of charge.

Hmmm, nope, sorry. Once it's been downloaded, you have to purchase it again
if you want to download it again. Or if there is a problem with it, you can
contact the iTunes Music Store customer support and they will usually credit
you with another download for the same song. I did it a few times after
downloading a song that wouldn't play correctly.

fat electrons n.: Old-time hacker David Cargill's theory on the causation of
computer glitches. Your typical electric utility draws its line current out
of the big generators with a pair of coil taps located near the top of the
dynamo. When the normal tap brushes get dirty, they take them off line to
clean them up, and use special auxiliary taps on the bottom of the coil.
Now, this is a problem, because when they do that they get not ordinary or
`thin' electrons, but the fat'n'sloppy electrons that are heavier and so
settle to the bottom of the generator. These flow down ordinary wires just
fine, but when they have to turn a sharp corner (as in an integrated-circuit
via), they're apt to get stuck. This is what causes computer glitches.

Re: Oh mega crap

2005-01-04 Thread Kyle Hansen
On 1/4/05 9:19 PM, Brian Rule [EMAIL PROTECTED] Spew into the
Cybertrough:

At the advice of the apple genius at the local apple store I did a
complete clean reinstall of OS X. Fast forward
I took my iPod and plugged it in, it loaded iTunes, and thinking this
would be a simple matter, when it asked if i wanted to change the
library on the iPod to link it to the new iTunes library I foolishly
said yes, assuming it would sync the two libraries. Now my damn iPod
is empty. Is there a way to regain what was lost without reloading all
 those friggin cds?

Nope. If you hadn't linked it to your new (empty) library you would have
hope. There are programs that will suck the songs off of a full iPod, but
not after it is erased...like yours is.
