My understanding is that Derrick May has 'DEMF' trademarked, while Carol 
Marvin has 'DEMF' incorporated.


I know nothing about copyright law, so I'm not sure if one of these cancels 
out the other or if they both have equal right to the name.

 That was my understanding too, Mark. 

 I think I'll just keep my seat in the audience and
let all who are involved deal with it as they may.

 HOWever, I think it's really unfortunate that
something that was so beautiful and community oriented
in its beginning has turned into a somewhat monster of
egos. What does this portray to people on the outside
of Detroit, of its music community? I wish those
involved who are keeping the festival from progressing
could put egos and self claims aside and see that this
festival is and always was supposed to be about-
showing people that Detroit, with all its bruised
reputations, can take this music and turn it into
something positive for the city. I believe Derrick and
company still have this vision and could do it
justice, as Carl did the first year. I really think
they have a chance here for a clean slate and to start
over from the beginning. To get the festival back to
its roots of the first year and completely start over.

If Carol is _truely_ for the community as she has said
from the beginning in interviews and so forth, then
she would relax and wish Derrick, and the city of
Detroit the best.

Well, from what I know, incorporating DEMF would simply mean that a business
named DEMF, Inc. exists.   A trademark, on the other hand, gives you the
right to market a product or services under a given name, like a brand name,
regardless of the name of the company that is selling the product.  So ,
given the information you just gave,  I'd guess that Marvin's DEMF Inc.
would not have any right to market an event called DEMF or a product that
says DEMF (tm) on it, only May or his company would have that right.
Possibly Marvin could be sued for infringing on the trademark if that
happened.  I'm no lawyer but this is my understanding of it.  This is only
true if May really owns the DEMF trademark, of course.

Yep - that's right.

Incorporating doesn't hold any legal rights to the name - it's more about
how you are taxed and what happens if you run into financial/legal
problems.
It doesn't give you any rights to the actual name of the organization.
That's the trademark.
However, it does protect your personal finances.

If Derrick has successfully put a trademark on the name then Pop Culture
cannot use it - Derrick's lawyers will issue a cease and desist order.
He essentially will own the image and therefore the festival.

According to the article the currently named DEMF Inc. is planning on doing
a DEMF tour. Isn't the whole point of the festival to GO TO Detroit for
the music?
I can see wanting to bring it to the people but why do that? Everyone will
just wait for it to come to their town and never experience Detroit City.
What good is that?!

So taking the festival OUT of the city will support Detroit how?? It might
make the music more visible but it won't draw people into the city itself.
Won't bring any money into other sectors of the city - hotels, restaurants,
car rentals, museums, theatres, tax revenues, record shops, airport,
parking garages, etc.
Why go to Detroit to hear the music when I can go to Chicago when the tour
stops there, or catch the show in L.A./Houston/Miami/etc.?

The music is part of the city and the city is part of the music -

 DEMF Inc. senior executives, Tommy Hearns, Carol Marvin and Michael Smith
will be attending the opening of the Detroit Techno exhibit at the Detroit
Historical Museum on Friday evening. A significant portion of the exhibit
showcases the 1994 The World Party and the 2000 Detroit Electronic Music
Festival -- both of which were produced by Marvin.

Does Derrick have the right to claim the trademark DEMF? I mean I know we all 
wish he can, or atleast anyone but Marvin, but if the DEMF was based on the 
work commercially done by Marvin's Pop Culture, and then someone else comes 
in and scoops the name up, from what I know about law, Derrick shouldn't be 
able to obtain the rights. I mean this is a city sponsored event by the Dept. 
of Recreation. Not a private venture. I believe the city of Detroit has the 
first priority to the name they sponsored, and they invested in.  I mean for 
example, if I operate a Pizzeria in Detroit named Big Dave's, but don't make 
any appropriate claim to the name, yet my reputation is built on it, then an 
unknown Big Dave's pizza trademarks the name, and tries to work off the 
success of the first Big Dave's pizza, from what I believe the First Big 
Dave, can sue the 2nd Big Dave for the rights to the name. and usually that 
party wins. I want an Electronic Music Festival in Detroit. I want anyone but 
the Marvin team to promote it, but as far as name ownership, I believe the 
city has first dibs, and the Pop Culture has 2nd's if the city doesn't want 
it.
Any business lawyers out there?

The wordsmithing involved in a sentence like this in their lame press
release tells it all:  The City of Detroit remains an important part of
the planning process for presenting the commercially-owned DEMF as an
annual event hosted at Hart Plaza.

Oh yeah?  Well, guess what, Carol, you LOST the bid and as we used
to say in high school after nailing a jump shot over a chump, in your
face you disgrace!

Now, older and more mature, I would call this an undeclared assertion
(support from the city) to a nonexistent object (commercially-owned
DEMF annual event).

All this stuff from Carol Marvin really boils down to a demand to pay
her off so she'll go away.  The Hearns thing is particularly cynical.
It's all about lawyers from now on, so if I were Derrick May and Carl
Craig I'd say, see you in court -- if you dare.

And if the new festival can't use the DEMF name, I'm sure another
can be found, and maybe not such a bad idea anyway since it would
allow rebuilding the brand in a direction more true to the real
meaning and history of electronic music in Detroit.

PS On a side note, what's EFF doing mixed up in all this?  I could swear
that was him I saw at the first DEMF, talking about how he's been in this
for over 20 years and I still don't get no love, and it was definitely
clear who he was talking about in terms of his scheduled time and stage
location at the festival.

But seriously, when it comes to the rivalries and all that, I prefer to
say, I'm a fan.  Let the music play.  There will be an electronic music
festival at Hart Plaza this May, I will be there, and it will all be good.

