As per information received from 69 Ministries/Departments of Government of India, there were 8,335 backlog reserved vacancies for persons with disabilities, including visually handicapped, as on 15.11.2009. A Special Recruitment Drive has been launched to fill up these backlog reserved vacancies, through which 1235 vacancies have been filled up. Disability-wise information of the backlog vacancies is not centrally maintained. This information was given by the Minister of State in the Ministry of Personnel, Public Grievances and Pensions Shri V.Narayanasamy in written reply to a question in the Rajya Sabha today. Kolkata: Md. Mannan Biswas of North 24 Parganas district in West Bengal has been selected for the National Award for the Empowerment of Persons with Disabilities, 2010, which shall be conferred on him by President of India Pratibha Devisingh Patil on the International Day of Persons with Disabilities on 3rd December in New Delhi. Mannan is the only person selected from West Bengal under the category of ‘Best Employees/Self-employed with Disabilities Blindness’. Mannan’s research work in mushroom cultivation and training of village youth for the profession has brought him the honour. Md. Mannan Biswas In 1997 he heard a radio advertisement about Narendrapur Ramkrishna Mission which had launched an academy to teach the blind persons in one and half years. He trained from the academy in Mushroom cultivation. After the training, 10 years ago, he started Mushroom cultivation in his home with the help of his child Mohinur who is reading in ‘Rajibpur Anglo Vernacular High School’. Day by day he increased his production and marketed in the cities like Howrah, Barasat and Saltlake. Then he started training local youth who were interested in Mushroom cultivation. Lots of young boys have so far been trained by him and they have self-employed by growing Mushroom in their home. For Mannan’s extraordinary work, his village Malickberia is now called ‘Mushroom Village’. Blind by birth Mannan is living in a remote village named Malickbaria under Ashok Nagar Police Station of District North 24 Parganas, about 70 kms from Kolkata. Md Mannan Biswas is glad and now preparing to go to Delhi to accept the award from the President of India on 3rd December, 2010. Subject:- Use of own car / hired taxi on LTC journey on account of physical handicap – 28th October, 2009 The undersigned is directed to refer to this Department’s O.M. No. 3101114/2008-Estt(A)dated 23.9.2008 in which it was stipulated that LTC facility shall be admissible only in respect of journeys performed in vehicles operated by the Government or any corporation in the public sector run by the Central or State Government or a local body. 2. Instances have come to notice where Government servants on account of physical handicap/disability of self or dependant family members are unable to perform the LTC journey by the authorized modes of transport and are compelled to undertake the journey by own car or private taxi. Representations are being received to allow reimbursement in such cases. Matter has been examined in consultation with the Ministry of Finance, Department of Expenditure and it has been decided in relaxation of LTC Rules to authorize the Head of Department to allow use of own/hired taxi for LTC journey on account of disability of the Government servant or dependent family member after obtaining following papers/conditions to avoid misuse of such relaxation:- (i) Medical Certificate from competent authority. (ii) Undertaking from Government servant that journey in authorized mode is not feasible and he actually travelled by own car/hired taxi. DIFFERENTLY ABLED CANDIDATES TO APPEAR FOR CAT As many as 630 disabled students will battle it out for the three percent seats at the Indian Institutes of Management [IIMs], when they write the Common Admission Test ]CAT] on November 9th this year. This year, the CAT committee has adopted a series of measures to make the test disabled friendly. From additional personnel for escorting the candidates, the CAT organizers appear to have geared up to conduct the computer based test [CBT] for the differently abled candidate. We have advised the administration at test centers to conduct the test on the ground floor for the differently abled candidates. Besides, we will provide testing aid for them said Himanshu Rai, Convener, CAT 210. The guidelines drawn up by the IIMs have defined categories like low vision/blindness, hearing impairment, locomotor disability/cerebral palsy for differently, abled students. They will be allowed to use technical aids like abacus, hearing support, wheelchair, magnifying screen and scribe/reader. However all these approved means of assistance will have to be brought by the candidates. Candidates suffering from low vision, blindness, cerebral palsy will be allowed to bring a scribe. Differently abled candidates will have to sit for a longer version of CAT exam at their specific test centers. The total time for the test under special accommodations will be increased from two and a half hours to three and a half hours. However, a differently abled candidate requiring support at the test can not re-schedule the test. But a differently abled candidate not requiring support during the test can res-schedule his/her test online. Candidates who have requested for support during their test should carry the authorization copy mailed to them by Prometric India. [AI] ROCKET ON FAKE DISABILITY CERTIFICATES IN KARNATAKA STATE
