Reading the law it becomes extremely obvious that it was never intended to be used to violate the constitutional protections afforded to Schools and Churches. Actually, I am shocked that the word "church" is used instead of "Houses of worship." Apparently, synagogues and temples or mosques are afforded no such protection. I really do not think this will stand up against any civil right of a federal nature! We will win... I said it when I started, I affirm it now 15 years later. Kevin Brown 33:1-76. Sales within 200 feet of church or school prohibited; waiver; exceptions Anything to the contrary hereinbefore notwithstanding, and for the benefit not of property but of persons attendant therein, no license shall be issued for the sale of alcoholic beverages within two hundred feet of any church or public schoolhouse or private schoolhouse not conducted for pecuniary profit, except to manufacturers, wholesalers, hotels, clubs and fraternal organizations which owned or were actually in possession of the licensed premises on December sixth, one thousand nine hundred and thirty-three. The protection of this section may be waived at the issuance of the license and at each renewal thereafter, by the duly authorized governing body on authority of such church or school, such waiver to be effective until the date of the next renewal of the license. Said two hundred feet shall be measured in the normal way that a pedestrian would properly walk from the nearest entrance of said church or school to the nearest entrance of the premises sought to be licensed. The prohibition contained in this section shall not apply to the renewal of any license where no such church or schoolhouse was located within two hundred feet of the licensed premises as aforesaid at the time of the issuance of the license, nor to the issuance or renewal, or both, of any license where such premises have been heretofore licensed for the sale of alcoholic beverages or intoxicating liquors, and such church or schoolhouse was constructed or established, or both, during the time said premises were operated under said previous license. 33:1-76.1. Renewal or reissuance of club or Class B wholesale license granted on waiver Notwithstanding the provisions of section 33:1-76 of the Revised Statutes if a club or Class B (wholesale) license has been or shall be granted on a waiver of its protection granted on authority of a church or school, the holder of such license shall be entitled to apply for renewal thereof without further or renewed authority, or waiver, of the church or school; but the renewal or reissuance of such license after a revocation, or subsequent transfer of such license, shall not be permitted without a new waiver granted on authority of the church or school. [AsburyPark] Lighthouse V Long Branch - Federal Circuit Appeals Court rules
Good Morning everyone. The Appeals court reversed the December 2005 decision against The Lighthouse in part. They decided in a published opinion yesterday that The C 1 Commercial Zone ordinance of Long Branch was illegal and violated the civil rights of the Lighthouse Mission & myself. We are being remanded back to the circuit court for a damages trial including legal fees. It's not a complete victory, in that they did not violate the redevelopment plan for the block because the City has put its hope of revitalization on increased retail alcohol distribution. That would be hindered as NJ State Statute prohibits Liquor Licenses within 200 feet of a church or school. We are not sure if we are going to accept that logic. In as much as it would now put drinking establishments in a place of sanctity greater than Houses of Worship! As a former retail liquor store owner in Brooklyn, I am really enjoying the comedy associated with this decision. Bottom line, when Long Branch prohibited us in 1995 they violated the Constitution of the United States and RLUIPA. So for the last 12 years we were prohibited illegally. Will we get to survive the redevelopment plans of Broadway Arts? That's the next chapter. I think the Statute NJSA 33:1-76 where the alcohol free zones are created around churches and schools may need to be addressed in a separate action. We do not care if our neighbors are retail liquor establishments! After all Jesus did make wine from water. Peace to you all. [AsburyPark] Red Bull Dog type spotted
I don't know, if this is the dog you all are looking for or not, but I have never seen this male dog here before. He was definitely dark reddish about 75 - 80 pounds. Ears were choppy, and was being walked by a black male around 5'8 - 5'9" - The dog came over to me and I petted him, and then the guy walked away rather suddenly. This was in Long Branch at 1:40 pm Saturday. Natisha Enalls, 32, and Joseph Dunbar, no age available, face four counts each of failing to provide food, water and sustenance to animals, said Victor "Buddy'' Amato, the Monmouth County SPCA's chief enforcement officer. Amato said Enalls called his agency at about 4 p.m. on Nov. 15 to report that when she woke up at about 9:30 that morning, one of the dogs was dead and one "was on his way out.'' "We sent out animal control, and they found two dead dogs,'' Amato said. He said the SPCA's enforcement agent Scott Gussin was deployed to the house, where he found two more dogs, "severly emaciated.'' Those dogs, which Amato said were all Terrier mixes, were removed from the home, Amato said. He said the dead dogs were a male and female, both four months old. The two surviving dogs are both females. One, named Princess, is about a year old, and the second, named Reme, is about four months old, he said. Enalls told authorities that someone dropped the dogs off about a month ago, and they were sick then, Amato said. Amato said Dunbar has taken a major share of the responsibility. He said formal charges will probably be filed in Asbury Park on Monday. "The paperwork is being drawn up now,'' he said. The case is similar to one earlier this month when a Neptune woman was charged with animal cruelty after she allegedly allowed two Terrier mixes to starve to death. [AsburyPark] Getting 8 Million from the State Taxpayers
The Asbury Park City Council approved a $35.5 million budget with a minimal increase in the city tax rate in June. This year, an $8 million deficit is covered by a state grant. Last year, Asbury Park's small deficit was covered by a tax increase. Since 2004, spending is up by more than $8 million, without offset revenues. Hence, an $8 million deficit. If the state had not come to the aid of our council's pleas for help, the average tax increase would have been heavy. Why continue to spend more than we have? We must look for new ways to increase revenues and cut expenditures. A Citizens Tax Advisory Board would be able to use the best and the brightest minds in this city to work on alternative ways to close our budget gap. One idea the citizens board can pursue immediately would be to create a "revenue allocation district" and a "revenue allocation financing" program. This district would encompass the entertainment area Madison Marquette is expanding. This would allow the city to establish a ratable tax amount base that would be paid to the city once full build-out of the district is accomplished. This ratable amount then would be sold via a bond and the proceeds used by the city to pay down the structural deficit — one portion used to cover the debt service and the balance for new projects. Gangs Of New Jersey Jon Coen for EXPN.com When did everything become so "dirty?" In the past few years, the accompaniment of the filthy adjective with the name of a city, state, or region has served to bolster said area's cred—"The Dirty Jerz," "The Dirty South," "Dirty Diego." It's all very cute, but there is a town on the famed Jersey Shore that has a history for being seedy, decrepit, and quite run down. Asbury Park was dirty before it was cool and is a fitting place for Red Bull to drop Down & Dirty, an event that is bringing BMX heavies out of the dark shadows this weekend. Anne Coen One of Asbury Park's many decrepit seaside structures. Asbury Park was the perfect Seaside retreat in the early part of the 1900's. New York City families could travel by rail to Asbury's beach, boardwalk, theatres, and amusements. But fires, race riots, and an expanding Jersey Shore tourism market brought a demise to Asbury. It rang as deep as Springsteen lyrics. This once proud city by the sea became the East Coast's version of Dogtown. Skeletons of abandoned buildings stood between classic architecture that was falling to the ground. But like all good "dirty" places, there was an element that thrived among the ruins. Asbury Park became home to artists, tattoo parlors, and fringe dwellers. Venues like the Stone Pony, the Fastlanes, and the Saint became legendary. Skaters and BMX riders found a haven among the rubble and swimming pools. The much-loved Casino Skatepark existed briefly, thanks to a motorcycle gang, in the once-famous Casino Amusement landmark. courtesy of Red Bull The once proud Asbury Park Casino will soon get down and dirty. Though realtors may tout the rebuilding of Asbury Park and the criminal element is largely cleaned up, the gangs returned to Asbury this week—not the Bloods and the Crips, but bicycle gangs from all over the world. Down and Dirty is highlighing Asbury's grittier aspects, allowing riders to get busy on a one-of-a-kind street course, including an articulated bus and an NYC cab with ballistic rails and jersey barriers. In the great tradition of street gangs, the dope "peddlers" will compete in teams, with squads rolling in from around the globe. Jersey boy, Van Homan, representing Team Pirates, has actually seen the inside of a jail cell in this rough town. "The Casino has a lot of fond memories for me. After the skatepark (inside) closed down, we used to sneak in there all the time to ride the bowl until we got arrested. That sucked," he recalls, "Lots of good pool sessions too. It was sad to see the best pool I've ever ridden get torn out. And I remember some good shows at the Stone Pony." courtesy of Red Bull Tom White, Tyrone Williams and Edwin De La Rosa take a slight pause in ripping to catch up on their text messaging. While Homan is considered by many to be a Philly rider, he has the Garden State Turnpike running through his veins. He recently opened a core-only BMX shop, called Two by Four in his hometown of Pennsville. He was just out slaying Asbury's streets last week. "I don't know what's in store," admits Edwin De La Rosa, "and I kind of like it that way. All I heard was that it was sketchy." De La Rosa came up on two wheels in Brooklyn, New York City (...where they paint murals of Biggie...) riding sans breaks through the grit. He, Vinnie Sammon, Ruel "Wormz" Smith, and Tyrone Williams are repping Team Zoo York. "But I'm down with that. That's where the good spots are, where it's sketchy," he adds. courtesy of Red Bull Brooklyn's Edwin De La Rosa grinds a dirty feeble down this Asbury ledge. De La Rosa isn't a contest jock, but this event is bringing him and the other OG's out of the competitive woodwork. Louisville's Jimmy LeVan hasn't competed in four years. You may remember him as the hellraiser who was scolded when he gapped out of the course into an uninsured area at X Games IX. "It just sounds like fun," says LeVan, riding for Team Electronical, "I competed for a long time, but I was just over it. This one seems interesting because I heard the course is so whacky. There used to be that awesome pool in Asbury and the guys that are riding sound like fun dudes." So fun, in fact, that when legendary English ruffians, Bas Keep, Dan Lacey, Robin Felon, and Bruce Crisman heard about it, they rallied and flew across the pond to get dirty themselves. The riders have been in town for a few days, sussing out the course and the city by the sea. Last year, Governor Corzine and his legislature raised the sales tax from 6% to 7% with the promise of property tax relief. Now they want voters to "permanently dedicate" a 1% sales tax for increased "aid." What Question 1 is really all about is raising the sales tax to 8%. If Question 1 passes, revenues "lost" to "property tax relief" (which never goes to suburban and rural homeowners) will have to be made up with higher sales taxes. Question 1 is a feeble attempt to fool voters into raising their own taxes so corrupt urban politicians can waste more of our money. VOTE NO ON Question 2! YES on Question 2 is a vote for a risky scheme Wall Street won't fund. Question 2 uses deceptive language to imply that this is a vote to fund adult stem cell research projects actually producing cures to diseases. But this science needs no government funding. Wall Street and the Drug Companies are already paying for it. Instead, Question 2 asks voters to give away a half billion dollar corporate welfare handout for Embryonic Stem Cell experiments involving human cloning. While they claim this money will cure diseases ranging from Cancer to Alzheimers to Diabetes, 35 years of this "Fetal Tissue Research" hasn't cured anything. Nothing at all. It's the ultimate taxpayer rip-off. VOTE NO ON Question 3! YES on Question 3 is a vote for Eminent Domain. Question 3 gives the state the power and money to begin "negotiations" with homeowners who live near rivers to sell their land to the state for "open space" -- part of an ongoing effort to stop construction of one family homes in New Jersey in favor of high density attached townhouses, condominiums and apartment buildings. While the question says land will only be taken from "willing sellers" does anyone think a homeowner or small business owner will have any leverage when a judge or bureaucrat decides that "preserving Open Space" is more important than your property rights. The city council and the administration of Long Branch, fully aware that their ordinance necessary to use eminent domain is under appeal at the State Supreme Court, along with claims brought against the development plans of the Katz family & PAX Construction, forced the Panday's, owners of Rainbow Liquors