[OSM-legal-talk] Re-using ODbL for other, similiar project?
Hi folks, this is my first post on this list, so kindly excuse if my questions are misplaced or have been answered before. I am working on a project similar to OSM: The objective is to provide a free database with basic geospatial and meta data of airfields (coordinates, height, runway info, and radio frequency). I am thinking about a good license for that database and I found ODbL. Question 1: May I copy and re-use the ODbL text for my project? Is the license itself free? Actually I inherited the database after the creator passed away some time ago. Back then he told me that all data in that database is either from free sources or had been collected by contributors. However, he neither had/demanded something like ODbL's Terms of Contribution nor archived the cotribution postings. So I have no objective evidence for the data source. Question 2: Under those circumstances, would you recommend not to add the data to OSM? But yes, in general it would be a good idea to check that you have permission to release your project under this licence. Note, however, that just releasing your project under ODbL might not be enough to allow its incorporation into the OSM project, which has its own set of contributor terms. I wanted to stay out of this endless discussion, but let me point out the simple fact that copyleft is designed to solve this problem. When you get a copy of the data, you get the intended license and done need a contract. Hi, i have a practical questions. If I want to generate a Garmin map for a larger country and want to add contour lines, it is impossible to merge the data only in the RAM. Hence a local temporary file is needed which would contain both, OSM and SRTM data. This temporary file would be deleted after the map creation process. I can not accept this answer, Frederik. Generating a Garmin map with contour lines is not something special. I guess all programs that generate such maps for larger areas need local temp files. And now there is no answer available? What is with all these Garmin Maps? If a local temp file would constitute a database according to ODBL, it would make it very hard to generate it. I don't want to talk with lawyers on legal. I always get headaches when talking with lawyers. And I am part of this community and don't want to talk with legal people when asking such an easy question. Your obligations are therefore to produce either the Derivative Database itself or, more practical in this instance, A file containing all of the alterations made to the Database or the method of making the alterations to the Database (such as an algorithm), including any additional Contents, that make up all the differences between the Database and the Derivative Database. There is no stipulation that the algorithm is machine-readable, simply an expectation that it could be followed by anyone reasonably competent in such matters. So a readme.txt detailing the steps required to transform OSM data into the derivative database will be fine. Show your working, if you like. I haven't made garmin maps with contours, so you'll have to forgive me if I get some of the steps or terms incorrect. I can see good points for arguing that a contour map is any one of a Collective Database, a Derivative Database or a Produced Work, depending on the details of how the contour map is implemented. I think that a strict reading of ODbL suggests that your temporary file is a Derivative Database. Under §3.1d this is permitted, Creation of temporary or permanent reproductions by any means and in any form, in whole or in part, including of any Derivative Databases or as a part of Collective Databases; I think that your temporary file is also exempt from further conditions if you do not Publicly Convey it. §4.2 Notices. If You Publicly Convey