And it isn't against pay once, own forever...you paid for that downloaded copy, not the rights to download it over and over. It's not. However, what makes Apple different from other companies is the length they go into to make customers/users happy. But apparently, they can help you out if you loose a big library, so that's a moot point. If you break a physical CD the record labels make you buy another one. If I lose a paperback book, I can't just waltz into the nearest BN, snag another copy and back out without paying for it again Comparing physical CDs/books to files (where the content is decoupled from the medium) doesn't make much sense, therefore I'm not even gonna comment on this. In the download case the medium is wherever you store it, and unlike books you can make a functionally identical backup copy of the data. That doesn't change the fact that you paid for *a* copy of the data with specific usage rights. The medium you purchased the data in is largely irrelevant within the context of the contract between the purchaser and seller. The complications with electronic data all come regarding the ease of reproducing the data by the purchaser, something that was some problem with CD's and is an acute problem with electronic copies. (A problem, that is, from the point of view of the publisher.) I find it ironic that people disparage Apple for their 'restrictive' DRM, when it's far, far more open than CD's or books. After all, how many books come as 5 complete hardbound copies, and unlimited portable paperback copies? That's what you get with ITMS music. I *do* think the dichotomy exists, and iTMS is the living proof -- would we need it if there was no difference? But that wasn't my point. I do not have any problems with Apple's DRM as it is, and I never called it restrictive -- you seem to suggest that. And I never suggested that Apple *should* offer a free replacement. I just wanted to point out that Apple says Own It Forever And A Day and For just 99 cents each, you get high-quality AAC music files that won't disappear at the end of the month, or ever on its website. As a courtesy most places (at least in my experience) that allow electronic downloads will provide a means to re-download the file(s). Though a few state something to the effect of it your responsibility to secure you downloaded file(s)... they will allow the original purchaser (with some kind of proof of purchase to re-download the file(s), while others simply won't. The cost to download a purchasers lost electronic file would appear to be: storage space, bandwidth and and good public perception (yes I realize there is a cost, but the files reside on the server regardless, and providing there isn't a huge rush to replace a lot of files, bandwidth should not be an issue, and keeping a customer happy is an investment). Whereas the cost of a physical item has an actual monetary cost to the Seller. Some companies will for a cost (and proof of ownership) replace broken or lost items (Maglite, Fruit-Of-The Loom, Symantec of my experience) with-in reason. Sometimes you are just out of luck, I had a Photodisc that my computer just could not read anymore, I called to see if i could get a replacement, the disc was discontinued. Oh well, should of made a back-up, which is a whole other common-sense vs. legal conundrum. The moral? Well, apparently all does not end well. The software related problem, as the genius at the apple store did indeed turn out to be a hardware problem this morning, as I originally suspected, and the iBook wouldn't even boot this morning. After a talk to applecare, they agreed this was indeed a hardware problem and they would deal with it immediately. Of course, immediately would have been nice before when i still had time to get it back before i desperately need the computer on monday. It's been sent in, and another hard drive wipe is likely, assuming they don't replace the HD altogether. My bet is it's in need of a new logicboard. Hmmm, nope, sorry. Once it's been downloaded, you have to purchase it again if you want to download it again. Or if there is a problem with it, you can contact the iTunes Music Store customer support and they will usually credit you with another download for the same song. I did it a few times after downloading a song that wouldn't play correctly. You're right. I would've sworn that I read it's possible. Pity. Kind of strange, too, since they probably have your full download history anyway, and it's against the idea of pay once, own forever. On the other hand, iTunes MS is not a subscription service... Well, if you have a backup just drag the music folders and drop them on iTunes. It will reload them into iTunes, make a new iTunes data file and they will be there to load on the iPod the next time you connect. Worked like a charm for me yesterday. Well, I have a partial backup, so I'm not completely screwed, just partially. I think about 75% of my itunes library is on my iMac, so that should help a great deal in the recovery process. I honestly assuemd that my iPod would work the same as my palm pilot when building a new database- the computer looks at the palm and the computer files, and adds to whichever database needs it in order to make them match. Brian, I think that it would not have erased the files IF you were set to manually manage playlists. There are c couple of utilities that will load music files from an iPod to the computer. I think most of theme have links at iPodLounge. But a backup is always best. I would NOT want to have to redo mine as I not only have 300+ CD's but also a lot of music from analog sources (vinyl or tapes) and they are a major pain to get done just because of the time involved. Luckily, I still believe in keeping hard copies, or better yet. starting with hard copies whenever possible. Too bad there's not a utility to retrieve deleted files on an iPod, like there are on regular hard drives. My pal lost his music collection - almost 700 songs downloaded from iTMS - when the XP upgrade mucked up his system royally. He called them and they gave him everything back. Fast forward I took my iPod and plugged it in, it loaded iTunes, and thinking this would be a simple matter, when it asked if i wanted to change the library on the iPod to link it to the new iTunes library I foolishly said yes, assuming it would sync the two libraries. Now my damn iPod is empty. Is there a way to regain what was lost without reloading all those friggin cds? Nope. If you hadn't linked it to your new (empty) library you would have hope. There are programs that will suck the songs off of a full iPod, but not after it is erased...like yours is.
