I filed two complaints with the commissioner.  The most recent had transcripts 
of our email conversations.  That was about two weeks ago.  I have had no 
contact with the original adjuster since.  The most recent clown at Amica 
called me Tuesday before lunch to “discuss” the commissioner’s complaint.   I 
derailed him by asking if he intended to settle as his superior had arranged 
with SWMBA a week ago.  He laid out the plans as he understood, then wanted me 
to respond right then.  I asked him if the incso had actually paid the body 
shop’s initial bill.He lied, and said they had.  I called the shop and they 
said not.  

I may find out how the commissioner’s complaint had any impact, once the boys 
at Amica have the full payments on the desk, my title clean, and stop 
prevaricating.

Well, I am sort of back in the saddle.

I picked up Allen this morning.  The shop finished it last night.  She drives 
as well as I remember.

NOW, to get the SOB insurance people to do their job.

I paid to ransom my car before the adjuster could get his tow truck over and 
steal the car from the shop to send to the CoParts yard.  Insco was supposed to 
pay the storage fees, but never did.  When asked this week, they claimed they 
had, twice.   When I asked the body shop last week and this, as well as when I 
paid to pick up the car, turns out it never had been paid.

I was supposed to sign a settlement at lunch, but there were just too many 
balls dropped.  I am holding out for them to get the proper payments made, and 
have proof that the title has been cleared, that it never shows as salvage.  
When the stars align, then I can sign.

is, regardless of how it is phrased, his action constitutes "Mens Rae"
which is a legal term for "Thought followed by Act" and is the qualifier
for having done a criminal act.

With all respect and regard for SHMBO wearing the legal hat... I suggest
you would be best served to engage local counsel and push legal resolution.

To my knowledge, there is no specific requirement to settle vehicle damage
quickly. So I brush off that his "desire to settle quickly" was a factor.

I am just a few heartbeats away from letting their client know I am going to 
file suit against her for pain and suffering, as well as emotional distress 
induced by the adjuster.  With the headbonk, I am just not as robust as I was 
before this incident.  I am sure there will be a few months of therapy required 
to return my to a more stable mental balance.

The thing is exceptionally clean, just suffering the normal wear issues with 
plastics and electric lines.  The things do not sell much, ANYWHERE.  The black 
on tan is a step above standard black on black.  The cluster is freshly 
rebuilt, so should not fail again for a few years.

To work at the insurance company, which has to possess a license from the
State, the individual working for that company has to also either be
licensed, or meet some state requirements to work the business In every
state I have experience in dealing with..

Thus... the Company is legally culpable for the actions of it's employees
to follow the law failure to do so.. either by deliberate intent, or by
negligence... qualifies as having done harm to our esteemed fellow
member... ie "individually harmed".

If it is found in the discovery phase of trial preparation, such actions
are "regular and common" and the Company not only allows it, but practices
such in due course, even more powerful... for the plaintiff...

I have contact with an attorney here who, for the past 40 years has only
taken insurance malpractice cases... He has not lost a case in 38 years
I'm sure there is another like him in the subject state

Agree with you that messing with titled property that belongs to neither him

Seems to me, you have legal standing to bring suit against them for
such actions. Far and above any damage done to you, or your car.

In this state, such actions would qualify for a tripple damages clause
in the settlement at court.
Case could be made the offending INSco bypassed all legal restraint
and violated insurance license requirements of ethical actions.

The more I think about it, the more I think it's just business as usual, 
proceeding blithely along and gittin 'er done as quickly as possible.  

The fact that it's not his/her car and they have no right to dispose of it 
unless they purchase it, and only after they have actually completed the 
purchase just never entered into their tiny brain. 

You don't have a contract with them that gives them the right to purchase your 
car. If you don't want to sell them the car, it's just a matter of arguing with 
them over the size of the check they'll have to give you to make you shut up 
and not sue their client.

Make me a reasonable offer.  

Only PITA at the moment is the front suspension.  The pump is ok, might be a 
leak on a spring or the distributor.  The rear wheels were on the ground in 
April, but my indy cleared the codes and tossed in a new relay.  That seemed to 
make the system work for a few weeks, then, probably for not driving it, the 
front end leaked down.