this Database, any Derivative Database, or the Database as part of a Collective Database, then You must: If you do not Publicly Convey the temporary file you would have no further obligations due to it. I presume that the final file(s) will be created from the temporary file. Those final file(s) would also be, in my opinion, a Derivative Database. Again, if you do not Publicly Convey it, and only use it yourself, you would have no further obligations. Otherwise, if you plan to share, sell, etc. the file(s) you would do so under the terms of §4 and the rest of ODbL. In addition to reading the ODbL, the OSM community has the opportunity to set community norms and guidelines[2]. I would suggest that creating maps for mobile devices is an ideal topic for such a community norm. These norms allow us to agree on practices that are sensible to our community. There has been little discussion of these norms to date. The Trivial Transformation guideline might well include such a mobile map conversion. Fui no irc do osm e fiz uma pergunta se alguem tem espaço em servidores para colocar as imagens, mas ninguém respondeu. Mas acho que vale uma mensagem na lista perguntando novamente. Essa questão do termo, fiquei curioso, será que tem alguma restrição? Se as imagens foram compradas com dinheiro público, deveriam ser de domínio público. Deixa o pessoal usar as imagens do jeito que quiserem, rsrsrs. Já que não existe espaço suficiente em HD/midias para copiar as imagens de todo estado, concordo em requisitar as imagens dos municípios que o pessoal aqui tiver interesse. Quando acharmos uma solução para armazenar todas as imagens, agente (samuel) vai requisitando mais imagens junto ao IEF.. Lembrando que talvez o próprio IEF armazene essas imagens no servidor deles em breve (esse breve geralmente demora viu). Samuel: Vc questionou isso? Enfim, já que temos poucas cidades (4 até agora) seria interessante requisitar as 3 coberturas. Outra pergunta: No seu servidor, tem espaço para armazenar quanto? Olá, Vocês sabem a resolução e se a cobertura de nuvens está ok? Em Alagoas a gente até conseguiu algumas imagens, mas tivemos dificuldade em usá-las por causa disso. Eu também acho que é melhor focar nas cidades que não temos imagens no Bing/Yahoo/etc, e que tenham pelo menos 1 mapeador. Desta maneira não teríamos desperdício de espaço e esforço. Perguntei sobre restrições e ele me disse que haveria algo sobre redistribuição. Acho que conseguimos negociar esse termo. Disse que iria continuar o processo, apontar as áreas e então ver o que tem nesse termo. Vou esperar alguns dias para ver se alguém quer alguma área específica, e então vou fazer o pedido e postar aqui o termo. Gerade ein Poller kann meistens entfernt werden, damit da auch Fahrzeug (zB Stadtreinigung) durchfahren können. Auch bei einem Tor dürfte motor_vehicles=private durchfahren, wenn sie denn durchpassen. Ob nun ein Tor offen oder verschlossen ist, ist noch mal ein anderes Thema und selbst nach langere Studie und zB mit Öffnungszeiten versehen, kenne ich noch keine Routing-Software, welche sowas auswertet. Zusätzlich sollte man auch noch an Rettungsdienste denken, welche doch allerlei Sonderrechte haben. wenn PKW-Zulassung bedeutet, dass sie diesen gleich gestellt sind, dann dürfen sie m.E. nicht durch. Hallo M∡rtin, danke zunächst für die Idee, VHS-Gebäude mit einem Multipolygon zu taggen. Wie du aber schreibst, eignet sich das beser für Gebäude, die auf einem Gelände liegen, als über mehrere Dörfer verstreute Dependenzen, die übrigens primär unterschiedliche Betreiber bzw. als gemeinsamen Betreiber die Kommune haben (VHS ist nur _eine_ Nutzerin). Auf die Idee, ein neues Tag zu erfinden, wäre ich nicht gekommen, weil ich einfach davon ausgegangen bin, dass weltweit schon einige Einrichtungen der Erwachsenenbildung getaggt sein müssten - wenn ich