BANGALORE: Divya (name changed) claimed she was speech and hearing impaired, and even had a certificate to prove it. But when a Lokayukta health investigator whispered in her ear, What's your name?, she responded immediately: Divya. Don't be shocked. For, Divya is just one among many perfectly normal people who have got themselves a certificate attesting to their disability. All they did was pay touts any amount between Rs 3,000 and Rs 5,000. The benefits are many: a monthly allowance of around Rs 1000, a bus/train pass, employment, identity card or even a telephone booth! Genuine certificates are issued free of cost by authorised hospitals. Lokayukta investigators have unearthed a racket in which touts will help you get these certificates. Two NGOs dealing with disability, Angala Vikalara Jagruti Maha Samiti and Pragati Anga Vikalara Shema Abhivruddhi Sangha, lodged complaints with the Lokayukta office about discrepancies in issuing disability certificates. Subsequently, Lokayukta Justice N Santosh Hegde entrusted doctors of Health Foundation to investigate. Investigators found material which indicated there was prima facie truth in the allegations and there're gross discrepancies while issuing certificates. Their complete report will be submitted to Justice Hegde soon. While there were discrepancies in certificates issued by several hospitals in the city, the disability board of a government hospital is particularly notorious for violating guidelines. When Lokayukta investigators visited the board, instead of three experts who would issue certificates as stipulated in central government guidelines, five doctors of different specialialites were examining people. These experts were paid Rs 800 per visit and they were not government employees but private practitioners. Lokayukta investigators — Dr C S Hanumanthappa, Dr R Chandrasekhara, Dr K Srinivasa Murthy and Dr K R Kamath — raided the board and after finding many discrepancies, summoned around 40 people who had been issued disability certifica-tes. Only 26 of them turned up. Instead of regular doctors, we called doctors from Bowring Hospital and Victoria Hospital. Many cases were found faulty. The institute is supposed to rehabilitate disabled persons by issuing them aids like Jaipur Foot or hearing aids and training them but none of it was done. They were only issuing certificates, Lokayukta investigators, who were part of the raid, told TOI. It's not surprising that just after the raid, the board wound up operations in a mysterious manner and said it was no longer authorised to issue certificates. Book Release Convention on Rights of Persons with Disabilities - A guide by Commonwealth Secretariat New Delhi, September 3rd, 2010 The approach to people with disabilities both nationally and internationally, has, for far too long, been built on a model of care and entitlement based on charity. There is a paradigm shift in the approach regarding the rights of persons with disability from the charity model to a human rights based model. The human rights model positions disability as an important dimension of human culture, and, it affirms that all human beings irrespective of their disabilities have certain rights which are inalienable. The National Human Rights Commission has been deeply concerned about the protection and promotion of rights of persons with disabilities. The Commission is of the view that the persons with disabilities should enjoy all human rights on an equal basis with others. Towards this end, the Commission has adopted a multi-pronged approach which includes redressal of individual complaints, legislative and policy reform, spreading of awareness etc. The Commission has been involved since the formative stages of the UN Convention on Rights of Persons with Disabilities (CRPD). The Commission advocated the ratification of the UN convention and finally the Government of India ratified the Convention on 1st October 2007. As a follow up action, the Commission appointed a Special Rapporteur on Disability related issues and constituted a Core Advisory Group on Disability to advise the Commission on matters connected with and incidental to the promotion, protection and monitoring of the human rights for persons with disabilities. With a view to assess whether existing Programmes and Policies for persons with disabilities are having the desired impact and to identify gaps in implementation, if any, and to suggest appropriate strategies to deal with them, the Commission organized five Regional review meetings on Disability during 2008-09 