Is there something in the water that you and Tommie are drinking? :-)

I did not criticize, I did not take a position, I did not request any action.
Someone asked about staggered terms, All I did was report the background.

Now to answer your question. The Council can do many things that are against
the will of
the people, A residential development instead of a destination development of
the
beachfront for example. By law they could change the form of government if they
wanted
to.

With the demonstrated lack of interest by the majority of Asbury Parks
residents many
things are possible without repercussions.

Werner, I'm totally in the camp of staggered terms but given that
there was a vote and the people rejected it specifically what would
you have the council do? I disagree with the way people voted but
bottom line that's how people wanted it. I really don't think it's
fair to criticize them for this. It they did it since the vote
they'd be hammered for imposing their will against the will of the
people. That's a no win.

Tommie, Stop right there, don't start with your usual nonsense of attributing
things to people
that are just not there. Selective quoting and taking things out of context.
I've taken no

They ran on a platform that included change to staggered terms, they didn't do

So now you are requesting that the council do what the people don't
want them to do.

Perhaps, just maybe, you need to rethink you're position there.

Yeah, thats the ticket. We seperate the beachfront from the rest of
Asbury Park. Should be easy, its already designed to be a City wthin
the City. MM gets complete control like Disney World in Orlando. A

even have to pay increased sewer fees since the plant is on their

The ballot issue was the result of citizen action. The council itself
promised to make the change (which it can do) upon being elected to
office. That was the campaign prior to this most recent one. They never

thanks werner. yeah, i see all sorts of things in the file section. i havnt
been too up to date on checking that stuff out. its intersting to look back at
the groups first comments, back in 1999. i was 17. i see a few of the same
names, i think, but not many. probably becasue when the group first started,
it was greatly composed of people supporting the save tiliie cause. and once
that was over, the rest of the waterfront probably wasnt of interest to them.
or not as much.

[AsburyPark] Madison Marquette Mexican Standoff - Let Citizens Know What They Want

2007-02-09 Thread dfsavgny
The deal(s) are not signed. Not with the City and not with Partners.
Know what's holding it up? MM wants the City to guarantee to
schedules in which it will review plans/permits and respond back to
MM if there are problems. MM doesn;t want it chain jerked. Time is
money. MM has drawn a line in the sand. They refuse to do a
presentation or lend their name to anything until they have signed
deals. Based upon Bruno's statements to me, it appears that the City
has also drawn a line in the sand. He told me he told MM to sign
their deal with Fishman and then the City will review what MM wants.

Are we going to let these elected officials possibly blow this up?
Why is this all being talked in secret? Why not let citizens know
exactly what MM is asking for and get our input if it is fair or not.

There is NO DEAL as of yet. If there is Fishman won't see a dime
until MM gets its money (and a return) out.

Partners will certainly violate DRA. Immediately move to arbitration
when violation is official and move to keep the moneys in escrow and
make a new deal with MM.

You're right, it's June 2007. Here's the link to the DRA in the files
section if you don;t know how to get to it on your own. This is for the
Casino (Arcade section), Schedule C. Schedule A is for the 5th Ave
Pavillion.

But that is the only way MM wants it I suspect. Recall my post from a
couple of weeks ago where I aksed if Partners got enough religion now
to accept what MM offers? That is what has held up the deal and the
obligations under the DRA.

I never accused the city of genius. Yes, but that was when? You
should be able to do it between Labor and Memorial Day.

The Dispute Resolution Agreement is dated April 10, 2006. That is
when it was final, but even taking that date, you should be ready to
go with construction on the day after Labor Day. WHen I said no
stores during the summer, I meant this summer in order to be able to
meet the october 2007 deadline, which I think is very difficult to
do. Stop picking apart things. What is at issue is that Partners did
not, and obviously cannot, live up to the DRA with regard to the 5th
Ave pavillion, and I suspect most of the other elements as well.
Isn;t the Casino to have a new roof by October 2007 as well?

