as a new boardwalk pavillion destinantion??  Oh, wait, I forgot -  AP can't 
maintain the historic structures they have - it would  probably rot into the 
ocean...

LONG BRANCH — Community  leaders, a historian, politicians and 
Monmouth County officials who  
focus on property acquisition, came to the Takanassee Beach Club 
today  to spread the word about the need to preserve the historically 
relevant  site.

But, as it turns out, neither the officials nor the media, had  any 
right to be on the Ocean Avenue property which is the focus of a  
family dispute.

Harry V. Osborne II, a lawyer who represents Ginger  Peters, a one-
third owner of the property, and Jerold L. Zaro, who  represents the 
contract-purchaser, Takanassee Developers LLC, said the  developer has 
a lease for the property and only he can give permission to  enter the 
site.

It is very disturbing and disturbing to hear of  this tour, 
especially by two lawmakers,'' said Zaro. ...They are law  makers,'' 
he said of Kean and Unger. They shouldn't be law  breakers.''

The beach club has been owned by the Peters family for  generations. 
Sister Ginger Peters and her brother Christopher wanted to  sell the 
valuable oceanfront land, while brother J. Scott Peters did not,  
although he ultimately signed the sale contract, saying he felt 
forced  to by Superior Court Judge Alexander D. Lehrer.

Since news of the  pending sale was disclosed and Takanassee 
Developers, whose principal is  Isaac Chera, revealed plans to build 
21 homes there, Kean and Unger have  been championing plans to 
preserve the 4.9-acre site which contains three  buildings that were 
once used by the U.S. Lifesaving Service, a precursor  to the U.S 
Coast Guard.

It is one of the few remaining sites in the  country with this 
heritage said New Jersey 
Historian Frank Esposito,  who attended the tour.

Kean initially said he would introduce  legislation to fund the $14 
million purchase, 
although the legislator  said today he did not feel it necessary to go 
through with the  legislation, given the fact that administrators of 
the state's Coastal  Area Facility Review Act are taking a dim view of 
Chera's  proposal.

Unger said he believes the city could operate the club as a  municipal 
beach club, as such operations are conducted in nearby  
municipalities. He said a formal study has not been made.

Some  things in a society are more important than economics,'' Unger 
said.  Sometimes we put economic considerations first and we act as 
if they  trump all other considerations'if they  trump a
case, there would  be no Central Park, there would be no Island Beach 
State Park...Takanassee  trumps all economic considerations.St

Both Unger and Kean believe  that if Chera fails to get his CAFRA 
permit, he could walk away from the  land, and the state, in 
partnership with the county and the municipality,  could pick up the 
oceanfront parcel for between five and $10 million. The  state Green 
Acres fund would provide 75 percent of that.

But Zaro  said that is not realistic. (Osborne said the $14 million 
price being  bandied about is incorrect. Chera is offering the Peters 
$16 million for  the property.)

I think these two gentlemen are latecomers to the  situation,'' said 
Osborne, of Unger, who was elected to City Council in  November, and 
Kean, who is seeking election to the state Senate. ...I  just don't 
know where they are going to come up with the money. As far as  I 
know, the mayor has no intention to condemn the property or put  
anything up in order for the city to pay for it.''

Osborne said  Chera's surrender of the land is pure wishful 
thinking'' on the part of  
Unger and Kean.

It certainly sounds nice for the politicians to  say we'll buy it' 
or we'll get funding 
for it.' That's just not  realistic,'' said Zaro, citing the state's 
ongoing budget crisis. I  
don't think buying a beach club for $16 million is going to rank up  
there with all the other needs we have. The city could condemn it  
under eminent domain (but) I can't imagine the citizens of Long  
Branch, who have just seen their tax assessments triple, would be in  
any kind of a mood to raise taxes again to buy a beach  club.''

Leila Poch, president of the Elberon Voters and Property Owners  
Association was present for the tour. She said citizens support the  
preservation.

We have the chance to put the stop sign up,'' she  said of razing 
historic properties in the city.

I think the next campaign in this town should be to get new code 
enforcers and move the current officers to other 
positions/departments.  The current officials have done enforcement so 
pell mell over the years that if they ever tried to get tough now they 
would be called on areas that they were soft in the past.  Clean 
house/new slate!