I heard last year a bunch of detroit artist, that did not play the demf wanted 
to do a free event at the same time in washington square. they susposably got 
the go ahead from the city, but the police said they were to low on officers. 
so it never happened.

this is what someone told me last year. I dont know how true the story is. 
anyone hear this? or something like it.

 A significant portion of the exhibit showcases the 1994 The World Party 
   
oh god, really??  Detroit music and underground party scene existed just fine 
on it's own before Marvin threw a Supersized Stadium Rave[TM] right in the 
heart of it during the World Cup.  That just seemed s out of character for 
the city at that time. Despite the lineup I remember myself an lots of others 
making a conscious decision NOT to go.

simple, i think it depends on how your brain is wired at the moment of
listening. but i cant sleep with music on. If anyone has any further

Not forgetting the mighty BOC.  Music has the right.. is a landmark LP of
that genre. A shame that Geogaggi couldn't quite follow it up.

On a Detroit tip, Infiniti's Skyway one the best things Juan ever did
IMO.

Here is where I stand (for those who don't know).  I'm happy that May and
Craig fought for the demf, and got the right to produce the next one.
Jumping for joy am I.  really.

But thinking of the DEMF as a bundle of resources (contracts, prestige,
etc.), I think you're putting too fine a gloss over it.  In as much as
these resources are zero-sum (there are only so many contracts and
prestige to go around), POLITICS ARE INVOLVED.

When politics are involved, communities fracture.  That's the name of the
game.  People have different interests.


 I wish those
 involved who are keeping the festival from progressing
 could put egos and self claims aside and see that this
 festival is and always was supposed to be about-
 showing people that Detroit, with all its bruised
 reputations, can take this music and turn it into
 something positive for the city. I believe Derrick and
 company still have this vision and could do it
 justice, as Carl did the first year. I really think
 they have a chance here for a clean slate and to start
 over from the beginning. To get the festival back to
 its roots of the first year and completely start over.

 If Carol is _truely_ for the community as she has said
 from the beginning in interviews and so forth, then
 she would relax and wish Derrick, and the city of
 Detroit the best.

The concept of the community is a rhetorical device used to mobilize
people for or against very specific projects.  I'm sure that Marvin is no
longer thinking of May and Craig when she talks about the community.

I'm sure May and Craig aren't thinking about Marvin when THEY talk about
the community.  I know I'm not.

This is politics.  It isn't bad (contrary to popular belief).  I actually
think it is good that Detroiters are willing to fight and compete over
something as glorious as this.

wasn't W Sound. I can't even remember what dj it was...all I know is my
crappy little Wallstreet P-Book freaked out  I had to initialize everything

Well, I dunno about Dinky starting a new movement, but she's a decent
DJ and nice person to get to chat with.  I had the opportunity to
speak
with her for a little bit at an after-party get together when she spun

Philly in late summer last year.

Not everyone was receptive to her spinning 313-ish stuff, but I
enjoyed
it very much.

To be fair, the abandonment might have been beyond Derrick's control.  There
is a certain burden of proof that needs to be met to register a trademark.
If you can't meet it (because perhaps you aren't doing trade under the
said mark - or aren't doing it *yet*) then you can't do much more than
abandon.  Getting a registered trademark is fairly involved in certain
respects.  Anyhow, it would have been the lawyer's job to handle this, right?

 Can I second Black Buildings most heartily, heard 
 the *whole* album recently rather than the vinyl EP 
 and it is awesome (thanks Ken), does anyone know if 
 the whole album got a vinyl release?

Yes...  there's a Black Buildings 2xLP that contains more tracks than the 2x10 
EP.  And the CD release contains like 6 or so more tracks than the 2xLP (!).  
Oddly enough one of my favorite tracks called Nebulae from the EP is on neither 
the 2xLP or CD, apparently.  And that track is worth getting the EP for IMHO.  

If anyone likes _Black Buildings_ and hasn't heard the marvel of his 1st effort 
_Soundtrack [313]_ on Ferox, you owe it to yourself to find a copy.  The very 
essence of a moody sleepless Detroit in the evening, the cover photo of steam 
coming thru the manhole covers on Gratiot says it all. I think it's even better 
than Black Buildings... one of those I recorded and bring on MiniDisc anytime 
I'm flying somewhere. (Also sharing the 'mandatory in flight entertainment' 
honors is Urban Tribe's Collapse of Modern Culture and Global Communications 
Pentamerous Metamorphosis)

Also if you like Detroit Escalator Co., check out the Soul Circuit CD/LP on 
Sirkus called _Don't Spoil The Tension_.  Similarly soundtracky (it was a 
created as film soundtrack for a gallery installation in London) and 
brilliantly intricate without being, err, wankerish.  Speaking of wanker, I 
liked the LP so much I had to buy it on CD too so I could fall asleep to it at 
night... brilliant.

While Carl is serving on the creative director/advisory board, he is
NOT...repeat NOT 'running' or producing the festival. This seems to be a
popular misconception throughout the community and on this board. That is
being administered by Derrick and he has hired Richard from his label to
oversee the logistics of everything. And judging from what I've seen/heard,
he's doing a fine job.

Carl's working in the studio on music. Finally.

So.. please disassociate yourself the notion that  Carl is running,
producing, directing, or planning the festival. He is a creative
director, and there's a world of difference.

It's not on one person's shoes. There's a whole team of people in place
working extremely dilligently already.
It's gonna be a good festival, and they are encouraging all sorts of
suggestions at the moment. If you've got one...I'd be willing to bet that
they're open to it.