in various parts of the country. The Commission has advocated to the Government of India for the ratification of Optional Protocol to the UN Convention on the Rights of Persons with Disabilities. The Commission is of the view that the Optional Protocol will strengthen the accountability mechanism and serve as an additional tool for the promotion of the rights of persons with disabilities. The Commission reviewed The Copy Right (Amendment) Bill, 2010 from Human Rights perspective and noted that it does not meet the demand of print disabled person. With a view to protect the rights of the print disabled people, the Commission made recommendations for amendments in The Copy Right (Amendment) Bill, 2010 which is being examined by the Parliamentary Standing Committee. With a view to monitor the implementation of various laws, policies, concerning the rights of the persons with disabilities, Special Rapporteurs, NHRC have been visiting various states. The Commission has also asked all the State Governments to give wide publicity to UNPRCD to create awareness regarding the rights of persons with disabilities. With a view to create awareness and sensitize various stakeholders regarding the various provisions of CRPD, the Commonwealth Secretariat has published a book entitled Convention on Rights of Persons with Disabilities - A guide by Commonwealth Secretariat. This book enumerates various provisions of the Convention in a very simple and informative manner. It not only clarifies that States should not discriminate against persons with disabilities, but also sets out the many steps that States must take to create an enabling environment so that persons with disabilities can enjoy real equality in society. Further, this book is also accessible to the persons with visual impairments. This publication has been released simultaneously at the four centers around the world by the Commonwealth Secretariat. In recognition of the work done by NHRC in the field of protecting and promoting Human Rights of persons with disabilities, NHRC is selected as one of the four institutions for releasing this book. Today on 3rd September, 2010 Hon'ble Chairperson, National Human Rights Commission, Justice Shri K.G. Balakrishnan has released the book in a function organized in the National Human Rights Commission. Justice Shri G.P. Mathur, Justice Shri B.C. Patel, Shri Satyabrata Pal and Shri P.C. State government rapped for inaction over disability issue The state government faced the Bombay High Court's ire for not complying with its August 9, order for filling up vacancies reserved for the disabled by July 31. Stating that inaction was writ large on the government's face, a division bench of Justices R M Lodha and S A Bobde extended the deadline by three more months. The Court said that unless the backlog - as on June 30 - is filled, the government and its 27 departments would be restrained from any recruitment for any post on which a handicapped person could be appointed. While hearing the two public interest litigations filed by the National Federation of Blind (NFB) and ILS Legal Aid, the Court expressed unhappiness over the affidavit filed by the Chief Secretary D K Sankaran and said that it was clearly an eyewash and the claim was hollow. The Court also came down heavily on Associate Advocate-General Ashutosh Kumbhakoni when he said that 22.81 per cent of the total vacancies for the disabled were to be filled. If the government does not know what it's doing, then it should stop functioning, Justice Lodha said, adding that the government has put the Persons with Disabilities (Equal Opportunities, Protection of Rights and Full Participation) Act 1995, in cold storage with no effort to implement it. On August 9, the High Court issued a show-cause notice to Sankaran asking why contempt proceedings should not be initiated against him for not complying with the February 14 order to fill up vacancies. Deputy Secretary (Social Justice) Special Assistance Department Jagdeo Rathod, in his affidavit, stated that of the 19,202 vacancies reserved for handicapped - blind or low vision, hearing-impaired, locomotive disability or cerebral palsy, 10,082 had been filled. However, the affidavit filed by Sankaran a month later, said only around 2,700 vacancies were to be filled. This claim was disputed by Advocate Uday Warunjikar, appearing for the NFB. Justice Lodha, then directed Kumbhakoni to ensure that the petitioners' advocates be given registers of all 27 government departments on September 14, to inspect the total recruitment and vacancies in each department till June 30. The Court directed Disability Commissioner R K Gaikwad to remain present for the next hearing on October 5 and file an affidavit in three week indicating the exact number of vacancies and fill up the backlogs within three months. HAVE YOU FACED ANY PROBLEMS USING RTI ? Answers: No, I have issued several court suo-motto notices, directions, enquiry notices and also lawyer notices to several government offices, institutions,establishments have never faced /forced to issue RTI applications. As some one offices I have touched was reacted suddently after issuing lawyer's information letter, so it's not my lpractice to issue RTI application about the grievances I have faced in any koffices. It needlessly say here that during that period there have no such acts like RTI and people used to obtain information only by issuing lawyer notice, court intervention etc. Hence present RTI act is very useful and economically be appraisable to poor people like in india. 