on lower Broadway into a negotiation whose only end is to sell. They forced the Panday's to the table under the threat of eminent domain. Even though the right to apply it has yet to make it through the judicial system. Our Government from Long Branch to Washington, DC is founded in a democratic system. It is composed of three branches. The Executive, which in Long Branch is Adam Schneider's administration. The Legislative, which in most part is the elected city council. Lastly but not the least, The Judicial, which is the courts. This system insures that democracy works. It protects the people when one or two of the branches of Government are wrong and indifferent to the masses, whose voices are sometimes muted by heavy handed politics and bully personalities. Well aware, that the use of eminent domain and the plans of Broadway Arts has been challenged in the courts, I find Adam Schneider and The City Council's persistence to push people out of their homes and properties beyond 'arrogant'. It is condemnable. The City relies on history to accomplish their conspiracy. They also are fully aware that such forced takings in the past took many years for the courts to finally rule on. In the historic "Wounded Knee" matter, it took the United States Supreme Court 90 years to rule the actions by the Government over the Lakota property was wrong and awarded $91,000,000.00 in damages. All too late to benefit the damaged individuals. In more recent history we have the case of 'Pole town', a Michigan eminent domain case that wiped out an entire ethnic community, homes, businesses and places of worship. That took over 20 years to be ruled on and again it found that Government was wrong. Long Branch, may take 20 to 90 years to discover that what Adam Schneider and his council has done was wrong, only where will the Panday's be then? We are you now? Why are the people of this State so silent, as Government continues to act in a wrongful manner? Eminent Domain Abuse is destroying liberty and the American Dream of property ownership, as we all sit back and do nothing. I pray that the people wake up and act before it is too late. November 6 is election day, vote out all incumbents who did nothing to correct what is wrong with eminent domain in New Jersey and specifically Long Branch. Call Mayor Adam Schneider and tell him how you feel about private property rights as if it were your home or business you were being forced to go to City Hall to sell! Go to City Council and demand that they end the use of eminent domain in all future projects or at least provide evidence that makes it necessary to remove someone from a perfectly useful home or business. The city estimated that about 250,000 gallons of partially treated wastewater were released after a sewer line collapsed, according to a state Department of Environmental Protection document released today. No staffers were on duty after 5 p.m., plant workers didn't find the problem until about 7 a.m. on June 5 and officials didn't post warning signs on beaches as a precaution until hours later. But the discharge from the 1,700-foot outfall had no effect on beach-water quality, an official has said. "I'm encouraged'' that the DEP is using enforcement to "keep compliance in the forefront,'' said Cynthia A. Zipf, executive director of Clean Ocean Action, a Sandy Hook-based coalition. But treatment plants should be supervised at all times, she said. DEP spokeswoman Darlene Yuhas said "the DEP licenses operators of sewage treatment plants and we issue permits which specify how these facilities must be run. When violations occur, we take action.'' The Asbury Park plant's discharge violated the Water Pollution Control Act, and the unpermitted discharge is considered a "major'' violation, according to the DEP document. The city can request a hearing and city officials said they will use whatever appeal or review process is available to them. "The plant had been inspected just a couple of months prior to the incident,'' said Terence Reidy, city manager. "The brackets gave way, but within a couple of hours, the whole thing was under control.'' Technically, there was an illegal discharge and the city is not arguing that point, Reidy said. "I guess the issue is that you have a city like Asbury Park doing everything in its power to do the right thing and has a staff doing the right thing and you have this fluky break ... and get everything back to normal in 48 hours,'' Reidy said. "My position is simple. We'll take the opportunity to go through the appeal process so we can tell our story. .‚.‚. It's not like we're some outlaw sewer plant.'' Garrett Giberson, city director of public works, said it was the first violation for the city since its sewer plant went on line in July 1988. And when the water was tested after the break, the parameters "were well below the level that would indicate pollution,'' he said. The DEP found no negligence on the city's part, he said. Tell incumbents to start packing I was not surprised to hear of the large number of New Jersey residents who have fled the state. ("More New Jerseyans leaving state," Oct. 10.) I attribute this "great escape" to three simple things: the highest taxes in the country, the most corrupt officials in the country and the mass development using abusive condemnation and eminent domain. When you tax the people out, rob the people out and throw the people out of their homes and businesses, what did you expect would happen? These three problems are controlled by 120 elected officials sent to Trenton by the same people who later wake up and start packing to move. Those of us who have not started boxing up our possessions have an opportunity to do something to fix the problem. On Nov. 6, send all 120 incumbents back to private life by voting for some new Senate and Assembly people who are dedicated to lower spending, smaller government, fewer taxes, honest government and development without the use of eminent domain for private developer gain. TRENTON — The coalition pushing voters to approve the state borrowing $200 million to preserve land in the state said yesterday that recent ads railing against the ballot question were "deliberate lies" and "vicious, false attacks." The Keep it Green Campaign, made up of 90 pro-preservation organizations, looked to debunk claims made by Bogota Mayor Steve Lonegan in recent ads and columns saying the program would take property from homeowners unwillingly, replace single-family home construction with high density housing and raise taxes. While the funding would have the state add more debt, Jeff Tittel, director of the state chapter of the Sierra Club, said local towns looking to buy land t o preserve rely on state money for reimbursement. "Without the state match, local property taxes would have to go up higher to buy those pieces of open space those towns want to buy," said Tittel. After learning of the coalition's statements, Lonegan responded, "To say that it won't raise taxes is an insult to the taxpayers of the state." "The state's at a breaking point, we can't afford any of this nonsense anymore," said Lonegan, who lost a bid for the Republican nomination for governor in 2005 and now heads the state chapter of Americans for Prosperity. " . . . When it comes to land use, we have to let the free market decide and not the government, not the planners of Trenton." If approved, the measure provides stopgap funding for one year of purchases, state fiscal year 2009, which begins next July. It would provide $109 million for open space, $73 million for farmland preservation, $12 million to buy flood-prone areas and $6 million for historic site preservation. The state, which the group says loses 40 acres per day to development, has about $170 million left to last until then. The victim, who lives on Fourth Avenue, initially told police he was shot once in Red Bank on early Saturday morning. But after further investigation, authorities determined the 22-year-old was shot on the 1100 block of Sewall Avenue in the city. A friend of the victim drove him to Monmouth Medical Center in Long Branch to be treated for the single gunshot wound to the stomach, said City Police Capt. David Kelso. When the victim said he had been shot in Red Bank, police from that borough, along with members of the Monmouth County Prosecutor's Office, started an investigation. But then authorities determined the shooting actually happened in the city around 3 a.m., said Kelso. City police had investigated a report of shots fired in that area around that time. Police said the shooter approached the victim, displayed a gun and demanded his belonging. The victim punched the man, and the man shot the 22-year-old, police said. Then the shooter ran away. The gunman was described as a 18- to 19-year-old black man, with a light to medium complexion, who was about 5 feet 11 inches tall, had short hair, no facial hair, and wore blue jeans, a gray hooded pullover sweatshirt and white sneakers. I believe that the redevelopment on the east side of town is actually hurting the poor people on the west side, because I think that it makes some low income folks angry that their town is being taken over by condos that they can't afford. Homosexuality: Questions and Answers Sue Bohlin Q. Some people say homosexuality is natural and moral; others say it is unnatural and immoral. How do we know? A. Our standard can only be what God says. In Romans 1 we read, God gave them over to shameful lusts. Even their women exchanged natural relations for unnatural ones. In the same way the men also abandoned natural relations with women and were inflamed with lust for one another. Men committed indecent acts with other men, and received in themselves the due penalty for their perversion (Rom 1:26-27). So even though homosexual desires feel natural, they are actually unnatural, because God says they are. He also calls all sexual involvement outside of marriage immoral. (There are 44 references to fornication--sexual immorality--in the Bible.) Therefore, any form of homosexual activity, whether a one-night stand or a long-term monogamous relationship, is by definition immoral--just as any abuse of heterosexuality outside of marriage is immoral. Q. Is homosexuality an orientation God intended for some people, or is it a perversion of normal sexuality? A. If God had intended homosexuality to be a viable sexual alternative for some people, He would not have condemned it as an abomination. It is never mentioned in Scripture in anything but negative terms, and nowhere does the Bible even hint at approving or giving instruction for homosexual relationships. Some theologians have argued that David and Jonathan's relationship was a homosexual one, but this claim has no basis in Scripture. David and Jonathan's deep friendship was not sexual; it was one of godly emotional intimacy that truly glorified the Lord. Homosexuality is a manifestation of the sin nature that all people share. At the fall of man (Gen 3), God's perfect creation was spoiled, and the taint of sin affected us physically, emotionally, intellectually, spiritually--and sexually. Homosexuality is a perversion of heterosexuality, which is God's plan for His creation. The Lord Jesus said, In the beginning the Creator made them male and female. For this reason, a man will leave his father and mother and be united to his wife, and the two will become one flesh (Matt 19:4, 5). Homosexual activity and pre-marital or extra-marital heterosexual activity are all sinful attempts to find sexual and emotional expression in ways God never intended. God's desire for the person caught in the trap of homosexuality is the same as for every other person caught in the trap of the sin nature; that we submit every area of our lives to Him and be transformed from the inside out by the renewing of our minds and the purifying of our hearts. Q. What causes a homosexual orientation? A. This is a complex issue, and it is unfair to give simplistic answers or explanations. Some people start out as heterosexuals, but they rebel against God with such passionate self-indulgence that they end up embracing the gay lifestyle as another form of sexual expression. As one entertainer put it, "I'm not going to go through life with one arm tied behind my back!" But the majority of gays sense they are "different" from very early in life, and at some point they are encouraged to identify this difference as being gay. These people may be the victims of "pre-conditions" that dispose them toward homosexuality. One such pre-condition may be a genetic predisposition for homosexuality. There is a huge difference, however, between a genetic predisposition that affects gender identity, and the choices we make in how we handle a predisposition. Although their work is far from conclusive, researchers such as Simon LeVay, Michael Bailey, and Richard Pillard have argued that homosexual tendencies may be indicated even before birth. But they will not go so far as to say that homosexual behavior is determined. Another pre-condition for some people is the presence of childhood or adolescent abuse, either emotional or sexual. It is very difficult to find a homosexual who did not experience the trauma of intense rejection, the horror of being molested, or the shock of an early sexual experience. Q. Wouldn't the presence of pre-conditions let homosexuals "off the hook," so to speak? A. Preconditions make it easier to sin in a particular area. They do not excuse the sin. We can draw a parallel with alcoholism. Alcoholics often experience a genetic or environmental pre-condition, which makes it easier for them to fall into the sin of drunkenness. Is it a sin to want a drink? No. It's a sin to drink to excess. All of us experience various predispositions that make it easier for us to fall into certain sins. We Reap What We Sow!! Body: The following was written by Ben Stein and recited by him on CBS Sunday Morning Com. My confession: I am a Jew, and every single one of my ancestors was Jewish. And it does not bother me even a little bit when people call those beautiful lit up, bejeweled trees