so etwas gefunden habe, war das meist artscentre (IIRC). Allerdings bin ich eben auf http://wiki.openstreetmap.org/wiki/Rostock:Geb%C3%A4ude_und_Strukturen gestoßen, wo folgendes angegeben ist: Sonstige Gebäude Schlüssel: 1122 Amenity KVLA: professional_education Bezeichnung KVLA: Berufsschule, Fachschule, Volkshochschule OSM Tags: amenity=school,vocational=yes,name=* Neu erfunden wurde hier wohl vocational, was Auf der deutschen Wiki-Seite zum Tag school http://wiki.openstreetmap.org/wiki/DE:Tag:amenity%3Dschool findet sich am Ende ein Hinweis auf eine kontroverse Diskussion. Als Lösung wurde vorgeschlagen, für Bildungseinrichtungen, die Wissen außerhalb der klassischen Schulen vermitteln, amenity=education oder direkt education=* zu verwenden. Dieses Tag gibt es jedoch (im Wiki) noch nicht. Dabei stammt die besagte Diskussion aus dem März 2010. Es handelt sich bei all dem aber um lokale Probleme die du mit mir in deinem Überwachungsbereich Kiel / Kreis Plön hattest. Ich halte es für unangebracht dies nun auf talk-de zu verschieben. Es kommt auch sehr komisch rüber nachdem du im März noch du machst gute Arbeit für OSM. schriebst. Lies dir doch einfach nochmal die 26 Mails durch die wir uns seit 2008 geschrieben haben. Ich hätte danach nicht gedacht, dass du hier so etwas schreibst. Vermutlich ist es dir sauer aufgestoßen, das ich deine übertriebenen Löschungen von railway=abandoned als Vandalismus bezeichnet habe. Eine recht harmlose Reaktion, wenn man bedenkt wie viel Arbeit ich da rein gesteckt habe! So etwas gehört aber doch nicht auf die Liste! Höchstens um wertfrei nach der besten Lösung zu einem Mapping-Problem zu Fragen. Für die anderen Mitleser muss ich nun aber leider doch auf die oben beschriebenen eigenwilligen Aktionen eingehen: Was das taggen von Fahrradstraßen mit highway=cycleway an geht: Soweit ich mich erinnern kann ging es vor 2 Jahren um 2 Fahrradstraßen in Kiel. Ich hatte das Tagging aber schnell wieder aufgegeben, weil es Konsens ist, dass highway nur den Ausbauzustand und nicht die Nutzung beschreibt. Leider gibt es bis heute keinen Tag für Fahrradstraßen und das Rendering ist bis heute unbefriedigend. Probleme mit dem Routing gab es niemals egal ob mit highway=cycleway oder highway=residential . Zu tram: Ich kenne bis heute keine bessere Möglichkeit um zu beschreiben, das Bahnschienen in der Straße verlaufen. Wie bei highway taggen wir ja auch mit railway den Ausbauzustand und nicht die Nutzungsart. Ansonsten ist noch mit usage=industrial alles gesagt... Es sollte weder bei Redering noch bei Routing (gibt es railway routing?) Probleme geben! Zu den Laderampen: Besser wäre wohl railway=disused + disused=stop + passengers=no gewesen. Könnte man ja mal drüber reden, was du jetzt draus gemacht hast ist auf jeden Fall kontraproduktiv. Ansonsten lasse ich mich durchaus überzeugen (siehe Fahrradstraße) aber nicht ohne Argumente. Und aggressives Verhalten halte ich für nicht erstrebenswert. Ein editwar bringt uns auch nicht weiter. Schönen guten Morgen, geht es hier eigentlich um eine sachliche Änderung oder geht es hier um einen Grabenkrieg? Kann man nicht ganz allgemein nachfragen und besprechen was hier, in welcher Form geändert wurde und warum? Völlig unabhängig von der Frage ob ich diese Änderung gut finde oder nicht finde ich den unmittelbar erhobenen Vorwurf nicht gut. Das es sich um eine 20er Zone handelt oder um eine 30er Zone ist doch jetzt keine schlechte Information, auch wenn man es eventuell aus dem maxspeed Tag hätte ableiten können. Solange es keine einheitliche Regel gibt wie eine Zone genau zu taggen ist, wird es immer wieder jemanden geben, der anderer Meinung ist und entsprechend umettikitiert. In diesem Fall ist der Unterschied lediglich, das sehr weiträumig umettikitiert wurde. Hej Jeff, Jeg bruger en Garmin eTrex Legend HCx ( https://buy.garmin.com/shop/shop.do?cID=145pID=8701) - den er robust, regntæt, rimelig nøjagtig, kører (i laang tid) på alm. AA batterier og så bruger den standard MicroSD hukommelseskort (så skulle kortet løbe fuld, kan du bare skifte det - så du behøver ikke en PC). Mvh. Kent B. [Talk-at] Stammtisch Wr. Neustadt
