Nobody can require that, that'd be stupid - how one can guarantee
nobody has patent to something? Even very expensive patent search
doesn't give such guarantee - patent interpretations differ widely
and there are submarine patents. Only thing one can reasonably
guarantee is that the code is not covered by his own patents or he
is granting license if it is and that he doesn't knowingly use
somebody else's patented technology without having appropriate
license.
I also think its ridiculous to grant someone a patent on using
cookies (aka one click shopping) but still students of law apparently
have decided its a good idea. If the clause does indeed not mandate
that I grant all patents the code infringes upon, then the life of
patent trolls is still pretty easy. Whatever, I think the language is
not clear and I also am not willing to pay for a lawyer to get this
cleared up for me.