2. WHAT SORT OF PROBLEMS YOU HAVE FACED? I am an clean activist for disabled person's rights and their movements. When government of India passed an amendment called Persons with Disability[Equal Opportunity Protection ] Act 1995 but was not implimented even after 3 years gap when parliment has passed the amendment for disability act. After watching the time being I approached the relevent central government offices to enact the disability act and sought for the informatioln. But non-one has responded for my querry on information nor given any records. Therefore I approached an public litigation maintaining NGO named COMMON CAUSE at New Delhi, then Common Cause issued information letter to the Secretary Governemnt of India and the department was not reacted well in time. Governement's approach on a casual attitude towards prestigious NGOs forced me to complain before National Human Rights Commission, New Delhi, and NHRC sought information and directed the concerned department to issue relevent records, information to me. Accordingly Secretary,Governemnt of india immediately reacted and despated me the Gazette of India which having important clues and notification on PERSONS with DISABILITY ACT -1995 and also appointed Chief Commissioner for Disabilities in New Delhi and subsequent Commissioners in all capital city of a state. Hence using RTI application was not arise at this stage. 3. ACCORDINGLY WHAT CHANGES WOULD YOU SUGGEST IN WHICH SPECIFIC CLUES ? As present system is not able to popularise RTI Act,hence an awarness among public by following systems is be implimented:- [a] It's better to propularise RTI Act among general public and also for illeterate persons. [b] By using news paper advertisemnts, TV slide shows, wall-posters, it could be well behaved for each one and expected to be encouragement to the concerned people in a state also. [c] In my openion RTI was not popularised about what purpose4 the RTI has been established and the real purpose of the act etc in general public, due to this several people using this act as a casual approach also, thereby precious times, workforce, ideas perhaps could l be destroyed in several occassions. Some people using illeterate person for mis-handling the RTI Act for pettitious gain like prestige making, money lending and any other undisclosed purposes Some times it was used for black-mailing the concerned offices of it's subsidieries in what we not to disclose here. Due to mis-using the RTI act following are the problems we should face:- [a] Precious times be destroyed/wasted [b] Institutions/authorities may be on black-mailed [c] Some one could be manage to mis-lead an office or authorities for pittitious gain. Court of the Chief Commissioner for Disabilities, Punjab 2008 A case which obtained a conveyance allowance for a disabled man Sudarshan Kumar was employed in the Office of the Deputy Commisioner, Hoshiarpur when he was forced to undergo surgery in 1994 to remove one of his kidneys. In 1996, the Punjab Government issued a directive stating that removal of one kidney constitutes a 60% disability for employment and other purposes. Case Details and Status In 2002, Mr. Kumar obtained a 60% disability certificate from the state medical board and promptly showed it to his employer, asking for a conveyance stipend. Despite this clear evidence, his employer refused. Mr. Kumar consulted with HRLN-Chandigarh and filed a petition before the Chief Commissioner for Disabilities, Punjab to receive his due conveyance allowance. The respondents tried to claim that since the conveyance allowance was established in 1982, before the Disability Act, it was not enforceable under the Act. In an order dated 5.3.2008, the Chief Commissioner rejected this argument and granted Mr. Kumar the conveyance allowance in stipulated amount of Rs. 250/month. 2. Docket: Surinder Pal vs. Director of Public Instruction Court of the Chief Commissioner for Persons with Disabilities, Punjab 2007 A case which obtained a job as a lecturer for a disabled man Surinder Pal is a physics teacher by trade who was trying to get a job as a lecturer Punjab, responding to an advertisement that 20 of the 658 slots would be reserved for persons with disabilities Case Details and Status Mr. Pal has a locomotor disability. The 20 slots were to be divided equally among males and females. When Mr. Pals application was being considered 18 had been filled by 10 females and 8 males. Mr. Pal was 3rd on the merit list for the two slots, and therefore was rejected, despite the fact that he was the highest male on the list. He consulted with HRLN-Chandigarh and filed a petition in before the Chief Commissioner for Persons with Disabilities, Punjab. After hearing arguments and issuing preliminary orders to get the uncooperative respondents to comply with requests for information, the Commissioner issued a final order on 18.9.2007, ordering that Mr. Pal be given his post immediately. 