Christmas trees. I don't feel threatened. I don't feel discriminated against. That's what they are: Christmas trees. It doesn't bother me a bit when people say, "Merry Christmas" to me. I don't think they are slighting me or getting ready to put me in a ghetto. In fact, I kind of like it. It shows that we are all brothers and sisters celebrating this happy time of year. It doesn't bother me at all that there is a manger scene on display at a key intersection near my beach house in Malibu. If people want a crche, it's just as fine with me as is the Menorah a few hundred yards away. I don't like getting pushed around for being a Jew, and I don't think Christians like getting pushed around for being Christians. I think people who believe in God are sick and tired of getting pushed around, period. I have no idea where the concept came from that America is an explicitly atheist country. I can't find it in the Constitution and I don't like it being shoved down my throat. Or maybe I can put it another way: where did the idea come from that we should worship Nick and Jessica and we aren't allowed to worship God as we understand Him? I guess that's a sign that I'm getting old, too. But there are a lot of us who are wondering where Nick and Jessica came from and where the America we knew went to. In light of the many jokes we send to one another for a laugh, this is a little different: This is not intended to be a joke; it's not funny, it's intended to get you thinking. Billy Graham's daughter was interviewed on the Early Show and Jane Clayson asked her "How could God let something like this happen?" She said, "I believe God is deeply saddened by this, just as we are, but for years we've been telling God to get out of our schools, to get out of our government and to get out of our lives. And being the gentleman He is, I believe He has calmly backed out. How can we expect God to give us His blessing and His protection if we demand He leave us alone?" In light of recent events...terrorists attack, school shootings, etc. I think it started when Madeleine Murray O'Hare (she was murdered, her body found recently) complained she didn't want prayer in our schools, and we said OK. Then someone said you better not read the Bible in school. The Bible says thou shalt not kill, thou shalt not steal, and love your neighbor as yourself. And we said OK. Then Dr. Benjamin Spock said we shouldn't spank our children when they misbehave because their little personalities would be warped and we might damage t heir self-esteem (Dr. Spock's son committed suicide). We said an expert should know what he's talking about. And we said OK. Now we're asking ourselves why our children have no conscience, why they don't know right from wrong, and why it doesn't bother them to kill strangers, their classmates, and themselves. Probably, if we think about it long and hard enough, we can figure it out. I think it has a great deal to do with "WE REAP WHAT WE SOW." Funny how simple it is for people to trash God and then wonder why the world's going to hell. Funny how we believe what the newspapers say, but question what the Bible says.. Funny how you can send 'jokes' through e-mail and they spread like wildfire but when you start sending messages regarding the Lord, people think twice about sharing. Funny how lewd, crude, vulgar and obscene articles pass freely through cyberspace, but public discussion of God is suppressed in the school and workplace. Are you laughing? Asbury Park man charged with six sexual assaults by MaryAnn Spoto Friday September 28, 2007, 1:13 PM Authorities in Monmouth County are calling an Asbury Park man a serial rapist after he was indicted this morning on charges of sexual assaulting six women since 2003. Michael Askins, 43, is accused of targeting women who walked alone in Asbury Park during the early morning. He threatened them with a stick, knife, box cutter or a gun, then dragged them into vacant buildings or under the boardwalk, where he sexually assaulted them, said Monmouth County Prosecutor Luis Valentin. The first attack occurred the summer of 2003, and the rest fell between November and December last year, authorities said. The victims were between 30 and 45 years old, Valentin said. Investigators landed a break in December, when they linked Askins to the attacks through a DNA from a victim, Valentin said. He was arrested in Delaware on March 13 and was indicted today on charges of kidnapping, aggravated sexual assault, weapons offenses and terroristic threats, Valentin said. How, Kennedy would ask himself, in the greatest country on Earth — with all of its opportunity and prosperity — could a person of common sense and a decent work ethic find himself in such a predicament? Kennedy, 64, now knows the answer. Since July, nestled between the opulent modern homes of Ocean Avenue and the Victorian houses of Belmar's tree-lined back neighborhoods, is a red, 1997 Chevrolet Astro that Kennedy calls home. "I am stuck with only one place to live in: a van. . . . I have no place to live," he said. "I wonder and I think, what did I do that's so wrong that put me in this situation?" During the day, Kennedy performs odd jobs at Calvary Baptist Church on the corner of 13th Avenue and E Street, where he has been a member for about six years and serves on the mission board. At night, he parks at different spots throughout Belmar and goes to sleep on a mattress behind the vehicle's rear tinted windows. Brendel, his 13-year-old pit bull mix, keeps watch. That's when the demons come, he said. "Where's my life going? I worry, what's going to happen to me? Will I wake up tomorrow? I just don't know what to do," he said, as he wiped away tears. "There's no safety net" Carolyn Sharrock, director of Belmar's Local Assistance Board, said Kennedy is a typical example of a person who has fallen through the cracks. "It is very unfortunate, there are people who are receiving very low amounts, so there's no safety net. Everything is income-eligible," Sharrock said. Kennedy, who up until July 13 was living in the Sea Breeze Mobile Home Park in Wall, was evicted after he was laid off from his job as a warehouse truck driver at Kmart and got behind in his rent. He had previously been living paycheck to paycheck. Without options, he sold his 1959 trailer, recouping $1,901 after paying his landlord back rent. Sharrock said Kennedy receives $636 in Social Security and $155 in food stamps each month. Under state and federal guidelines, without a place of his own, Kennedy makes too much to qualify for additional government assistance while simultaneously not enough to live on. Sharrock said a single person cannot earn more than $140 to receive more help, or $210 if the person is unable to work. The rule has not been changed since the 1970s, she said. Kennedy can and wants to work. Indeed, his resume is a record of steady employment since 1973. He was a truck driver and professional mover for United Van Lines for more than a decade, worked as an investigator for an insurance company traveling the country, and had spent the last decade as a limousine driver until he got a job at Kmart in Wall. But now he bears the stigma of being homeless. Potential employers are leery of taking him on, wondering about his credibility. Landlords question whether he could make the rent each month, he said. Sharrock has been trying to find Kennedy subsidized housing for senior citizens. Once he finds a place, he will be eligible for a series of additional state and federal benefits to help pay his rent and utilities. The waiting list is long, but because Kennedy is homeless, he has jumped to the top of the list and should have a permanent residence in about a month, she said. "It's frustrating; there's only so much we can do," said the Rev. Grace Scarle, pastor at Calvary Baptist Church. Scarle said Kennedy is a respected member of the church. She has given him a key to use the bathroom facilities of the church — day and night — and he has access to her family's private washer and dryer in the pastor's house beside the church. "We've helped him out with food and some monetary assistance," Scarle said. "(But) we're a small blue-collar congregation. It's heartbreaking." Kennedy pays $200 per month to keep all of his personal belongings, including his clothes, in a unit at Belmar Self Storage where he spends the first part of his mornings. He goes there to pick up a change of clothes and sits for a bit in a chair that once belonged in his home, sipping his Dunkin' Donuts coffee and trying to figure out how he got here. The rest of the day he wanders around town on foot, looking for help-wanted signs and winter rental signs. "Jack is not the only one," Scarle said. Repeated fiscal problems over the years triggered the state's decision, announced Tuesday, which was made under the School District Fiscal Accountability Act, known as the Willingboro Act. Asbury Park will be joining Willingboro, Camden, Paterson, Irvington and Pleasantville in having such oversight. The monitor arrangements have replaced a previous state initiative of taking over the running of poorly performing districts. Under the new system, the local school board remains intact but its financial decisions need the monitor's approval. "Once the monitor is in, the state has its presence in the district, the monitor has a presence and looks at all of the things happening there," Deputy Education Commissioner Willa Spicer said. "It is the conclusion that the state needs a presence in that district." The district has had a state intervention team working with school administrators, but that team did not have the authority of a fiscal monitor. The district is working to address areas that need to be improved under a new monitoring method called the Quality Single Accountability Continuum, or QSAC. But officials said the move to have direct control for some period of time over the district's finances is not connected to QSAC. Katherine Attwood, the state assistant commissioner for finance, cited repeated or serious problems found in the district's audits. Asbury Park's educational system has been in severe distress for at least a decade. During the past year, the school district struggled with acting superintendents coming and going while current Schools Superintendent Antonio Lewis remains suspended with pay for more than a year. The infighting in the district continues over jobs — from administrators on all levels to coaching jobs. Board member pleased "It's about time," Board of Education member Garrett Giberson said of the state monitor coming in. "It's absolutely great and something that's long overdue. I think the monitor will be able to lead board members in the right direction. "Let's face the facts," Giberson said. "Our administration is in chaos, and it all centers around the investigation of the current superintendent. . . . We are literally being held hostage." Before the board suspended Lewis right just prior to classes beginning last September, he had started to face opposition from the still relatively new business administrator, Aiman Mahmoud, who was prepared to leave if Lewis stayed. "Mahmoud seems to know what he's doing," Giberson said. "He's our money man, a pretty savvy guy when it comes to finances in the district. What messes he's cleaning up from the past is another story. We all know that messes can linger. It takes a while to straighten out." Board kept "in dark" Robert DiSanto, board president, said he was concerned that the decision to send in a monitor had not been discussed with the board. "We were completely in the dark regarding this," DiSanto said. "Nobody's communicated this to us at all. . . . We are making changes best we can to make it best for our district." Keisha Frazier, a 32-year-old parent with five children in the school system, said she welcomes the state's help. The arrests at an Avenue A home this week were part of a sweep by the Monmouth County Prosecutor's Office's Gang Task Force, a team made up of Prosecutor's Office detectives, county sheriff's and corrections officers and local police. A total of 21 people were taken into custody Wednesday and Thursday, after a lengthy investigation by the Gang Task Force into drug distribution by members of the Bloods street gang, according to a news release from the Prosecutor's Office. At the Avenue A home, police arrested nine people, including an Asbury Park woman who was charged with being the leader of a drug trafficking network, according to the Prosecutor's Office. At that home, police seized the suspected heroin and an imitation handgun, and they found a drug distribution operation that employed juveniles, according to the news release. Police also took three juveniles into custody. Among those arrested at that home was Ebony Peteete, 26, of the city, whom prosecutors say is a reputed Bloods member. She was arrested on a warrant charging her with being the leader of a narcotics trafficking network, a first-degree crime that carries a sentence of up to 20 years, if convicted. Peteete was also arrested on warrants charging her with three counts each of possession of a controlled dangerous substance, possession with intent to distribute, and distribution of a controlled dangerous substance. She was also charged with distribution of a controlled dangerous substance within 500 feet of public housing (Asbury Park Village). She is being held on bail set at $430,000. Ricardo Wesley, 22, of Asbury Park, whom prosecutors describe as a reputed Bloods member, was charged with two counts each of possession of a controlled dangerous substance, possession with intent to distribute, and distribution of a controlled dangerous substance. He is being held on $40,000 bail. Kevin Graham, 38, Michael Bradley, 37, Rosland White, 43, James Ruffin, 39, Eugene Peteete, 36, and Tanya Peteete, 33, all of Asbury Park, and Zachary Vreeland, 23, of Stafford, whom prosecutors describe as "reputed associates" of the Bloods gang, were charged with possession of a controlled dangerous substance, possession with intent to distribute, and possession with intent to