Here is some of the testimony from Tuesday night:

The former chief of police of Morristown who now lives down here 
applauded the shelter.  Similiar to the testimony of the current 
chief of police in Morristown who gave testimony a couple weeks ago.  
They have many more problems coming out of the bars and gangs in 
Morristown than they do at the Mission.

There were also a couple former homeless AP men who spoke.  One who 
went to Morristown for help because he couldn't get the help he 
needed here in AP.   Both men have their lives together now thanks to 
shelters.

Father Bill of Holy Spirit spoke about coming together to help solve 
the problem of homelessness and making these men part of our 
community. 

Several residents talked about their reasons for moving to AP and 
they want to keep the town a mixed population:  black/white, 
rich/poor, gay/straight, renter/home-owner.Since AP isn't 
creating more affordable housing, we are just continuing to force 
more people into homelessness. 

SUFA said that they are not against the homeless shelter just against 
some of the policies.  So we'll just work on changing some of the 
policies. However, unless we turn AP into federal property, the 
Mission is not allowed to perform background checks.  And say they 
could?  What should we do with a AP man who may be an ex-con who is 
living under the boardwalk?

And everyone has a right to defend their property and their rights, 
right?

For example, I have a rentla property Ocean Township. Unfortuantely 
for me, when I purchased this house 22 years ago as an investment, 
the onwer's son was a POS. The POS was arrested a few years after I 
bought the house for apparently molesting his daughter. So a few 
years ago, the POS gets out of jail, moves next door to another 
neightbor who took him in. And, the way the law is, no one is 
notified by the probation department, prosecutor etc. Luckily, I saw 
the POS walking around and made sure we all knew. After calling the 
probation department etc - the POS has more rights to privacy then do 
the rights of the surrounding neighbors and KIDS.

While his picture is on the 'net, you have to check for yourself.

Lucky for us, we have someone from Dan's old neighborhood who made it 
a point to show the POS a couple of things. 1)The toy in his belt 2)
The property lines.

Then, when you go to either SELL your house or RENT it - the landlord 
is NOT allowed to disclose that you have a POS living next door (that 
is, you're not supposed to, by law), but you can advise them 
to check out the internet for possible sex-offenders. So you may 
lose a tenant or 5, get around $400/month less (everyone has a 
price), or your home may be worth LESS.


Think back - that is what happened to AP. Now you have to have some 
controls over the building, number of people to serve etc etc.

The state pays good rent for approved adult daycare centers. You'll 
see more and more facilities located in former warehouses. Actually, 
there aren't enough locations for the demand.

This is another trend that has gotten out of control - lights in the 
sidewalk that blind you.

its not enough they blind you from above?

Ignorant designers never considering the PEOPLE will one day be on the

The City does nothing to stop it and at the Grand the light were 
planted on public property. I will check into the others.

[AsburyPark] Freeholders Meeting in Asbury Tonight

Pardon the interruption - 

I just wanted to make sure everyone knows that The Monmouth County 
Board of Chosen Freeholders occasionally takes their meetings on the 
road to make it easier for people around the County to attend.

Tonight they are meeting in Asbury Park at the Municipal Building (I'm 
assuming council chambers) at 7:00 pm.

It is very important for AP to make a strong showing in attendence.

The Freeholder's budget each year is close to a half Billion dollars 
(your tax dollars), and they spend millions back on the municipalities.

We have to let them know what we need to get them interested in 
spending on us.  Squeaky wheels and such.

Hope to see you there, and let's make them feel welcomed.  If they 
feel they've had good experience, they'll be more likely to take an 
interest in us.

Yes, I agree with that conclusion. (except for it being great)

What about walking on the sidewalk? What about being blinded as a 
pedestrian?

consideration for the general public.

Here's a note I sent to the City, lets see what the response is.

To: Reidy, Sammet, Grant

It has come to my attention that new lighting is being
installed in the pavement in front of ConHall as part
of the plaza construction.

It appears to consist of flood lights located at grade
directed upwards against the colonnade along Ocean
Ave.

This is completely inappropriate for a number of
reasons:

- The fixtures appear to be installed on Public
Property (ROW)
- The lights point up from ground level blinding
pedestrians
- They violate the National Register preservation
guidelines 

I note that the colonnade has original ceiling fixture
wiring where industrial lighting has been installed.
It was my understanding that those fixtures would be
temporary and that the original or at least
architecturally compatible fixtures would be restored.