Scott G. Bullock, a senior institute attorney, said in a prepared
release that the brief explains "why Long Branch's outrageous land
grab" is unconstitutional.

The institute also maintains that city attorneys with financial
conflicts of interest tainted the redevelopment process, an allegation
earlier denied by City Attorney James G. Aaron, who could not be
reached for comment Thursday.

"The evidence shows that Long Branch cut corners, ignored the law and
flouted the Constitution," said Jeff Rowes, an institute attorney, in
the release. "It is time for the appellate court to hold the city
accountable."

I have been out of touch so I don;t know if they have signed yet or
not. I would expect a big announcement as well. After the last
council meeting bruno told me that mm told him they wouldn't sign
with Partners until the city agreed to some changes in the plan (that
was new to me). The changes included allowing a higher height limit
for a proposed hotel (I assume by the Casino). Bruno intimated that
MM said 8 stories won't cut it.

Assuming this is true, all I can say is that if the city took as
tough a stance with Partners over the past 4-5 years as it appears it
is with mm, maybe we would be a little farther along or not in this
mess at all.

MM could only do it if the plans, funding are all in place and agreed
to right now and the place is closed for the summer. Then maybe, and
that is a big maybe, that the first floor could get done by October,
but I doubt it. Done as was the original intent.

They see some inherent value here or they still would not be
interested. However, the numbers they were initially given for
restoration (from Fishman) are in orbit. In any event, it is not a
sure thing to make a decent return with just the retail. That is why
it was the quid pro quo for being able to sell off or develop the
residential land.

The redevelopment subcommittee - Bruno and Johnson. I don't necessarily
dismiss phased construction. Nor do I think that a year for each is too
quick. Quite frankly, I think the whole thing could be done in one year
if you wanted to. It is a very small building. The problem is you
can't, probably no one, in 8 months, a couple of which might preclude
the puring of concrete.

Do you see the design that wowed over the council as a whole a while

If it's not signed, it's not done. No obligations. Walk away. Really
unprofessional of them to say it's done when in fact it's not.

No back pedaling. I want MM to come in and succeed. I just want the

Yes, I see your point and I agree.

My original point was about the discussion over the 5th ave pavillion
and doing one floor per year. Recognizing that MM is in this for the
profit not the altruism I am hoping that they will see the economic
value to fixing up the pavillion immediately instead of on some
ridiculous 2-step timetable.

That is all I meant

The purpose of redevelopment is to repair a damaged community. To
better the opportunities and quality of life for the taxpayers and
residents. To "make the City whole again". That is the goal.

Profit to the developers is secondary to the public purpose for which
redevelopment was created. Certainly profit is needed to make things
move forward. A good plan would address both public and private needs,
however the prime beneficiary is supposed to be the community.

I say full control because I believe that is part of what is holding
things up...didn't someone on this board who claimed to be in the know
say that the holdup was because MM did not want to share the retail with
AP? That they are the experts and therefore wanted to control the
retail if they are going to make the investments which I have heard is
up to $150M. Of course the goal is for them to start making
money...what else would it be?

What makes you think they will have "full control" ? The press release of last

a partnership with Asbury Partners. Did it not? I'll try to find it. Also the

I think we all could agree on that. It would be better to do the building all

No, I suggested that they would just slap on paint. Don't get defensive now.

The entire idea of a 2 phase (1st floor,2nd floor) restoration is just asking
for problems.
The building is an integrated unit. Do you realize that the sloped concrete
bandshell
seating area (the roof) is also the interior ceiling of the 1st floor
storefronts.

It would be much more prudent to Rehabilitate the entire building in one shot.

Yes, sure they can get the 1st floor working by the summer, they have had
storefronts
there for several seasons already. That does not equate to restoring the
building.

My conclusion is that the extended and phased restoration agreement is just to
buy them
time since a comprehensive restoration will impact the entire building and
render the 1st
floor unusable.