distribute in a school zone and within 500 feet of public housing (Asbury Park Village). For law enforcement authorities, an "associate" is someone who has not been formally initiated into a gang but is known to associate with gang members. Graham, Bradley, White, Vreeland, and Eugene and Tanya Peteete were being held in lieu of bail set at $75,000. Ruffin was being held in lieu of $100,000 bail. The gang task force continued their work Wednesday night and Thursday, and arrested nine more people in the city and "the surrounding area," according to the Prosecutor's Office. Michael Lane, 57, of Red Bank, whom prosecutors describe as "a reputed associate" of the Bloods gang, was charged with possession of a controlled dangerous substance, possession with intent to distribute, and distribution of a controlled dangerous substance. Lane was being held on $20,000 bail. Dishaun Dixon, 21, of Lakewood, whom prosecutors describe as a reputed Bloods member, was arrested on Howell warrants, charging him with aggravated assault, burglary and criminal mischief. Dixon remains in custody in lieu of $75,000 bail. Markus Briggs, 18, of Asbury Park, whom prosecutors describe as a reputed Bloods member, was charged with unlawful possession of a handgun. The city deposited approx $140,000.00 for the value of his house at the time! Bruce never wanted to leave this beautiful home, but through eminent domain abuse he was forcibly removed and has been living in limbo for the past five years. His just compensation trial finally starts tomorrow in Freehold in Superior Court. The trial will be Tuesday and Wednesday before Judge Daniel M. Waldman in courtroom 218-W at 9:00am. It would be great if anyone can attend either day to show our support for Bruce through this very stressful time in his life. MY POSTING HABITS I have refrained from engaging the sirens and the pecksniffians in topics they obviously knew nothing about. I mostly posted invites to tune into my web casts. No more or less than Maureen Nevin - promoting her Asbury Radio Show or Shingazy (sp) her cable show. On occasion I come out to speak against Eminent Domain Abuse, Civil Rights Violations, Corrupt Elected & Appointed Officials, Jesus Christ and other ministries. Recently I came out in support of the Jersey Shore Rescue Mission. Apparently those who are against it think they can assail me with empty accusations and twisted interpretation of what I have posted over 15 years on the world wide web. I get the digest every time one is sent. I read every post, as busy as I am - I still spend the time to keep up to date as best I can. I have a persona l bias, because I am a born again, spirit filled, bible believing Child of God, saved by faith through Jesus Christ. Anyone who would have a problem with that, has a problem with me. MY MARKETING SKILLS I am not prone to revealing where I went to school (s) beyond the City University of New York. Degrees only serves people who are elitists. I have a strong conviction that the reason the poor are kept poor, starts with the quality of education they were deprived of. I want to relate to whom I minister to and have them relate to me as well. My web involvement was original and insightfully. I made an investment in it 14 years ago. I bought names that anyone could have gotten if they knew what they were doing and who realized this was the way of the future. I was shocked to see that asburypark.com was available the day I registered it first, and will always be known as the first registrant owner of that name. I thought it was important, more so than everyone else on the web today. Otherwise I would not have been able to have registered it, when I did. I sold that name two years ago to Joe, who passed away. Those of you that knew him, now know that I am not a judgmental Christian Pastor. For Joe and I had different sexual preferences. Joe offered me less than 4 other competing individuals and the city themselves. It was I who suggested to the guy in development for the city the name they could get and should get, and they did. Anyway, Joe had the best idea for the use of the name and he won out. Whoever is using it today, I am not happy about the neglect of the true purpose in the agreement between Joe and myself. Of course I promote myself, anyone with any basic non profit experience knows, you must always promote yourself. As for the finances of my ministry. Some on this board have taken direct shots at the way I handle "the money". They are stupid, and are taking chances by attacking me and an organization that has been under the microscope since I filed our Civil Rights Action against Long Branch on behalf of the organization itself, as well as I, its Founder & Pastoral Director. All our finances were submitted in discovery and if there was one dollar unaccounted for do you really think The organization would have the Department of Justice, The Becket Fund For Religious Liberty and our lawyer stick with us through this entire land use controversy? MY CREDENTIALS: The formal ceremonies I have been privileged to be a part of - licensing, ordination and dedication of the church, were done by organized clergyman in this very area. I served one church for 10 full years. They issued my Preacher's licence after 5 years of study and I was affirmed by the Superintendent of the Assemblies of God Ed Spinola - a very close and dear friend of my pastor, Rev. Ben Ragusa, of Faith Christian Fellowship, Tulsa. I was ordained by Bishop Robert D. Richardson, Sr. Freehold, NJ I was also invited to study under the Presbyterians and go to Princeton, by the session leaders of a very large congregation in Monmouth County. Since my first anointing in 1991 to my Ordination 1995, I have been in constant supervision by respected ministers locally and extra locally. The U.S. Coast Guard and the New Jersey State Police Marine Services Bureau began their search for Dalessandro off of Point Pleasant Beach Wednesday after a family member called authorities because he failed to meet her for a scheduled lunch date. The Coast Guard received the report at 1:30 p.m. and a helicopter was on the scene three minutes later, said Cangemi. Soon after, the crew discovered an overturned orange kayak about nine miles off shore, he said, adding that authorities have not confirmed that the kayak belonged to the missing boater. A somber Mayor Kenneth E. Pringle announced the news at a council meeting that he had sought and received authorization from the governing body to terminate the borough's partnership with Gale. The council's decision comes days after Gale had informed the town of its decision to back out of a key agreement to redevelop the first phase of redevelopment: 800 Main St., once home to a Sea Coast Chevrolet car dealership (which moved to Sunset Avenue in Ocean Township). Pringle said negotiations between Gale and the Di Feo family, owners of the showroom site, could not reach a deal to develop a 3•-story complex of condominiums and town houses along with 9,500 square feet of planned retail space. For several weeks, Pringle and his aides have been bracing residents for what he acknowledged Wednesday was obviously "bad news" for Belmar, one of countless victims in a sinking real estate market nationwide, he said. He also talked about the nation's "credit crunch" and how state courts have raised the bar on what can be defined as blight to prevent municipalities from abusing eminent domain in order to force unwilling residents and business owners from their properties. "From their (Gale) standpoint of view, they're having a hard time getting the numbers to work," Pringle said two weeks ago. Gale invested millions of dollars in architectural renderings and plans in Belmar, even though the company did not own a single piece of property in town, Borough Administrator Robbin D. "Vinny'' Baker, the former owner of an Asbury Park restaurant, pleaded guilty today to laundering $15,000 he received from an FBI operative during "Operation Bid Rig,'' an undercover sting operation that resulted in corruption charges against more than 20 public officials. Baker, 63, told U.S District Court Judge Jose L. Linares that he received the cash in May and June 2001 from Robert "Duke'' Steffer, the FBI's cooperating witness who was posing as a demolition contractor. In return for the cash, Baker said today "I issued (Steffer) a check on two occasions for $6,750 each,'' for a total of $13,500. The difference of $1,500 was Baker's "fee'' for laundering the cash. In exchange for his plea, the U.S. Attorney's Office will dismiss bribery charges against Baker upon his sentencing. Judge Linares set sentencing for Dec. 19. In today's Asbury park Press the following editorial appears. Eminent domain: Continue fight Assembly bill 138 would have put the eminent domain reform question on the ballot this November for the voters to deal with. ACR 138 was tabled in an Assembly budget session. I am calling for a statewide strategy. Pressure needs to be applied to those legislators who stood in the way of eminent domain reform. In Long Branch, townspeople are so frustrated with the tax-and-spend mentality of Mayor Adam Schneider's administration, coupled with the abuse of eminent domain, they are looking for new leadership at City Hall. Camden has successfully battled many pro-eminent domain forces. Assembly Speaker Joseph Roberts, D-Camden, no friend to property owners, has to be beaten at the polls this November. Senate President Richard Codey, D-Essex, who has clearly sided with mayors who use eminent domain for private gain, has to be confronted at the polls as well. We need to stop eminent domain abuse from doing any more harm to property rights in New Jersey. The Legislature has failed to produce reform in the last two years. On June 21, 48 Assembly members voted to table ACR 138. We can start with them. If they want to serve us in an elected capacity, then let them have a change of heart and protect us from any further abuse of eminent domain. Otherwise, let's send them back to private life. Many people think it is too late to do anything. The deadline to run a candidate has passed, people are trapped in litigation over this issue and we are apathetic and worn down. We cannot quit. David Petraeus says President Bush’s decision in January to increase the number of U.S. soldiers in Iraq by 30,000 is working - a point disputed by many Democrats, including one from South Jersey. The commander of U.S. forces in Iraq said today American and Iraqi troops have dealt “significant blows” to al-Qaida and Shiite militant leaders, adding that it’s possible to reduce the U.S. military force to pre-“surge” levels of about 130,000 by next summer. Petraeus said a long-term commitment is critical to stabilize the situation in Iraq, which right now is “complex, difficult and sometimes downright frustrating.” He said U.S. objectives would be met, but in time. However, Rep. Rob Andrews, D-Haddon Heights, said nothing in Petraeus’ much-anticipated testimony to the House Armed Services and Foreign Relations committees changes his mind that the war is misguided. The U.S. should no longer referee a “civil war” between Sunnis and Shiites, he said. All U.S. forces should be pulled out in the next 1½ years and the orderly withdrawals should begin in 90 days, said Andrews, a member of the Armed Services Committee. The point of the surge, which Bush announced in January, was to reduce violence and give the Iraqi government time to gain “legitimacy” to do its job, Andrews said. Petraeus’ report shows there’s been some reduction in the violence, though that's debatable, Andrews said. Working with faith-based organizations: challenges and benefits Abstract Serving with community organizations -- in particular, small faith-based ones -- presents a unique set of challenges for those in national and community service. Beverly Al-Amin of the National Crime Prevention Council shared strategies for overcoming potential obstacles at the 2005 AmeriCorps*Direct Best Practices Conference in Nashville, Tennessee in April 2005. Issue Working with any organization presents challenges, and community organizations are no exception. Action According to Beverly Al-Amin of the National Crime Prevention Council, take the following steps to deal with challenges posed by working with community-based organizations. Problem: The organization may be cautious about partnering with the federal government. Solution: * Be clear about the opportunities available to the new partner and how its program can be enhanced with this support. * Be specific about what activities can and cannot be done when organizations are partnering with the federal government. (See the section on legal guidelines below.) * Be aware that in the past, faith-based organizations might have limited their services to members of their own faith. When an organization becomes a Senior Corps volunteer station, their services must be available to all members of the community, regardless of their religious background. Problem: The organization may face administrative challenges, such as staff being unavailable to answer phones or be present during "normal" working hours. This is especially true for congregations (mosques, temples, churches, synagogues).Solution: * Be consistent and patient in communicating with the organization. * Be flexible in your schedule so you can meet staff when and where they are available. Problem: The organization may lack access to information.Solution: * Offer to invite the organization to community councils and networking opportunities. * Introduce staff to new and different sources of information. * Offer support to help the organization comply with local and federal rules on partnering with various organizations. Problem: The organization may need help with additional capacity building.Solution: * Every organization has both strengths and weaknesses; suggest ways you can help the organization maximize its strengths and compensate for its weaknesses. * Offer to share effective practices that have worked for your organization and might be adapted to work within their program