That would be the proper course of action, repair and
restoration of the buildings original lighting
systems.

Why is additional modern lighting that is a hazard to
pedestrians and contrary to the landmarks design being
permitted?

I recommend that this be addressed ASAP since the area
is being finished with masonry shortly.

I also noticed it appears the wiring is being routed
through the abandoned steam pipe tunnel which was
flagged as an asbestos hazard. Those wall penetrations
could provide water entry points to the below grade
area of the building.

I have walked down the sidewalk with out an issue.  I assume if you walk right 
over the lights, you may experience discomfort.  That would leave you with the 
option of then walking on the other side of the sidewalk or street.  If the 
lights were located on the top I don't think the appearance would be as great.  
You would miss the entire top of the building.  I fail to see a real issue 
hear.

As for Mattison, I believe the lights fall under the eve of the building,  If 
so, then it is not on public property.  People have the option to walk away 
from the lights.  And if it is not on public property, the owner can do as he 
pleases.

I'll be honest...I walk my dog to Market on the Middle sometimes, and i've 
noticed the 
lights on the sidewalk, but they don't bother me. If anything, they make 
looking up at the 
building and it's classic architecture easier, because there's no blaring 
lights shining down 
on me. They really don't bother me, but I do understand where Werner is coming 
from.

Do you have some sort of sensitivity to light? I think the lights at 
Mattison Park are great. I'd line Cookman with them. If we want to be 
so historically correct we'd ban cars and still have horseshit in the

I think the lighting at Mattison is great.  It makes that beautiful building 
stand out at night.  If you drive donw the street, you can see the details.  
   
  I agree. It looks nice.  The point werner was trying to make is, in some 
cases, the lights are blinding if people need to walk around them.  I never 
had, or know anyone who's compalined about the lights at Mattisoin though.  I 
don't really think the Convention hall lights will be a problem either.  They 
are close enough to the building that people wont be walking on top of htem or 
around them.  I think bradley beach has some sort of ground lights around the 
Gazebo, but not sure.

Thanks for posting the Faiella articles from the Ledger.
I put something up on AsburyRadio.com this morning, but I'm still learning how 
to manage that website.
Not to blow my horn or anything, but I tried to read the council information 
about Faiella before they ever voted the redevelopment agreement into law, 
which, thanks to Shangazi, I still have on tape. James Aaron, our attorney for 
redevelopment, was quick to respond to me that my comments about Faiella were 
irrelevant to the item under discussion - The Waterfront Redevelopment 
Agreement with Faiella's clients, Asbury Partners.
So the council did have a chance to put the breaks on, between Weldon's 
admission (he was gone before that night) and the Star-Ledger stories I held in 
my hand, referring to his being let go by Sharpe James from his job as deputy 
mayor, and thrown off his Newark Economic Development Corp by his own board of 
directors. I believe I summarized it all as not passing the smell test in 
Newark, or words to that effect.
Maybe I should've been more forceful, dug my heels in and read the whole thing. 
There's something about that gavel pounding that can be very intimidating.

People have the option to walk away from the lights.
   
  Someone may say, why do we have to have an option?  Can't we talk whereever 
we want?  yes, you can.  But clearly you see there are lights there, so if the 
lights bother you, walk a few steps away from them.  The lights have been there 
for weeks, and no one that i know of have complained about them.

No it's not my friend. While I may agree with you in principle, it 
becomes an issue that valid and perhaps more important criticisms are 
not heard by the masses because everything is a criticism. Having 
children is a wonderful teaching experience. You have to learn to pick 
your battles. And training a dogg too. You can't say no all the time.

Clearly you do not beleive in the distinction between private property 
and public property, or that shining lights out of the sidewalk at 
people is something that should not be done.
   
   Your point about lights being on public property is all right.  But now 
your talking about lights shining up at people?  Assuming were talking about 
the lights at Mattison Bar here.  They are right next to the building, and look 
straight up.  Unless your scalling the building, i'm not sure youd come in 
direct contact with them.  Does anyone stare at house lights?  To the point 
where your eyes hurt?  I do understand the lights are in the sidewalk, and 
people walk on it.  This of course goes along with your point, that people have 
to walk there.  However, the lights take up 1 foot just outside the wall of the 
building.  The sidewalk has another 10 feet of walking space on it, with no 
direct views of the lights.  Don't stare at them!  :-)

You say Werner's point is the lights are blinding if people have to walk around 
them, but that is not the case.  So again what is the point?  