Gleich mal vorne weg: Ich weiß es ist sehr kurzfristig ausgemacht, aber schneller ist es leider nicht gegangen. Also BerndSch und ich (Soldier Boy) haben uns gedacht wir versuchen einen weiteren Stammtisch ins Leben zu rufen und zwar in der Fachhochschule Wr. Neustadt. Grund: Für ihn und mich (und ws noch einige andere) ist das reinfahren nach Wien zu umständlich. Außerdem haben wir an der FH einen Geoinformatik Zweig und können so vll einige davon besser dazu überreden bei OSM mitzumachen als sie mal nach Wien zu schicken/bringen. Termin: Do, 30. To že vznikne CC-BY-SA fork je skoro jisté, teď už jen doufat, že ten fork bude jen jeden, nebo že pokud jich bude víc, tak ty ostatní rychle vychcípou a zbyde jen jeden (plus někteří lidi chtěli i PD fork, takže je možné, že vznikne ještě jeden fork, kde ale bude asi jen minimum dat) Pokud v ČR zmizí 20 až 25 procent dat (což je aktuální odhad dle té stránky), tak bych tipoval, že lidi nejspíš utečou k cc-by-sa forku, v jiných zemích to může dopadnout jinak (pokud bude dopad mazání minimální, můžou tam lidi zůstat). Úplný rozpad asi nebude, ale tipuju, že se přispěvatelé rozdělí na tři skupiny, jedna co zůstane na ODBl a pokusí se napravit chaos vzniklý smazáním čtvrtiny dat (tipuju to na většinu lesů a vodstva plus asi celkem dost silnic a dalších věcí - může to být méně než čtvrtina pokud se některé podaří přesvědčit aby odbl akceptovali, ale i více, pokud se ukáže že některé importy jsou s novou licencí nekompatibilní a pak by musela data pryč ať už dotyčný souhlasil s odbl nebo ne) a ta se nejspíš časem bude spíše zmenšovat (asi je těžké dávat dohromady mapu, kde po celé republice různé náhodné kousky chybí). Druhá se přesune na cc-by-sa fork, kde budou data všechny (ale je to fork, ne každý o něm ví atd ...). Třetí odejde a přestane mapovat. Zdravím, situaci ohledně změny licence jsem nesledoval a i když nemám žádný podstatný podíl na editacích v OSM, rád bych si udělal obrázek o tom, o co jde, a nějak se rozhodnul. Můžete mi prosím někdo stručně vysvětlit, v čem jsou zásadní rozdíly mezi licencemi? Jaký je hlavní důvod změny licence? Jaké jsou naopak negativa nové licence, že někteří nesouhlasí (podle té tabulky s licencí nesouhlasí i druhý nejčastější přispěvovatel pavel, který je pořád velmi aktivní). Jakým způsobem je třeba vyjádřit souhlas/nesouhlas a do kdy? Věřím, že tyto informace stručně a jasně shrnuté pomohou i dalším. Druhá se přesune na cc-by-sa fork, kde budou data všechny (ale je to fork, ne každý o něm ví atd ...). Třetí odejde a přestane mapovat. Ale ještě z toho shrnutí nerozumím, jak to tedy podle nové licence bude v tom modelovém případě: Pokud někdo vaše data používá pro mapu s několika vrstvami v knize, co všechno má být pod CC-BY-SA? Jen vrstva OpenStreetMap a její úpravy? Celá mapa včetně nesouvisejících vrstev a značek? Celá kniha? Tohoto se patrně týká odstavec: Podle nové licence může mapu uvolnit pod jakoukoli licencí chce, pokud uvolní všechny doplňky a vylepšení, které k našim datům přidal. Hlavním důvodem pro tuto změnu je, že mapy lze nyní vytvářet pomocí vrstev z nekompatibilních zdrojů dat. Těmi doplňky se myslí např. software, který použil k vytvoření mapy z dat, data jiných vrstev? Tedy nyní lze vzít OSM data, vytvořit z jich libovolným způsobem mapu (např. pomocí nějakého software, který není volný), dokreslit si na ni nějaké další informace (např. trasu nějakého závodu), které neuvolním ... a tohle po změně licence již nepůjde (tedy s novými daty, které nejsou licencovány i starou licencí)? Tedy změna licence přidává