3. Docket: Sukhdev Singh vs. HPVNL, Panchkula Court of Chief Commissioner for Disabilities, Hary A case which obtained back pay for a disabled employee whose just promotion was unfairly delayed Sukhdev Singh was employed as a cane weaver in the Panchkula HPVNL since 1986. After he had been working for five years, he expected to be considered for a promotion as per the organizations policy Case Details and Status When he wasnt, he filed a petition before the Punjab and Haryana High Court. In 2005, the High Court ruled that he must be promoted. The order was complied with and Mr. Singh was promoted to clerk in 2005. Since the promotion should have occurred much earlier, Mr. Singh asked for some compensation for the almost 10 year period during which he was denied the benefit of his promotion. To obtain his due compensation, Mr. Singh consulted with HRLN-Chandigarh and a petition was brought before the Chief Commissioner for Disabilities, Haryana. To combat this, a series of public interest petitions were filed on behalf of a society of disabled employees of Delhi University. In a series of orders beginning on 4.4.07, the High Court ordered the university to stay the hiring process for all the relevant positions until the requisite reservations were met and directed them to take all steps to make it happen as soon as possible. As a result of the orders, 70 blind lecturers were hired by Delhi University and the affiliated colleges. Govt decision will bring better mobility for physically challenged In a move that could bring about better and safer mobility for the physically challenged people, the Union government has restored the power to approve retrofitted two-wheelers by state governments under the Motor Vehicles Act. A few years back, this power was withdrawn as it was misused by vehicle owners who made changes to the two-wheelers, altering the fundamental safety features built in by two-wheeler manufacturers. The Ministry of Shipping, Road Transport and Highways, in a notification issued last week, has granted exemption from alternation in motorcycles to be used by physically challenged people that can be approved by state governments. While granting this power, the Union government has also brought in clear guidelines on how these changes can be made, who can make them and a stringent set of guidelines for approvals. These vehicles will also bear the insignia (see logo) to indicate that the owner of the vehicle is a physically challenged person. Changes mandated by this notification include shifting of leg controls (like gear and brakes) to hand control as well as either hand-start or electric start to make driving easier for the physically challenged people. Two more features will also be added to the vehicle, such as the intentional locking mechanism that will help the person alight the vehicle without the risk of roll-over and clamping arrangements carrying crutches. The kits for converting regular two-wheelers to those for the physically challenged will be sold only by select manufacturers who will need prior approval from the government after testing for brakes and ability to handle gradation. Only workshops approved for fitment of the kits can make the changes to the vehicle. The approval, according to this notification, will be based on competence, availability of necessary equipment, experience in the relevant field and manpower. Further, different types of disabilities have been now listed which can be given driving licence. BANGALORE: Karnataka High Court judge V. Gopala Gowda on Thursday said if the disabled persons did not get equal opportunities even after 10 years of the enactment of the Persons with Disabilities Act, 1995, there must be something wrong in governance. Speaking after inaugurating a conference on the implementation of the Act organised by the State Commissioner for Persons with Disabilities here, Mr. Gowda urged the State and Union governments to implement the Act in letter and spirit. Mr. Gowda said courts, including the Supreme Court, always favoured equal opportunities for disabled persons and had often come to their rescue. He urged the disabled persons to approach courts and legal services authorities to redress their grievances. In a presentation, an official of the office of the Commissioner for Persons with Disabilities said though the State Commissionerate was adjudged the best by the chief commissioner, there were several grey areas where justice had to be done to disabled persons. While five per cent reservation in government jobs was yet to be provided, insufficient budgetary allocation was coming