or organization. Walk-through their (or your) processes or procedures step-by-step with an eye to highlight areas of efficiency and troubleshoot areas of "bottle necking." Problem: The organization may have language barriers. Members of the organization may not be fluent in English; words may be used in slightly different ways -- for example, a secular organization may talk about a "program," while the faith-based group has a "ministry." The two words often appear to be interchangeable, but they mean different things to each group. Solution: Ask a lot of questions when meeting with community organizations. Do not assume anything, and be specific about the expectations of the programs. Problem: The organization may feel protective of their programs and congregations. Sometimes new programs can be perceived as taking money, volunteers, and other resources away from an already limited capacity. Solution: * When meeting with a community organization, be prepared to discuss how the new partnership will support the mission and use the organization's resources to benefit the community. * Ensure that the organization has both the benefits and the responsibilities of a full partnership. Issue Just as public institutions reconsider their funding patterns and seek to engage faith-based organizations more actively, private philanthropies also have the opportunity to forge partnerships with these groups. Action According to the National Crime Prevention Council's publication, "Philanthropy and Faith: An Introduction," steps to take when partnering with faith-based groups include the following: Find common ground. It is almost always there. You and many of the faith-based groups in your community share purposes. You may find that you agree on many of the goals although you may have different ways of getting there. Work together on those elements where you find common ground and respect those where you don't. Establish clear guidelines on how you are willing to give support and assistance to faith-based organizations or programs in the community. Make it clear what you pay for and what you don't pay for. Help build capacity. Be sure to provide training and technical assistance to support the aims and purposes of the guidelines. Remember that for many local groups capacity is an issue. Help groups recognize that they can grow, but don't try to make them stretch without providing the resources for growth. Assume the responsibility for recognizing their capacity and your ability to help them grow. In many cases you will be dealing with smaller, less formally organized, and less experienced groups. They may need help in understanding how to become an incorporated or nonprofit organization if that is what is required before your organization can fund them. They may need assistance in determining what they can or should evaluate and how to do so inexpensively. Consider working through "intermediaries"— nonprofit entities that receive and manage monies for small, faith-based groups. Small- to mid-sized faith-based organizations will also need to look to government and the philanthropic community for financial support to continue this work. While their ability to draw on volunteers may offset overall costs, the increasing need for improved organizational infrastructure and professional staff will eventually outstrip their own resources. Recognize that different groups have different purposes. In fact, one group may have several different programs with dissimilar purposes and different levels of grounding in faith-related issues. Don't look at labels or emblems but at a group's actions and methods of reaching the goals. Realize also that faith-filled groups may be fully capable of running faith-based programs. Develop an understanding of faith in the community. A faith-based group within the community may be an agent of change, a builder and keeper of norms, an administrator of a program, a seeker and healer of the lost and forgotten, or a restorer of civic health. A faith-based group may take on one or more of these roles at various times. It's important to understand the context in which faith acts to move and shape the community. See the faith community and the faith-based group as a partner — a natural partner of seemingly unnatural allies, such as the police department, the school, or social services delivery systems. Seek not just fiduciary relationships but operating partnerships. Take an active role as an agent of change. Bring together groups that share commitment, purpose, and approach. Help them learn from each other, and help them grow with each other. Link with others — national and local — to build a philanthropic network around the faith-funding issue. Bring in public agencies — local, state, and national — in your area that may be funding or have an interest in funding faith-related programs. Be ready to relate to new groups with new constituencies. There are new and important players coming to the table, such as representatives from Latino Pentecostal-Holiness churches and from mosques who are beginning to see private and public monies as important to their social work. Demand accountability. Good stewardship is as much a part of faith as it is of philanthropy. Treat faith-based groups as you would any partner. Agree on outcomes and timelines. Don't let groups make promises that will be difficult to keep regarding results or the promptness of delivery. Be clear about legal boundaries. Stay in for the long haul. It may take a long time for change to be able to happen both for people and for communities. Be sure to give programs a chance to work. Keep in mind research, track records, and plausibility when assessing what is presented to you. Faith based organizations, no matter how noble their intentions, may not understand the scope of the problem or the needs that they're trying to address. This is a Prayer given in Kansas at the opening session of their Senate. It seems Prayer still upsets some people. When Minister Joe Wright was asked to open the new session of the Kansas Senate, 'Heavenly Father, we come before you today to ask your forgiveness and to seek your direction and guidance. We know Your Word says, 'Woe to those who call evil good,' but that is exactly what we have done. We have lost our spiritual equilibrium and reversed our values. We have exploited the poor and called it the lottery. We have rewarded laziness and called it welfare. We have killed our unborn and called it choice. We have shot abortionists and called it justifiable. We have neglected to discipline our children and called it building self esteem. We have abused power and called it politics. We have coveted our neighbor's possessions a nd called it ambition. We have polluted the air with profanity and pornography and called it freedom of __expression We have ridiculed the time-honored values of our forefathers and called it enlightenment. In 6 short weeks, Central Christian Church, where Rev. Wright is pastor, logged more than 5,000 phone calls with only 47 of those calls responding negatively. The church is now receiving international requests for copies of this prayer from India , Africa and Korea Commentator Paul Harvey aired this prayer on his radio program, 'The Rest of the Story,' and received a larger response to this program than any other he has ever aired. Asbury Park City Council should have rescinded the 45 day sentence at it's last council meeting by resolution and ended this imprisonment for Werner. Railings on a porch can be useful, however private property should be respected. The public cannot trespass so where would the public safety concern be in this matter. Crumbling ceilings? Show me one person who was injured in that house. Werner shows good judgement by at least not renting his apartments until he fixes the place up for tenants. [AsburyPark] Fighting to preserve property and commerce
Existing businesses shut out of Broadway plan The Broadway Arts Plan scheduled to condemn properties through the excessive powers of eminent domain, the brainchild of the Katz and Siperstein families, violates the first law of economics. It will add to the supply of what there is already too much of in the state, and specifically Long Branch, without in fact doing anything to change the demand side of the equation. It is wrong from its inception and is being forced upon the community as a direct result of the relationships between the developers and the politicians. The developer needs to modify its attitude, more than its design plans, to guarantee the success necessary to result in the "public" good and purpose. The attitude of the city is blind and deaf to those already in the area who own and operate good solid businesses. The attitude of the managing partner, Todd Katz, is totally out of touch with viable economic development, which would make the project more inclusive of those elements already in place that are not blighted in the traditional sense. Yet what amazes me, is that Todd Katz is on the Urban Enterprise Zone board here in town. He needs to modify his attitude to allow those willing to continue in their respective properties. Public support of the project is essential if the end plan is to draw the needed visitors to the area where economic growth could occur. Not the type of economic growth that Pier Village and Beach Front North failed to give us. My evidence to the failure of the complete beachfront projects is the catastrophic tax increases the property owners outside the redevelopment area were hit with this year. The purest form of proof of a development project being economically viable to the further growth of the base of its taxpayers. Here in Long Branch we have had major density increases and commercial development, however the taxes have increased upwards of 200 percent outside the development zones in Long Branch. Any project that costs taxpayers more outside the project area itself is detrimental to the whole financial health of the city. What can be done to reverse this negative turn of events? The development area needs to become attractive in more areas than the developers are concentrating on. The need to stimulate the right interest, not their own interests to the plans must be considered. People from all over the state, and beyond, will want to come to spend recreational time and spend money here in town if they have an admiration of the area. Our beach is the best in the state, and so should our developments be. The very first thing the developer needs to do and the city needs to address is allowing those presently in the Broadway Arts Zone to remain. Katz and his team are smart enough to figure out what to do with their present holdings without forcing out those who are operating essential businesses already. Since the approval of the Katz plan, many small businesses have been put out. We have lost a family run grocery, bakery, barbershop, restaurant, electronics store and gift shop. The only small business owners still operating are those housed in buildings owned by the private owners and not the Broadway Arts Center. The plan eliminates private business owners, destroys independent commercial property ownership and looks to replace diversity and individuality with "Super Blocks." The state development authorities should be outraged and so should the people of Long Branch. This is more than an eminent domain abuse situation. This is a situation where the little guy is being put out so that a monopoly with strong political ties can become the owner of everything! The very thing that Justice Sandra Day O'Connor, warned us all about in her dissent of Kelo v. New London. What can you do? Call and encourage Mayor Adam Schneider and the City Council to work together for the good of the small business growth in our community. It is the best way to foster a real economic growth for years to come. Please encourage them to make certain that the present owners remain in their respective buildings and give them the development rights to ensure them the tools necessary to rebuild if necessary. This would automatically end the need for eminent domain in the zone. The statute allowing it points out that it should only be used sparingly and as a "last resort." Something Mayor Schneider seems to want to ignore, as evidenced by his dismissal of the cries against forced removal in MTOTSA. Also call the Broadway Arts Center developer and tell them you want them to work toward protecting small business owners and independent commercial development, and end the "Super Block" attitude. [AsburyPark] Resoultion needed by Asbury City Council - Emergency Commuting of Sentence