omezení na využití dat? Přirozenou nevýhodou demokracie je, že těm, kdo to s ní myslí poctivě, nesmírně svazuje ruce, zatímco těm, kteří ji neberou vážně, umožňuje téměř vše. (V. Havel) Jinymi slovy - cela tahle habadura se dela vlastne jen proto, ze by v budoucnu (nebo soucasnosti) mohl nekdo vytezovat OSM a prodavat to jako svoji praci. Xfree a Xorg - celkem hezke prirovnani - akorat u Xek neni ten vyvoj tak strasne rychly jako u OSM... Navic ne mala skupina lidi podporila zmenu na ODBL (skoro 50% vsech) Bohuzel OSM pro me neni jen ta databaze ale i vsechno kolem - servery, sluzby - a to neni malo. Neumim si v tuhle chvili predstavit zivotaschopny fork. Řekněme, že by se opravdu někdo našel a data začal prodávat. Kdo by je ale koupil, kdy je může získat zdarma přímo z OSM? Jistě - někdo by se najít mohl, ale nevidím v tom žádné podstatné riziko. Obdobně vydělávat lze např. i prodejem GPL software, ale kdo GPL software kupoval, když jej může mít zdarma? Také by mohl data nějak vylepšit a prodat vylepšená data. Ale to je velmi podobný případ. Kdo by koupil takto vylepšená data za větší cenu než je cena tohoto vylepšení? Mohl by si totiž vzít zdarma data z OSM a vylepšit si je stejně. Ne, právě naopak. Určitým pohledem by se dalo říct, že některá nechtěná omezení vzniklá nevhodnou aplikací CC-BY-SA uvolňuje. Nová licence jasně definuje co je chráněno : data, laicky řečeno to co je v .osm souboru. Tedy to, co všichni společně vytváříme. Pokud někdo chce tato data používat, může v podstatě zcela libovolně, pouze se dvěma omezeními: - musí se patřičně odkázat na zdroj - musí změny v _datech_ poskytnout zpět do projektu Jaké nástroje k tomu použije a jak bude vypadat výsledný produkt je zcela volné. Pěkně je to shrnuto i zde: http://www.opendatacommons.org/licenses/odbl/summary/ Duch licence je v zásadě stejný jako u stávající licence, dalo by se říct že je to jenom úlitba právníkům. Nová licence je tu proto, aby zachovala myšlenku OSM a napravila nešťastnou volbu původní licence, která se na dílo vznikající v projektu OSM vůbec nehodí. Nechápu, proč se kolem toho dělá takový rozruch. Rozdíl je v tom, že kód mezi projektem a forkem projektu lze poměrně dobře přenášet, jsou na to nástroje typu diff, patch a postupy na řešení konfliktů, pokud se patch nedá jednoduše aplikovat. Pro mapová data v OSM na tak dobré úrovni nástroje nejsou (hlavně na to řešení konfliktů), takže to je o dost složitější. Importy by mohly projít jak do forku, tak do OSM (napíše se skript a jen se pustí dvakrát), ale tím to asi tak hasne, většina lidí se asi rozhodne pro fork nebo hlavní projekt a to druhé bude ignorovat. Fork ale (minimálně ze začátku) asi na tom bude hůře co se serverové kapacity týče, takže je možné že místo jedné fungující opensource mapy tu budou dvě nepoužitelné (jedna kde je náhodně vyrvána čtvrtina dat a druhá kde servery budou pomalé a přetížené) Nejlepší by bylo, kdyby si to Odbl rozmysleli :) Martin ___ Talk-cz mailing list Talk-cz@openstreetmap.org http://lists.openstreetmap.org/listinfo/talk-cz

Ahoj! Ne, práv`i naopak. Ureitým pohledem by se dalo o/íct, 3/4e n`ikterá necht`iná omezení vzniklá nevhodnou aplikací CC-BY-SA uvolouje. Nová licence jasn`i definuje co je chrán`ino : data, laicky o/eeeno to co je v .osm souboru. Tedy to, co v^1ichni spoleen`i vytváo/íme. Pokud n`ikdo chce tato data pou 3/4ívat, mu 3/4e v podstat`i zcela libovoln`i, pouze se dv`ima omezeními: - musí se pato/ien`i odkázat na zdroj - musí zm`iny v _datech_ poskytnout zp`it do projektu Jo, bohuzel to je dost blbe vynutitelny, ze? Kdyz bednari vydali OSM mapu Prahy, tak jsem ji aspon smel vyfotit a dat na web... Neumim si moc predstavit, jak by bednari davali .osm soubory s popisy stanovist... Duch licence je v zásad`i stejný jako u stávající licence, dalo by se Kez by :-(. ODBL se bohuzel lisi v pomerne podstatnejch