in the way of implementation of many schemes for the disabled. Twenty of the 27 offices of deputy commissioner in State were situated on the first floor denying free access for the disabled. There was no separate finance corporation on the lines of the one in other States to fund projects to be taken up by the disabled. Also, medical boards established at district headquarters to certify disability were not functioning properly. Officials of various government departments made a presentation on the plan of action for implementation of the Act. Sir/Madam, I am directed to say that the most important aspect of rehabilitation of persons with disabilities is their economic rehabilitation, which can be achieved by providing employment or through self-employment. Government has been promoting the selfemployment of persons with disabilities by providing vocational training and loan on concessional rates through National Handicapped Finance and Development Corporation (NHFDC). Employment of persons with disabilities in the Government is promoted through reservation. Section 33 of the Persons with Disabilities (Equal Opportunities, Protection of Rights and Full Participation) Act, 1995 provides for a reservation of 3% in the vacancies in identified posts (1% each for persons with blindness or low vision, hearing impairment and locomotor disability or cerebral palsy) in the Government establishments including the Public Sector Undertakings. To promote employment of 1 persons with disabilities in the expanding private sector, it has been decided that incentives be provided to the private sector employers. 2. Section 41 of the Persons with Disabilities (Equal Opportunities, Protection of Rights and Full Participation) Act, 1995 provides for incentives to employers to ensure that at least five percent of their work force was composed of persons with disabilities. The National Policy for Persons with Disabilities, which was adopted in 2006 also lays down that pro-active measures will be taken to provide incentives, awards, tax exemptions etc. to encourage employment of persons with disabilities in private sector. Accordingly, Finance Minister in his Budget Speech had announced a Scheme for employment of physically challenged in the organised sector. 3. After consideration, the Government has approved the enclosed scheme of providing incentives to the employers in the private sector. Under the scheme, the employees with disabilities covered under the Persons with Disabilities (Equal Opportunities, Protection of Rights and Full Participation) Act, 1995 and the National Trust for Welfare of Persons with Autism, Cerebral Palsy, Mental Retardation and Multiple Disabilities Act, 1999 and working in the private sector, with monthly wage up to Rs.25000/- per month would be covered. The scheme would be applicable to all the employees with disabilities, who are appointed on or after 1.4.2008. 4. Thousands of such booth owners were to be evicted on Friday. Public Telephone Their contracts, which were ending on April 27, have been further extended for three months, official sources said, but declined to elaborate. On April 7, the Hindustan Times had reported the Railway Board's move to evict the booth owners. On April 9, taking cognisance of the HT report, the Court of the Chief Commissioner for Disabilities stayed the eviction and issued a show cause notice to the Railway Board through its Secretary. It asked why the said Public Call Office (PCO) scheme should not be continued and to submit the version of the Railways on the newspaper report within 30 days from the date of receipt of this notice. COMPUTERS TO REDUCE GAP BETWEEN ABLE DISABLED Efforts are underway to come up with a more user friendly computer that responds to physically challenged individuals. Current designs are particularly frustrating for the disabled, the elderly and anybody who had trouble with a mouse. A new approach developed by Washington University researchers would put each person through a brief skills test and generate a mathematically based version of the user interface optimized for his or her vision and motor abilities. Assistive technologies are built on the assumption that its the people who have to adapt to the technology. We tried to reverse this assumption, and make the software adapt to people, said the studys co-author. Tests showed the system closed the performance gap between disabled and able bodied users by 62 percent and disabled users strongly preferred the automatically generated inter faces. This shows that automatically generating personalized interfaces really do work, and the technology is ready for prime time, the author said. The system called supple begins with a one-time assessment of a persons mouse pointing, dragging and clicking skills. A ring of dots appears on the screen and as each dot lights up the user must quickly click on it. The task is repeated with different sized dots. Other prompts ask the participant to click and drag, select from a list and click repeatedly on one