Sure storefronts this summer, just as in the past, perhaps a new operator for
the former
HoJo space. But no significant capital investment to actually restore the
building. That's my
prediction, I hope I'm wrong.

Doors, The entire

I suspect they will slap on yet another coat of paint, repair some utilities as

You're right, there are people who will blast it regardless of what
it actually is, and others who will support it regardless. But
there are also a great many people like myself who are open-minded
and will judge on the merits. But I increasingly find myself moving
to the skeptical side as I feel others probably are too. Over the
past several years I've just heard so many concrete promises only to
find the actual facts, agreements and actions are really set in
jello. There's only so many missed commitments and over promises
that a reasonable person can take and not become skeptical of
everything they hear. It's a shame.

Allan,

Structural repairs, Resoration of the exterior, Paint removal etc, Windows,
Doors, The entire

I suspect they will slap on yet another coat of paint, repair some utilities as
you suggest and
declare they have met the intent of the agreement.

You can send a donation to Officer April Bird, APPD, 1 Municipal
Plaza, Asbury Park, New Jerey 07712.

If you are going to do that, I hope you will take the tickets and
give them away. I'd like to see a nice head count at the Wnder bar.

Thanks so much for your help.

They still have time. First floor renovation probably 2 or 3 months? We are
not talking about knocking down the structure. New electric, plumbing etc.
They could easily get that done before the summer. The 2nd floor would require
more time due to plans needed to change the structure.

Point taken, but who knows? The article is about 5th Ave pavillion but
you'r right, that comes right after discussing the Casino. But even if
its about the Casino, then when do they do the improvements to 5th Ave
which are to be done (1st floor) by October?

I fear that this MM deal is going the same route as the A-Partners deal.

Negotiations, deal making, contracts - all behind closed doors, out of Public
view.
Then the big announcemrnt "We ave a Deal". This is what we're doing,

If we are lucky the Public will be asked - "What do you think". (not likely)

Perhaps the Public will be allowed comment, critiques and recommendations for
improvements.

All of which will be declared as "anti-redevelopment", "obstructionist",
"holding the city
back", etc.

Finally - Thank you for your comments but we have a contract and if we try to
change the
"Deal" there may be litigation so we have to stay the course.

Another cart-before-the-horse, Dealing before Planning?

[AsburyPark] " Black Folks"to Get Jobs.

2007-02-09 Thread Fred
INTENT: 20% of work force from Asbury

CONCERN: How much will be affordable housing?
Residents seek jobs in Springwood project
Posted by the Asbury Park Press on 02/9/07
BY NANCY SHIELDS
COASTAL MONMOUTH BUREAU

ASBURY PARK — Job opportunities for city residents are a top concern
of people telling city officials what they think of plans to
redevelop the faded Springwood Avenue corridor into new homes,
businesses, parks and entertainment.

The Springwood Avenue Advisory Committee held two sessions for the
public on Tuesday and will hold a third at 10 a.m. Saturday at the
Asbury Park Transportation Center. A fourth meeting for the public is
scheduled for 6:30 p.m. Thursday at Sisters Academy, Springwood and
Ridgewood avenues. The plan was first unveiled at the end of November.

On Tuesday night, a small turnout of residents mixed with city
officials and committee members to discuss the plan at the Asbury
Park Village meeting room. A separate meeting for the public had been
held earlier that day at Brookdale Community College's Higher
Education Center downtown.

"What we want this plan to do is to offer the community hope, and
that the community can be a part of it," said City Councilman Jim
Keady, a co-chairman with Councilman Ed Johnson of the Springwood
Avenue committee.

The city intends for the rebuilding of Springwood to see, at the
least, a requirement that 20 percent of the workers and 20 percent of
materials be from Asbury Park. That was not a requirement for the
work on the waterfront, but rather the waterfront developers had to
make a "best effort" attempt to meet the 20 percent benchmark for
local labor and materials.

"My dream scenario is to have job training here on the west side as
part of it," Johnson said.