vecech. AKA tu bednarskou mapu bych normalne ofotit nemoh'. Dalsi problem je, ze oduvodneni zmeny licence trosku kulha (jestli je CC neucinna, tak proc se ptaji na souhlas), a ODBL dava trochu moc kontroly nadaci. (Neni pravda ze s CC-BY-SA nemuze nikdo potrestat zle hochy. Naopak kazdy muze potrestat zle hochy. S ODBL budou potrestani jen zly hosi co nastvou nadaci...) Ahoj, projekt MTB mapy urcite pokracovat bude, doted jsem ho spis udrzoval, ale snad se konecne najde cas na urcity rozvoj. Evitez de tagguer les parkings publics et les parkings privés de la même façon. Ajoutez le tag 'access=private' pour les privés. Je n'aime pas le rendu actuel qui montre tous les parkings sans distinction, y compris ceux en bas des immeubles. Je ne sais pas si le rendu mapnik tient compte du tag access mais il devrait. J’y vais de mon petit commentaire aussi… Le mapping intérieur est évidemment intéressant, mais rajoute énormément de complexité à la carte, et comme l’a dit Pieren OSM n’est pas adapté pour cette cartographie. D’un autre côté, je me suis adonné à l’exercice pour les gros bâtiments commerciaux : les couloirs dans les galeries marchandes pouvant être vus comme des « rues » couvertes, et balisés comme des tunnels dans le bâtiment http://www.openstreetmap.org/?lat=46.55133lon=0.300235zoom=18layers=M Autre remarque, le mapping intérieur étant intéressant pour les mal-voyants (messages précédents), ne pas cartographier les intérieurs reviendrait à une certaine discrimination, qui serait mal vue (sans mauvais jeu de mot)… Mais il y a probablement d’autres discriminations impliquées par notre façon de remplir la base dont on n’est pas conscient… Et je ne saurais dire lesquelles. Donc je ne suis pas pour interdire, évidemment, mais pas pour faire le travail aussi fourni dans les bâtiments qu’à l’extérieur. Il y a probablement un compromis entre le nécessaire et le superflus. Bonjour JE suis complètement d'accord avec Pieren. Il va être très difficile de gérer la modification et l'affichage des données OSM sur plusieurs niveaux d'un bâtiment. Pour moi, c'est ici que le côté libre d'OSM prend toute sa force : rien n'empêche de créer une infrastructure similaire à OSM pour y mettre les données d'intérieur. Ensuite il faudra bien sûr gérer le lien entre les 2, mais pourquoi pas ? Rien n'empêcherait par exemple une application de routing d'utiliser les données OSM pour l'extérieur, et pour la navigation dans le bâtiment, d'utilser les données de OSM_indoor, bdd dédiée à l'intérieur. On pourrait aussi très bien avoir un éditeur pour les données d'intérieur qui intègre en fond les données OSM (pou le repérage), et propose des fonctions pour vérifier les liens entre les 2 (par exemple l'osm_id du building OSM est bien présent dans le tag from_osm des objets la bdd dédiée intérieur.. Je comprends bien que les moteurs de rendus actuels ne sont pas conçus pour rendre du multi-niveaux. Et que les éditeurs non plus. Et qu'on n'a pas de GPS pour se rassurer. Et qu'à ce niveau de détail, il faudra attendre d'avoir 3 millions de contributeurs pour avoir une bonne couverture... Mais, pour me faire l'avocat du diable, la base de données et son infrastructure me semblent très bien convenir pour l'intérieur et la faible quantité de données d'intérieur ne me semble pas risquer de pourrir les performances de l'usage habituel d'OSM. Quant au reste : - pour les moteurs de rendus classiques : yaka leur demander d'ignorer tout ce qui est indoor=yes et laisser ce job à des moteurs de rendus conçus pour l'intérieur - pour les éditeurs, c'est plus compliqué : ce qui pourrait être sympa, c'est de pouvoir aussi filtrer facilement à l'affichage ce qui est indoor=yes/no puis pouvoir filtrer ce qui est level=1/2/3... pour n'afficher qu'un seul niveau ; une boîte de dialogue filtres de données dans le menu affichage de JOSM...