spot. Participants can move the cursor using any type of device. The test takes about 20 minutes for an able bodied person or up to 90 minutes for a person with motor disabilities. Researchers tested the system last summer on six able-bodied people and 11 people with motor impairments. The resulting interfaces showed one size definitely did not fit all. A man with severe cerebral palsy used his chin to control a trackball and could move the pointer quickly but spastically. Based on his skills test, supple generated a user interface where all the targets were bigger than normal, and lists were expanded to minimize scrolling., In contrast, a woman with muscular dystrophy who participated in the study used both hands to move a mouse. She could make very precise movements but moved the cursor very slowly and with great effort because of weak muscles. Based on her results, supple automatically generated an interface with small buttons and a compressed layout. The Disabilities Act provides for the following authorities: ¨ Chief Commissioner (at the Central level) and State Commissioners ¨ Central and State Coordination Committees ¨ Central and State Executive Committees Q. What are the powers of Chief Commissioner/State Commissioners? A. The Chief Commissioner may, on his own, or on the application of any aggrieved person, or otherwise, look into complaints with respect to: v Deprivation of rights of disabled persons v Non-implementation of laws, rules, bye-laws, regulations, executive orders, guidelines or instructions framed for welfare and protection of rights of disabled persons ¨ The Chief Commissioner may thereafter take up the matter with the appropriate authorities ¨ The Chief Commissioner shall also: v Coordinate the work of the State Commissioners v Monitor the utilisation of funds disbursed by the Central Government v Safeguard the rights and facilities available to disabled persons v Submit reports to the Central Government on the implementation of the Act at regular intervals ¨ The State Commissioner have the same power/functions at the State level Q. What are the functions assigned to the Coordination Committees? A. The Central and State Coordination Committees-at Central and State levels respectively-must review and coordinate the activities of all government departments and NGOs and advise the respective government on formulation of disability-related policies, programmes, legislation and projects. They must also monitor and evaluate the impact of policies and programmes designed for achieving equality and full participation of disabled people and such other functions as may be prescribed by the government. Q. What are the functions assigned to the Executive Committees? A. The Central and State Executive Committees have been at Central and State levels, respectively must carry out the decisions of he Central Coordination Committee and perform other functions which may be delegated to it by the Coordination Committee. What can I do? Q. What must a disabled person do to enforce the rights created under the Disabilities Act? A. A disabled person can make representations to the concerned government and/or the concerned establishment, if there is deprivation or violation of any right provided under the Disabilities Act. If there is no response, or if the response is negative/inadequate, one can approach the concerned Commissioner of Disabilities. Alternatively, one can file a Writ Petition under Article 226 of the Constitution of India, in the concerned High Court. If there is any violation of a Constitutional right also, of national importance, a Writ Petition can be filed under Article 32 of the Constitution, before the Supreme Court. Q. What can be done against violations of the rights under the Disabilities Act, that affect an entire group of disabled people? A. A disabled individual or a group of disabled individuals or even a concerned NGO, may, on behalf of the affected group or class, initiate Public Interest Litigations (PILs) in the High Court, or, where it also amounts to violation of Constitutional rights of national importance, in the Supreme Court. For instance, PILs may be initiated on issues regarding education and/or employment of the disabled, use and access in public transport system, civic amenities, public buildings, or the like, which affect and benefit more than one disabled person. International Institute to train leaders among visually impaired persons #150; Applications invited An International Institute for Social Entrepreneurs (IISE) in Trivandrum, created by the Founders of the Braille Without Borders Sabriye Tenberken, who herself is blind and Paul Kronenberg, is all set to train about 40 young visually impaired persons from different parts of the world with skills to set up their own social or environmental projects in their countries. The year-long training programme will commence in January 2009 and is open to visually impaired adults above 18 years of age. 5-10 visually impaired youth from India will be fully sponsored for this course.