I learned today that he is serving a sentence and that is why there is no bail. He can only be released by a Judge or a commuting of sentence by the local authorities and or the Governor. If you agree that he should be released than Call Asbury Park and ask them to pass a resolution at tomorrow night's council meeting to commute the sentence to time served. The gesture underscored the U.S. belief that the spark for progress may come at the local level. Defense Secretary Robert Gates arrived ahead of Bush and conferred with senior U.S. officials, including Gen. David Petraeus and Ambassador Ryan Crocker, before a session with Prime Minister Nouri al-Maliki, President Jalal Talabani, and other top Iraqi officials from Baghdad. To a large degree, the setting was the message: Bringing al-Maliki, a Shiite, to the heart of mostly Sunni Anbar province was intended to show the administration's war critics that the beleaguered Iraqi leader is capable of reaching out to Sunnis, who ran the country for years under _Saddam Hussein_ ( breitbart.com&eid=csl&tid=5e1f511db&site=breitbart.com) . It started out innocently enough. I began to think at parties now and then -- just to loosen up. Inevitably, though, one thought led to another, and soon I was more than just a social thinker. I began to think alone -- "to relax," I told myself -- but I knew it wasn't true. Thinking became more and more important to me, and finally I was thinking all the time. That was when things began to sour at home. One evening I turned off the TV and asked my wife about the meaning of life. She spent that night at her mother's. I began to think on the job. I knew that thinking and employment don't mix, but I couldn't help myself. I began to avoid friends at lunchtime so I could read Thoreau, Muir, Confucius and Kafka. I would return to the office dizzied and confused, asking, "What is it exactly we are doing here?" One day the boss called me in. He said, "Listen, I like you, and it hurts me to say this, but your thinking has become a real problem. If you don't stop thinking on the job, you'll have to find another job." This gave me a lot to think about. I came home early after my conversation with the boss. "Honey," I confessed, "I've been thinking..." "I know you've been thinking," she said, "and I want a divorce!" "But Honey, surely it's not that serious." "It is serious," she said, lower lip aquiver. To this day, I believe that a Higher Power was looking out for me that night. Leaning on the unfeeling glass, whimpering for Zarathustra, a poster caught my eye, "Friend, is heavy thinking ruining your life?" it asked. You probably recognize that line. It comes from the standard Thinkers Anonymous poster. This is why I am what I am today: a recovering thinker. I never miss a TA meeting. At each meeting we watch a non-educational video; last week it was "Porky's." Then we share experiences about how we avoided thinking since the last meeting. I still have my job, and things are a lot better at home. Life just seemed easier, somehow, as soon as I stopped thinking. I think the road to recovery is nearly complete for me. Paul V. Fernicola, who represented Freedman's Bakery, said he is in a good position to make that statement because he is defending the city's use of eminent domain against the Anzalone family, which has owned a home near the city's oceanfront for nearly half a century. Fernicola said the city's argument in support of using eminent domain to redevelop what he considered a blighted neighborhood is much stronger than what was presented by Belmar and deemed insufficient in a state appellate court ruling made public Wednesday. While Long Branch's case might be stronger, its redevelopment study fails to show that the so-called blighted area should be condemned, said Scott Bullock, a lawyer from the nonprofit Institute of Justice, which is representing a group of homeowners there. "The redevelopment study doesn't meet the state criteria to prove that an area needs redevelopment," Bullock said. In the Belmar case, a three-judge panel ruled that Belmar did not show that the operation of the bakery was a detriment to the public. The borough's argument — that the bakery should comply because its facilities weren't modern — was not enough to win over the judges. The ruling cited a recent decision in which the state Supreme Court said Paulsboro could not condemn a property simply because it is not "fully productive." While Fernicola said Long Branch has argued to use eminent domain on the same grounds, he said the city's case is stronger than Belmar's. Furthermore, the city has presented three other reasons why the use of eminent domain would be legal in MTOTSA, which is an acronym for the neighborhood in question — Marine Terrace, Ocean Terrace and Seaview Avenue. The city wants to clear MTOTSA for the second phase of Beachfront North, a redevelopment project that includes 185 luxury condominiums and a two-story public pavilion. Two challenges to the project — one by the Anzalones and another by a larger group of homeowners represented by Bullock — are pending before a state appellate court, which intends to rule on both cases simultaneously. All sides have submitted briefs to the court. The next step would be the presentation of oral arguments, a date for which has not been set. The arguments, Fernicola said, aren't expected to be heard until at least the fall. James G. Aaron, who is defending the city against the homeowners represented by Bullock, said the Belmar case and one involving Long Branch should not be compared. The Belmar case dealt with a single property, while the Long Branch case concerns an area. "The MTOTSA area was found to be part of a redevelopment zone that was necessary for redevelopment and met the statutes," Aaron said. Anna DeFaria, an 81-year-old resident of Marine Terrace, said she was not familiar with the Belmar case, but added that she and her neighbors could use all the help they can get. The undercover detail done near the beachfront was part of the department's ongoing effort to combat prostitution throughout the city, police said. "This operation is just another example of how the police department is working hard to address all of the issues that are effecting peoples' quality of life in the city,'' said Police Chief Mark Kinmon. Capt. David Kelso said the female officer was on foot, while members of the detective bureau and street crimes unit handled surveillance Wednesday afternoon. The men approached the plain-clothes officer on foot and in vehicles, he said. Of the 18 men accused of offering the officer money for sexual services, one-third - six --were from out of town, authorities said. Charged with soliciting for prostitution were: Arius Lahens, 37, of Heck Avenue, Neptune; Jerome Meiselman, 77, of Genesse Avenue, Oceanport; Brian Smith, 36, of Sea Drift Avenue, Highlands; Michael Madden, 58, of New Bedford Road, Spring Lake; Angel Zuniga, 21, of Tenth Avenue, Belmar; Andrew Menyhart, 48, Lafayette Drive, Brick; and city residents Juan Santiago-Reano, 25, Jenaro Gomez, 28, and Rogelio Zarate-Martinez, 41, all of Second Avenue; Alberto Diaz-Rosas, 31, of Sixth Avenue; Jesus Martinez-Serrano, 29, of Emory Street; Jose Tatis-Pena, 46, and Percio Gomez, 44, both of Ocean Avenue; Arturo Massa, 38, of Fourth Avenue; Anthony Williams, 50, of Seventh Avenue; and Ezequiel Anaya-Flores, 33, Tysonne Broadie, 30, and Abel Contreras, 35, all of Eighth Avenue. The decision last Tuesday was a result of a federal lawsuit that was filed by Christian legal group Liberty Counsel on behalf of Lighthouse Christian Center, noting that the “church-free” zone was violating the Religious Land Use and Institutionalized Persons Act (RLUIPA) and the First and Fourteenth Amendments. The Fourteenth Amendment states that "no State shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any State deprive any person of life, liberty, or property." "We are pleased that local governments are getting the message that churches are not second-class property owners,” commented Liberty Counsel founder Mathew Staver, in a statement. “The First Amendment and federal law both provide that churches and houses of worship should receive equal, if not preferential, treatment to other similar zoning uses. Churches are not orphans to any zoning district." According to Lighthouse staff, the local church was in need of a location that could house its growing ministries, especially their youth outreach. Until last summer, the ordinance had forced them to locate themselves in a residential area which they report as having no sewer or running water. Once the religious center had outgrown the facility, it confirmed a spot within Titusville’s C-1 commercial zone in July 2006. Tim Lorenz, a building inspector and zoning officer for the city of Titusville, would not allow the religious institution in the city, however, citing the “Codified Ordinances of Titusville.” The city law only provided space for stores, restaurants, offices, theaters, gas stations, hotels, clubs and other nonreligious services. Lighthouse attendants then had to move to another temporary location outside the city that lacked heat and insulation. In addition, the church’s target youth ministry demographic was inside the C-1 district. "[The church was] in dire straits because this particular city ordinance [had] essentially removed them from the city limits and they [couldn’t] use the property that was ideal for them,” explained Staver in Cybercast News Service. Lorenz clarified that he had nothing against Lighthouse Christian Center, but that he was simply holding up the law, which had been around since 1976. "It is a pretty old ordinance, and what the people who are responsible for writing the ordinance had in mind back then, I have no idea," said the building inspector in defense of his position in Cybercast News Service. "I am just enforcing it as it is written." Following the lawsuit brought up by Liberty Counsel attorneys, the city reached a settlement with the Christian litigation group where officials agreed to eliminate the discriminatory ordinance and amend its policy. Lighthouse Christian Center can now move into the commercial district where members are planning their outreach, which includes a Christian bookstore, television ministry, outreach to teens, and church services. The city of Titusville also paid for attorney’s fees. In addition to Lighthouse, several other cities in the past have resolved the similar situations, including a decision by the City Council of Washburn, Wis., which voted to repeal its zoning ordinance to eliminate discriminatory restrictions on churches. The ordinance prior to the vote in March prohibited any church from locating on commercial property, even though the code permitted other nonreligious public assemblies within the same commercial districts. Sewage spill makes ocean off limits at some NJ beaches Eyewitness News (Monmouth County - WABC, June 5, 2007) - Swimmers in some Monmouth County beaches were advised to stay out of the water after partially treated, heavily chlorinated sewage discharged from the Asbury Park sewage treatment plant. Officials say no-swim flags were posted between Deal and Bradley Beach after a sludge return pipe broke in the plant early Tuesday morning. Some 500,000 gallons of partially treated sewage were discharged from the plant starting at 3 a.m, according to authorities. They say the problem was fixed by 9:30 a.m., but the damage was done for the day. Officials expect the problem to be fixed at most of the beaches by tomorrow, when they retest the samples. Attorney Patrick T. D'Arcy filed the lawsuit against Asbury Partners, LLC and AP Venture Holdings on behalf of the estate of James Morrison, a Navy veteran of the Iraq War who was found unresponsive and bleeding from the back of his head outside Club Deep on Ocean Avenue in Asbury Park about 5:50 p.m. Jan. 14. Morrison was pronounced dead less than an hour later, and an autopsy revealed the cause was blunt-force trauma to the head. Morrison had been in the club with some friends listening to music when they became involved in an altercation with another group of people over a T-shirt worn by one of Morrison's friends, authorities have said. Morrison was asked to leave the club and was escorted outside when he was punched in the right side of his face and fell backward, striking his head on the sidewalk, authorities said. Alexander J. Franklin, a 34-year-old Brooklyn tattoo artist who authorities said is associated with a gang known as FSU, has been charged with manslaughter in connection with Morrison's death. D'Arcy maintains in the lawsuit that on the day Morrison was fatally assaulted outside Club Deep, its owners, Asbury Partners and AP Venture, were hosting a show featuring a number of "hardcore" bands that "notoriously and openly promoted violence, fighting, aggression and criminal behavior as a lifestyle and, more particularly, at and during their live performances." The lawsuit alleged that the bands that played at the club that day had a "known reputation and history" of drawing gang members and individuals prone to violence, that Asbury Partners and AP Venture directly or indirectly fostered an environment of violence, intimidation and criminal behavior at the club, and that the club owners failed to provide adequate security for its patrons. In addition, the lawsuit alleges that the club's owners and employees failed to summon police and medical personnel for Morrison in a timely fashion after he was assaulted. "As a direct and proximate result of the aforesaid negligence, carelessness, and breach of respective duties, the deceased plaintiff James Morrison sustained severe personal injuries, ultimately causing his death," the lawsuit said. "Defendants Asbury Partners' and/or AP Venture's actions and/or inaction were engendered by their financial considerations and motives to gain profits at the expense of the security and safety of Club Deep patrons and/or business invitees, as well (as) the security and safety of the local residents of the City of Asbury Park, New Jersey." Larry Fishman, chief operating officer of Asbury Partners, informed of the lawsuit late Friday, said he had no knowledge of it and would not comment. D'Arcy could not specify how much in damages Morrison's family is seeking. "We're trying to get fair compensation, and it (the lawsuit) is to answer questions for the family as well," D'Arcy said. The girl, whose name was not made public, was released from Jersey Shore University Medical Center in Neptune Tuesday, police said. Around 9:15 p.m. Monday, the girl was in the back seat of a vehicle that also was occupied by two other people. The driver pulled out of the parking lot of the McDonald's restaurant on Main Street and turned left onto Sixth Avenue, police said. As they headed east on the 800 block of Sixth Avenue, shots were fired into the vehicle, Capt. David Kelso said. The girl was struck in the shoulder, he said. Neither the driver nor the front-seat passenger was hit, Kelso said. Police still are trying to determine if the bullets were fired by someone who was standing on the street or who was in another vehicle. The shooting investigation is being handled by city Detectives April Bird and Terry Williams, along with Detective Louis Zuppa of the Monmouth County Prosecutor's Office. Letters May 17, 2007 Public advocate should vet all property takings Ronald Chen, public advocate, a good man by the way, wants to put a face on what eminent domain abuse has done to folks in New Jersey. He really