Because remember, it is not that there is actual danger, it is just if

I don't know about this scenario. It's got a vigilante justice feel

I don't think he should get off totally without penalty. It was his
neighbors property, and the police told him to let it go.
He should at least have to take a gun-owners rights course, or pay an
"unlawful discharge of a firearm". And maybe an assault charge.