Correct

I just made a list of all the “upgrades”.  There a a bunch.  Replaced most of 
the interior parts, lights, paint and full filters/fluids, as well as tires.  
Turns out the engine is a rebuilt with only 15k on the clock.  I did not 
remember that.   I wonder what impact that has on value

I have invested mucho dinero in making a a daily driver.  When I went to pick 
the car up, the POS W220 kacked its speedo and then shat its airmatic.   To 
make either car work again, the investment is the same.  But I think the SD is 
a more reliable car, as the W220 is a cascade failure of epic proportions

I have stuffed the checks mailed me into a folder and will not process them.  I 
told the adjuster I am not accepting his checks and they will remain filed 
until I get a reasonable settlement.   I have been paying all other costs, but 
for the rental car that they are picking up, not part of the settlement.

I have made two complaints to the insurance commissioner.  Most recent details 
each statute he violated.  I expect there will be fire works when his pee pee 
is whacked.

To do business in a state, an insurance company MUST be licensed. Each
state has a department that has no other duty but to monitor compliance
with those licenses.

Find that department, call them, report what the INSCO is doing.. I wager
it will get results... quickly...  Here, it is called the "State Insurance
Commission" and recently, a friend had a problem, called them on my
suggestion at 10:00, at 1:00 PM the insurance company hand delivered a
check for payment in full by an officer of the company... they took it VERY
seriously...

Perhaps the same result could happen for you.

Attach a cover letter explaining that the claims adjuster did some criminal 
things and you had to protect yourself, send it to the CEO of Amica with a copy 
of the summons and complaint.

SWMBA is pretty busy with oil and gas stuff in the great white north, so less

a representation letter so that the as*hat can no longer pester me.  That would 
keep the file open for a bit while I recover.

I was fed up with the mendacious ways of the adjuster.  Catch -22 where they 
were no longer going to pay for storage of the car at body shop, but not paying 
the bill, so that I could remove the car from body shop.  Tech from body shop 
admits the guy is being a putz and making it hard.

Adjuster tells me the title is already clouded and he submitted to the state as 
salvage.  I remain legal owner, but he likes to lie in his attempts to force a 
low settlement.  I decided to complain to the state insurance commission about 
his pernicious prevarications.  I will be sending supplemental data to support 
my complaint.

So, I got the run around last night when I tried to pick up the car.  Need it 
towed to my home, but bill needs paid.  I whip out my CC and pay it.  Then will 
submit that bill to insco to get reimbursed.  Then I emailed the adjuster boy 
out in RI that he is off the case, as he is unethical and untrustworthy.  Also 
that I am retrieving my car as soon as he pays the bill at the shop.  Made it 
sound as if I was backing down.  I will keep this fish on the hook and poke him 
every so often to keep the pot at a simmer.  I figure that insco will grow 
tired within the next ten months and come around to a more equitable resolution.

My interpretation was that his insurance, USAA was paying the medical bills as 
they occur, and will subrogate the lump sum to her insurance, Amica, at the end 
of 3 years when hopefully the medical expenses will be finished.

I need to miss at least 14 days of work before the lost wages kick in.  I work 
14 days this month.  Payout is only 80% of wages.   To have income, I must 
therefore work while injured.

As long as USAA covers it, the medical stuff gets paid.  Then it becomes a 
matter of legal departments from each carrier pissing on each others heads and

Some of it is physical, due to muscle and nerve damages.  Much of it is the 
brain trying to process all the repairs and clean damage.  Much like night 
terrors the kids got as youngsters.  Brain trimming axons and stuff.

All mechanical/auto is through the at fault party insurance.

I have been spending the day trading email with the insco drone.  I am not able 
to carry on business telephonically because the brain trauma has resulted in 
increase aggressive response to perceived threats.  I end up yelling and 
becoming unreasonable.  When I am able to calmly state my case and have the 
requisite time to gather my wandering sheep thoughts, I can compose a fairly 
coherent missive.

out at the end of the three year term.  I had to work in pain and with mental 
clouds this month because the lost wages coverage would have required I have no 
income for the month.  This just increases the need for more therapies to 
alleviate the damage.