doesn't have to look far. Long Branch took 47 Cooper Ave. in November 2002. The home belonged to Bruce MacCloud where he lived 300 feet from the ocean for over 20 years. He did not want to move, he was not cooperative with the taking, and as a result was forcibly removed by Long Branch police. Two months later his house was demolished, and today there are million-dollar condos on his 10,000 square feet of land. What makes this so horrible is almost five years later, Mr. Mac Cloud is still homeless, because the compensation courts have yet to have his trial. The Long Branch legal team keeps postponing his trial for some reason or another. His matter has been recycled in the Monmouth courts more times than any aluminum can. Bruce is at wit's end and continues to suffer under the abuse of Long Branch eminent domain, along with many others throughout the state. The MacCloud matter is so embarrassing to the state, no one wants to talk about it. We should be ashamed of ourselves. As we build homes, schools and hospitals for the people of Afghanistan and Iraq, how can we stand idly by while one of our own is treated less than those overseas? Eminent domain has done enough damage, especially in Long Branch, the largest abuser. The most recent budget here has a substantial increase in our taxes. Obviously, the redevelopment of Long Branch, as pretty as it may be, hasn't even provided economic relief to the taxpayers of the city. Yet it continues. Gov. Jon Corzine said he was blessed to survive his life-threatening accident. Eminent domain is no accident, yet it threatens the quality of life for private property owners and taxpayers alike. He needs to share the blessing he seems to have gotten, by calling for a moratorium on all seizures of private property, and causing all takings agencies in the state to gain approval for those takings through the Public Advocate's Office. Local boards who have the power to abuse eminent domain should have to answer to a higher power, before they destroy the quality of life for one more family. God bless Bruce, God bless New Jersey. Eminent domain sparks squabble Tuesday, May 08, 2007 By TRISH G. GRABER Staff Writer TRENTON -- Eminent domain reform proposed by New Jersey Public Advocate Ronald Chen could "paralyze" redevelopment efforts in the most densely populated state in the nation, said a top Democrat on Monday. Chen has proposed reforms to the state's eminent domain laws through his involvement in court cases about Paulsboro, Lodi and Long Branch. One suggestion includes the requirement that government -- instead of property owners -- bear the burden of proof when challenged on blight designations. "Changing the burden of proof will create a litigation nightmare," said Senate Majority Leader Bernard Kenny, D-Hudson County, in a budget hearing for Chen's department Monday. While agreeing that the process could be made more transparent and that compensation could be adjusted, Kenny said that shifting the burden to government would steer private investors clear of urban areas. Investors would not risk being held up with time-consuming lawsuits, he said. Kenny also questioned the legal tactics that Chen had used to push his proposals in court. "Is this your intent, to change the law through the courts rather than the Legislature?" Kenny asked. Sen. Sharpe James, D-Essex, commented that Chen said he would try to resolve matters through other means before taking it through litigation, stating that Chen "went into court seeking publicity." But Chen contended that was a misunderstanding. All three cases were in progress before he entered as a "friend of the court." "When the Supreme Court decides it's going to take a case on the definition of blight ... if you don't get on that train, it's leaving without you," he said after the hearing. Chen recently testified before the New Jersey Supreme Court in Gallenthin Realty Development v. the Borough of Paulsboro in an attempt to narrow the definition of blight. He argued that the criteria Paulsboro had used to designate a 63-acre tract of land "in need of redevelopment" -- based on its underutilization -- could open the door to land seizures statewide. As a "friend of the court," he also submitted briefs in the Long Branch and Lodi cases, currently in the state Appellate Division. Aside from court involvement, Chen has worked on and endorsed legislation to reform eminent domain laws sponsored by Assemblyman John Burzichelli, D-Paulsboro, which passed the Assembly last year. The measure recently stalled in the upper house after Sen. Ron Rice, D-Essex, proposed a competing bill. Chen said in the year ahead, he plans to continue lobbying on behalf of residents threatened by eminent domain abuse -- a population that he said is at a legal and financial disadvantage. "Obviously, I think there are problems," Chen said. "I think it involves a constituency that up until now haven't had representation." The committee chairman, Senate Majority Leader Bernard Kenny (D-Hudson), told Chen his attempts to change eminent domain could create "endless litigation" that would "paralyze" efforts to revitalize urban areas. Sen. Sharpe James (D-Essex) said Chen's decision to get involved in ongoing court cases over eminent domain contradicted his earlier assurances that he would "not litigate first." Chen said eminent domain battles in Long Branch, Lodi and Paulsboro already were in litigation when he joined them as a friend of the court on the side of the homeowners. "It was definitely in the public interest that we be involved," Chen said, adding that the three cases have raised "very important" legal questions. Chen also said he does not want to abolish eminent domain, but make it fairer. He said a municipality should have to prove an area is "blighted" before it can condemn it for private redevelopment. Kenny told Chen such a change would "create a litigation nightmare in the state that will paralyze redevelopment. Both Kenny and Chen agreed, however, that those whose homes are taken by the government deserve more compensation than they usually get. The subpoena was limited in scope compared to an earlier raid by state authorities Feb. 22 when investigators filled a truck with boxes and computers. The search warrant at that time covered both the district's central business offices on Lake Avenue and the district's computer and technology center on Park Avenue. School board officials in recent weeks have expressed frustration that the state has not been able to get to the point in its investigation to help the board resolve the issue of Lewis' suspension and get a new superintendent in place. "We have been putting pressure on the investigative agencies to move the investigation along as best they can, as quickly as they can,'' said Alan J. Schnirman, the school board attorney. The school board early last September wanted to buy out Lewis' contract, but the state Department of Education intervened and did not let Lewis get the money had agreed to -- $600,000. State education officials have been overseeing district expenditures and working closely with school administrators since September. Atlantic Yards Hit with Seventh Lawsuit by Sarah Ryley ([EMAIL PROTECTED] (mailto:[EMAIL PROTECTED]) ), published online 04-09-2007 Opponents Ask Court To Make Project Start Review, Approval Process Over By Sarah Ryley Brooklyn Daily Eagle FORT GREENE — Opponents of the Atlantic Yards arena and high-rise development filed a lawsuit yesterday seeking an annulment of the project’s approval based on deficiencies in its Final Environmental Impact Statement (FEIS), bringing the tally of project-related lawsuits to seven. The plaintiffs, which include 26 community groups ranging from neighborhood block associations to the Sierra Club, will be asking state Supreme Court Justice Joan Madden (Manhattan) to stop demolition and construction until the case is resolved. If they win, the project would have to start the entire review and approval process over again, which could take years. Project developer Forest City Ratner Companies, the ESDC, the Public Authorities Control Board and the Metropolitan Transportation Authority are all named as defendants. “The suit filed today by project opponents should come as no surprise to anyone, as the opponents have claimed publicly that their strategy is to sue early and often,” said FCRC Executive Vice President Bruce Bender. “[Yesterday]’s action is simply the latest in a long line of attempts to derail Atlantic Yards and the over 2,500 units of affordable housing, thousands of jobs for the community, job training programs, a new precedent for minority and women workers and contractors, and a new exciting home for the Nets [basketball team],” said Bender. “We believe that the opponents’ claims are without merit and we will prevail in court.” Daniel Goldstein, a plaintiff in one of two lawsuits challenging the project’ s use of eminent domain, said preparations “to challenge what we knew would be a flawed FEIS” have been three years in the making, “because we knew it would be predetermined who the developer of the project would be.” Goldstein is also the spokesman for Develop Don’t Destroy Brooklyn (DDDB), the group leading opposition to the project that is named in this lawsuit and two others. Central to arguments against the project is the fact that no other developers were seriously considered for redevelopment of the Vanderbilt Yards, situated at the intersection of Atlantic and Fourth avenues, and essential to the 22-acre project. “For nearly four years, we participated in an exhaustive public review process, involving hundreds of meetings with local leaders and officials, including numerous public hearings, as well as countless meetings with community representatives,” said Bender. “We have also complied with rigorous state and city requirements, resulting in what we believe is a better project.” Does an Arena Serve A ‘Civic Purpose’? The lawsuit also seeks a declaration that a privately-leased and operated sports arena does not meet the definition of a “civic project” under the Urban Development Corporation Act, which was established in the 1960s to fast-track urban renewal. The act gives the ESDC the power to issue bonds and grant tax abatements, condemn land and seize property through eminent domain, and to overrule local zoning laws without acquiring legislative approval for urban renewal-related projects. The ESDC has often used its authority to spur private development. The Jacob K. Javits Convention Center and the redevelopment of Times Square, which both used eminent domain, and the World Trade Center Memorial Fund are a few examples. Opponents of the project said the Barclays Center — named after Barclays Bank purchased the naming rights for the Nets arena and immediately surrounding high-rises — is not a civic project because community groups would only have use of the arena for 10 events a year, at a prohibitively high price. Community groups would be charged $100,000 to hold events like high school graduations at the Barclays Center, according to a state-mandated financial analysis of the project. Other nights would be used for Nets basketball games and concerts. The lawsuit contends that “the home of a professional sports team and commercial venue [is] by no stretch of the imagination a ‘facility for educational, cultural, recreational, community, municipal, public service or other municipal purposes.’” Supporters of the project have argued that the affordable housing and jobs it provides would also serve a civic purpose. “Another delay in the Atlantic Yards project means delaying economic opportunity for many in the Brooklyn community,” said Delia Hunley-Adossa, chair of the committee overseeing the project’s Community Benefits Agreement. “Those opposing the project can afford delays, but what of the over 2,000 who are clamoring for jobs, the hundreds of minority and women-owned contractors w

On Saturday, officers arrested Bibby at his Fourth Avenue home, where they also confiscated 25 bricks of heroin, with a street value of roughly $18,000 to $24,000, said Bercovicz. He said a brick of heroin contains 50 packets of the drug, which are worth about $15 to $20 on the street. Bibby was charged with possession of a controlled dangerous substance, possession with intent to distribute, possession in a school zone and possession within 500 feet of a public park. The drug possession charge is a second-degree offense, which carries a five to 10-year-prison term, if convicted. Bibby was also charged with simple assault in connection with a domestic violence case, police said. Bercovicz said the arrest and seizure also resulted in further information for additional investigations. Bibby was sent to the Monmouth County Jail, Freehold Township, with bail set at $100,000. During the hearing before U.S. District Judge John J. Hughes, Bryant was told he faces 150 years in prison while R. Michael Gallagher, a former dean at the University of Medicine and Dentistry of New Jersey, faces 220 years in prison on the same federal charges. Bryant was told he could only travel within New Jersey and eastern Pennsylvania. Gallagher surrendered his passport, a 30-year-old shotgun and was told his travel was restricted to New Jersey, eastern Pennsylvania and Florida. Let me be the one to say it out loud. The only real reason there is a conflict over This Mission in Asbury Park is because the spiritual leaders of this organization have gone on the record that homosexuality is a sex addiction. So, now let me go on the record. In the light of having 50 States in the Nation, and seeing 45 States passing amendments to define marriage as being of one man and one woman, and having only one State out of 50 allowing Gay Marriage, that being Massachusetts, it's a small issue. Let's not allow it to even be as big as some would like it to be. I agree that every individual should have the civil liberty to select one other person and bestow upon them all things a spouse can bestow upon another spouse, if they are an American citizen, they have inalienable rights. However there is