A second concern is how much of the new housing on Springwood will be
affordable housing. The city has said at a minimum it will be 20
percent, but it likely will be more.

According to language in the plan, the committee's goal is
to "advance a sustainable community model, which will include job
opportunities, housing, entertainment, recreation, transportation,
business development and a partnership with a developer who shares
the committee's vision for job opportunities and skills education."

The Rev. John Bradley, a Neptune minister who is president of the
Neptune-Asbury Park Ministerial Alliance, brought up several concerns
at the Tuesday night session. They included jobs for residents and
former offenders, and whether jobs should be restricted to residents
only from the west side.

City officials said limiting those who could get jobs to only the
immediate Springwood Avenue area was unlikely to work.

City officials said the city's work force and employment program,
Asbury Works, is working hard on those issues.

"We're talking about putting black folks to work," Keady said at one
point.

Someone from the audience said: "No, not black, poor."

City Manager Terence Reidy said that unlike the city's waterfront
plan, the Springwood plan encourages small groups and investors,
which means participation of Asbury residents can be higher.

Hazel Samuels, the city's director of community development, said
work force training is in place with the city's Asbury Works
employment program but that there is a need to make sure residents
can meet requirements to have a driver's license and pass a urine
test for drugs.

"You can't show up today and not show up tomorrow," Samuels added.

Samuels and Keady pushed to get the city's churches more involved to
help bring life back to Springwood.

Keady said he would suggest that Bradley go on the board of the
city's Asbury Works program. He also asked that the ministers find
volunteers in their churches to help the West Side Community Center,
which is just off Springwood Avenue but not part of the avenue's
redevelopment plan. The center needs funding.

When the public sessions end next week, the committee will review
comments and work to deliver the plan to the council for approval
before it goes to the city Planning Board for review.

[AsburyPark] 5th Ave Pavilion Timeline

2007-02-09 Thread wernerapnj
For anyone who is interested:

- Specifically identified in the redevelopment plan as a significant historic
asset worth
preserving and restoring. Immediate structural evaluation recommended.

- Building is "whitewashed" along with all the other pavilions. I make some
calls, both a
TRC member and Councilwoman are extremely upset with this.

- The whitewashing is finished and cartoon murals of fake storefronts are
painted on the
building along with fake shoppers.

- Parts of the exterior ramps and walkways begin to fall off. The recommened
structural
evaluation was never done to the best of my knowledge.

- All the remaining exterior walkways are demolished.

- A plan is presented to demolish the southern portion (bandshell) of the
building to
construct retail and office space. The plan does not allow office space.

- Argument is made that the "Howard Johnsons" is being saved and that satisfies
the Plan.
(word was that Asbury Partners wanted to move their offices to the 'new' office
space and
demolish the 4th Ave Pavilion)

- I circulate a letter with details from the plan confirming: - The entire
building is to be
restored, Office space is not a permitted use. The bandshell is to be retained.
(see the files
section)

- The Preservation Committee is formed around this issue. I point out the
requirements of
the Plan. legal representation is retained and letters are sent to the Council.

- A "Save The Bandshell" postcard campaign is initiated by the Preservation
Committee.
Hundreds of cards are received by the City Manager.

- The Council holds off endorsing the office space idea and rejects forwarding
it to the
Planning Board. Guess they finally realized it violated the Plan.

- The building is repainted in "Asbury Partners Colors" with the addition of
Purple on the
boarded up windows.

- The dispute resolution agreement is entered into: - Paint to be removed from
brickwork,
a restoration plan is to be formulated and the entire building preserved and
rehabilitated.

- Howard Johnsons is gutted with the original 1960s furnishings and fixtures
disposed of.
(I need to confirm this - will have a look over there tomorrow)

- Bids were to have been awarded by October 06. Entire first floor to be done
by June 07.

The Plan recommended restoration and preservation of this significant historic
asset of
Asbury Park 5 years ago.