As it is, I am not sleeping well, and have been waking up screaming in the 
middle of the night the past two weeks.  Dealing with microcephalic insurance 
drones just makes my head hurt in the most excruciating manner.

In a no-fault state, if the claim is against the at-fault driver's
insurance then you do not have a contract with the insurer.  Court is then
always an option.  If _your_ insurance is involved at all, then that would
be different.  You _do_ have a contract with them.  (This is a lay opinion,
and worth every dime you paid for it.)

Dear Mr Claims Adjuster: How many of the cars you consider comparable are one 
step away from the junkyard, and how many of them have had $4000 worth of 
paintwork in the past year? Oh, and BTW, I'm still experiencing headaches, 
since you're paying for the CAT scan, is there a particular hospital you'd like 
me to go to?  (in all seriousness, in Clay's case I would not use the medical 
claim for leverage on the property damage claim, he wants to keep the medical 
claim open for as long as possible because there may be lingering effects)

When I got a lowball offer on my 300D is burst out laughing, as I'd already 
bought a replacement at a significantly higher amount (3x if I remember 
correctly).

They paid the full amount of the purchase price of the replacement, minus 
salvage since I kept the hulk for parts.  

Definitely hold out for the upper end of the value range in Kelly Blue Book or 
similar.  Most insurance company adjusters don't understand the value holding 
ability of a well maintained Benz.

And that’s the way to do it.

They want to get the claim paid out and closed as quickly as possible.  
However, do understand that they are subrogating the claim with the other 
carrier, meaning that the other carrier is the one on the hook and your insurer 
is paying out with the expectation that they will collect from the other 
carrier.

More time = more money.  Not something the insurer wants.

As it has been pointed out, do the following: 

Document, document, document.  The more proof of value you have the better and 
stronger your case is.  Pictures, receipts, etc., etc.  The more the merrier, 
and the stronger your case.  Do realize that if you spent more than the car is 
worth you’re not going to recover those dollars, they’re only going to give you 
what the market value would be and not include the money for the 22s you’re 
rolling, so to speak.

State your claim clearly and professionally, without emotion. Make your claims 
realistic based on the data you have collected.  Understand that they’re going 
to look at an average value and toss the outliers, so if you do have outliers, 
make sure they’re waaa out in order to shift the curve in your favor, if 
possible.

Court is most likely not an option, as nearly every insurer has an arbitration 
clause in their policy.  If it goes to arbitration you’ll get screwed as the 
tables are tilted in their favor, of course.

However, arbitration is timely and costly, two things they want to avoid, so 
it’s unlikely that it will go that far.

Remain firm with your claims, be reasonable and rational and you’ll get the 
settlement you want or darned close to it.  Time is on your side as they are 
under great pressure to close out claims and move on.

I plan on waiting these bastards out for a long time.  It would be nice to have 
an equitable settlement swiftly, but I have a few cars that will serve until at 
least March or so.  I can pay the ransom and bring the car home.  It is just a 
matter of reimbursement when they remove head from buttocks and make me whole.

Record of what you have in value in the car.
Value reports by various places, like Blue Book.
Comparative replacement value based on available market listings.. I would
go beyond the 500 mile radius even to gather "equal value listings of like
cars."

Then... write a demand letter stating your cars value, based on all the
above points.
All they can do is say ... OK, we tried to low ball you... Here is our new
offer..

So, I had a chat with the body shop boys.  Seems insco has a bug in bum to not 
repair Allen.  They give a lowball valuation that has not been disclosed, but i 
probably south of $3k, that does not take into account the $2900 I spent 
getting it all pretty with fresh paint, replaced seats and carpets, upgraded 
stereo, lighting, and making everything work for the most part.  

How should I deal with the adjuster?  Will they adjust value with all my 
receipts over past 6 months?   I have MBCA valuation from the buying guides.  
NADA give a much higher value, as do a bunch of other websites.   Looking for 
replacements, I find either cars good only for parts at around $2k, or cars 
with other issues for 5-15k.   There are few to no comparable cars within 500 
miles.  Kollyfurnyer has a few comparable.