no way marriage should be permitted between two members of the same sex. But before I even discuss the issue let me point out that the real problem stems from all promiscuity. Intimate sexual activity should be restricted to only people who are married and this is not a pitch for legislation controlling the marriage bed. This is moral and character in nature not legal or otherwise. People of faith need to ban together to promote values, starting at a very basic level, in the home. Schools need to stay out of the character development of our children, and politicians need to simply raise their own children and stop legislating sacred matters. Government should never attempt to legislate "morality." Government would be best tending to the budget and spending of tax payer dollars. Gay citizens have civil rights, granted. However, they do not have the right to invade the Kingdom of God in a manner that diminishes the entire power of the faith within the Kingdom. The whole battle is against the Kingdom of God. Those who are subjected to God's will understand this. Be kind to your neighbor but be pure before our God. Even I admit of falling short of the glory of God, but I die daily to my selfish desires and hope to increase each moment in His desire for me. Kevin Brown of 162 Broadway. Brown, who was joined in the action by Gopal Panday, owner of Rainbow Liquors, whose corporate name is Cottage Emporium, 141 Broadway, had sued the city to block the Broadway Arts Center project. When the city was named in the lawsuit, it applied to its insurance carrier, St. Paul Fire and Marine Insurance company, for coverage. But because the action involved the use of eminent domain, St. Paul declined coverage. The lawsuit was largely dismissed — one count remains — and St. Paul has now agreed to pay $17,685.28, which was the cost of the city's legal fees and expenses in the case. If Brown and the other plaintiffs pursue an appeal of the Dec. 19 summary judgment ruling, St. Paul will pay 25 percent of the fees and costs, according to the resolution passed by the council accepting the settlement. Brown said the resolution was flawed and discriminatory because it only identified him by name when in fact there were four individuals and six trade names identified as plaintiffs. "If this is not arbitrary and capricious and personally discriminatory against me, please add every single name," Brown said. The resolution was not amended. Advertisement Judge Justice Ira B. Harkavy ruled that Weinstein’s long-term tenants, real estate developer Shaya Boymelgreen, improperly assigned their lease to Forest City Ratner Companies (FCRC) for the properties at 752-766 Pacific Street and 535 Carlton Avenue. The decision permits Weinstein to regain full control of his properties. In court filings, Weinstein said that FCRC never made him a firm offer for his properties, and that FCRC implied that if he did not sell, the Empire State Development Corporation would take the property through eminent domain. Weinstein is also one of the plaintiffs in a lawsuit to stop the use of eminent domain to proceed with the $4 billion project. “I’ve always believed in the rule of law,” Weinstein said following the decision. “I’m pleased that the truth prevailed today, and I am confident that my co-plaintiffs and I will win our challenge to Ratner’s unconstitutional use of the power of eminent domain,” he added. Boymelgreen could not be reached for comment at press time. FCRC attorney Jeffrey Braun said the company cannot comment in detail on the decision because the suit did not directly involve the company he represents. “FCRC purchased the leases for the property in question from another developer. That developer of course believed he had the right to sell those leases under his contract with the landlord, as is often the case with leases such as these held for extended periods of time,” said Braun. “The developer has advised us that he will appeal the decision. Finally, we do not believe that this decision will have any impact of the project and are continuing with the preparatory work begun last week,” he added. Star Ledger Op Ed Fran Wood A welcome voice on eminent domain Sunday, February 18, 2007 If you ever doubted the wisdom of restoring the Public Advo cate's office, a long-overdue move finally implemented a year ago, you don't have to look beyond the single issue of eminent domain. Two years ago, in a case called Kelo vs. City of New London, the U.S. Supreme Court attempted to more precisely define "eminent do main" -- the government's power to buy a piece of property whether the owner wants to sell it or not. In the Kelo case, New London wanted to condemn some 115 properties, for which the owners would be compensated by a private company that would redevelop the whole area. But 15 homeowners -- led by Susette Kelo -- did not want to sell. The court was asked whether the owners could legally refuse. The dictionary defines eminent domain as "the right of a government to take, or to authorize the taking of, private property for pub lic use, just compensation being given to the owner." Now you might think "public use" suggests land would be taken only for, say, a highway or a park. You'd be wrong. The court ruled New London could condemn the properties for redevelopment -- suggesting that "public use" means a use that a municipality feels will benefit the public by sprucing up the city and yielding higher tax revenues. Whether this is a good enough reason to evict taxpaying homeowners is rarely a clear-cut call, and the 5-4 Supreme Court vote reflects that split. Kelo sparked considerable concern that "big brother" government now had carte blanche to move in and take any property that caught its eye. But one of the consenting opinions that formed the majority in Kelo expressly said this wasn't so, stressing that the ruling was not binding on lower courts and laying out a checklist that towns were advised to examine be fore exercising eminent domain. Nonetheless, the court already had opened the door to a looser interpretation of eminent domain in 1984 (Hawaiian Housing Authority vs. Midkiff), when it ruled a state can invoke eminent domain to take land for redistribution to a larger population. Kelo opened that door even wider. Thus, it isn't surprising that towns have increasingly been seiz ing property for economic development. And it's hard not to feel a little uneasy about it. When people lose homes for reservoirs, highways and the like, we're sympathetic. But in most cases there's a demonstrable greater good -- cleaner water, a more efficient transportation system and so on. It's often harder to endorse this seizure when the new project merely replaces a solid old home with an apartment building, or a viable, industrious mom-and- pop business with a multiple-use complex. That five-story, block-long building featuring retail on the ground level, offices on the second and apartments on the top three floors may generate more ratables than what it replaced, but is that sufficient reason to eliminate the little bodegas, restaurants and second-floor walkups that serve an im migrant community? Is it fair that the people who used to live there can't afford rents in the new building? Can any economic benefit from replacing a handful of shore bungalows with highrises justify covering ourbeaches with mega-constructions? Can a local housing authority cavalierly broaden the definition of "blight" to seize any property that's in the way or "not fully productive"? These are the kinds of points Public Advocate Ronald Chen has been addressing in several friend- of-the-court briefs he has recently filed with the state Supreme Court, which may soon be deciding several important eminent domain cases. Chen's office isn't objecting to eminent domain per se. But he wants, for instance, a sharper definition of "blight," which he notes now can be interpreted so broadly that almost any property in the state could be so designated. The framers of our Constitution, he argues, did not see eminent do main as an open door to "forced redevelopment," and it's hard to disagree with him. We invest ourselves, our family histories and the lives of our children in the places where we dwell -- whether that happens to be a multimillion-dollar Regency-style replica in Alpine, a 1950s split-level in Hillsborough or a simple little bungalow in Long Branch. Our homes are the repositories of our lives, our dreams, our stuff. Forcing a family out of its home simply be cause a corporate developer sells a town on some glittery new luxury project isn't fair or just. It isn't American. In eminent domain cases, the little guys need all the voices they can get. Rarely has the term Public Advocate been so literally true. Or welcome. February 8, 2007 Judge Poses Tough Questions to Atlantic Yards Backers BY JOSEPH GOLDSTEIN - Staff Reporter of the Sun February 8, 2007 URL: http://www.nysun.com/article/48258 A federal judge's line of questioning yesterday made it appear he was unconvinced when defenders of the Atlantic Yards project argued that the public benefits of the proposed development protect it from a lawsuit. During lengthy oral arguments, a magistrate judge in U.S. District Court in Brooklyn, Robert Levy, asked probing questions to lawyers on both sides about where he should draw the line between legal and illegal uses of eminent domain. The Atlantic Yards project, which calls for a basketball arena, nearly 7,000 units of housing, and office space, would cover 22 acres in Prospect Heights, Brooklyn, some of which is currently in private hands. The proposal is being challenged in a lawsuit by three homeowners, several renters, and a business owner. Their properties face condemnation and seizure under the plan. They are suing the project developer, Forest City Ratner, as well as Mayor Bloomberg and Governor Pataki, who support the project. The 10 named plaintiffs say any public benefits are incidental to the project's ultimate goal of enriching Forest City Ratner. The central issue during yesterday's hearing was whether Judge Levy would be overstepping his role if he began to weigh the public benefits that the project would deliver against the private benefits that would accrue to Forest City Ratner. The defendants are asking Judge Levy to immediately dismiss the lawsuit on the grounds that the public benefits of the development are obvious. A lawyer for Forest City Ratner, Jeffrey Braun, told Judge Levy that his role as a reviewer of the plan should be extremely limited. All the judge needed to do before recommending the dismissal of the lawsuit was to confirm that the proposed public uses were legitimate, Mr. Braun, said. "What I'm hearing is that so long as a defendant can articulate a public use," Judge Levy asked, eminent domain is "per se constitutional?" "Your honor, I would say yes," Mr. Braun said, adding that "the role of the court really disappears" beyond conducting that initial review. This answer did not seem to satisfy Judge Levy. Soon thereafter, he put forward a hypothetical: What if developers wanted to seize 22 acres of private property and build luxury housing on 21 acres of it and place a school on the remaining acre? Under Mr. Braun's argument, Judge Levy noted, "Any condemnation would pass the test so long as a school was put in, regardless of the detriments." "When can a court say," Judge Levy asked, "as a matter of law, we're not going to dismiss the case because an allegation of public use isn't sufficient in this particular project?" In response to another hypothetical posed by Judge Levy — this one positing corruption between a developer and the government — Mr. Braun backed down from his position. "This is where my dilemma is," Judge Levy said. "How do I know where to draw the line?" Indeed, by his questions, Judge Levy appeared eager to weigh the public benefits against the private motives at work in the Atlantic Yards proposal. But the judge also noted that such an accounting would not necessarily lead to any easy determination as to whether the use of eminent domain is constitutional. While defenders of the proposed plan were touting the public benefits, Judge Levy noted that the plaintiffs were more interested in pointing out the private gain that Forest City Ratner anticipated. "What if we have both?" Judge Levy asked. "Let's say there is an undeniable public use and let's say at the same time there is an undeniable private benefit." In that case, a lawyer for the plaintiffs, Matthew Brinckerhoff, said he would urge Judge Levy to decide what is the primary goal of the project. "The standard would be what was the motivating factor in taking somebody's property," Mr. Brinckerhoff said. If it is for private gain, then eminent domain "has to be stopped, it is unconstitutional." Judge Levy is expected to issue a recommendation on whether to dismiss the case to the presiding judge overseeing the case, Nicholas Garaufis. The victim suffered one gunshot wound to the buttocks, said Deputy Police Chief Mark Kinmon. The man was treated at Jersey Shore University Medical Center in Neptune and released. Just before noon today, police received a phone call about shots being fired in the 1200 block of Bond Street, Kinmon said. Officers responded, but the victim was gone. A short time later, police received a call from a hospital employee who said a gunshot wound victim was there. Kinmon said the Lakewood man was driven to the hospital, but it is still unclear who took him there. Asbury Park detectives and the Monmouth County Prosecutor's Office are investigating the shooting. Kean said the bill would ensure that citizens' homes cannot be seized simply because development at that location would bring in more tax revenue. And if the legislation, ACR-225, becomes law, a ballot question will go before the voters that ask if the Constitution should be amended to allow property to be taken when the municipality proves it negatively affects the community. “People should not have to live in fear of having their homes taken out from under them by governments that want to increase ratables,” he added.