I think some are just sour.  No matter what they will complain.  Enough 
already.  I think using Mattison as an example is really low.  From what I 
recall ( I will have to look again) I don't think the lights are in the public 
space.  Not to mention that the restoration work done to this building was 
first rate. The owners spent a good deal of money (and now asking for a good 
amount) to bring back the beauty of this building.  They could have taken a 
cheaper way out but didn't.  Dirve past that building at night and it makes a 
statement.  The kind of statement we need more buildings and homes to make

I don't know if that poll question is worded right!  Obviously in some cases 
the lights are fine, and others they are bad.  it's not a simple yes or no 
question.  I voted yes, becasuee i like the way it looks, and the lights don't 
bother my eyes. NO, i would not like to see this type of light everywhere

Flag Pole lighting is very specific and when properly designed has 
no 'light spillage' or adverse effects on the public. It lights the 
flag and nothing more.

based on the ground.  If you were to walk by it, you could easily stare into it

It appears this lighting issue has taken off, and will soon lead to posiable 
insanity.  I didn't know the post would inspire so much, but its good that it 
did. I originaly joined this group back in 99' because i liked the citys 
buildings and past history.  
   the up lights on convention hall will look nice in my mind.  We all need 
to agree that Werners points are correct.  With the new up lights washing the 
front lower half of the building, the under mounted arch lights on the inside 
will be pointless.  Maybe not pointless, becasue clearly they will shed light.  
There visual inpact will be greatly less.  When the front of the building is 
dark, the arches light up from the inside.  If the front is lit up, the inside 
arch lights wont show up as well.  We will see what happens.  Concrete started 
pouring for the sidewalks opposite the convention hall.

   I think they care, just not in the same way you do.  It's no wonder your 
tired.  I don't think you will ever win your battle againts certain people.  No 
one is right or wrong really.  It's two different ways of thinking.
   Some people want everything to be exact, dead on, the way it's sopose to 
be.  Lights mouldings all the correct time period.  Others see it as making the 
buildings look their best.  If it means making small changes or modifications 
to make something look better, then do it.
   Of course with the second way of thinking, thats not going along with 
the codes and restrictions that some of these buildings have.  I think those 
rules are over looked sometimes.

Tired of..

- studying the history of this City for 25 years
- puting my own life on hold for this City
- volunteering for committees
- creating the historical society
- attending every conceivable meeting
- taking preservation seminars
- attending out of state conferences
- reading City plans and documents
- trying to save historic sites
- watching the essence of Asbury Park disappear
- receiving no thanks or respect
- being shunned in my own community

All for no benefit to myself.

A while back the Veterans donated Cherry Trees for Sunset Lake  they wasn't 
maintain by the the City.That could  happen with these.Like the tree at growing 
around our library flag pole.They will probaly die like the ones the Veterans

 thought out better.
 
 Yes, plant trees, yes beautify the City, BUT do not destroy what 
 little character and interest exists in the streetscape during the 
 process.

A while back the Veterans donated Cherry Trees for Sunset Lake  they wasn't 
maintain by the the City.That could  happen with these.Like the tree at growing 
around our library flag pole.They will probaly die like the ones the Veterans 
donated years ago.

[AsburyPark] Thursday Evening's BOE meeting

Dear Group Members,
   Thursday night the Board of Education had its annual
Organization Meeting, which takes care of typical administrative
chores mandated by law such as re-establishing board policies,
appointing bank depositories, etc.  Prior to that, the new board
members (Barbara Lesinski and Tom Pivinski) and returning board
members (Garrett Giberson, Mrs Sanders and myself) took our oath of
office and were seated.  The Board voted to table the immediate
re-hiring of the present law firm to give the board members time to
consider their proposed contract and perhaps other offers by different
law firms.  Robert DiSanto and John Figueiredo were voted President
and VP respectively.  There will be a special BOE meeting to take care
of pressing business on Thursday, May 3rd at 8 PM.  The reason for the
rather late start is that the meeting will be preceded by the QSAC
community forum from 6 to 8 PM.  The meetings will take place at the
Bradley Elementary school on 3rd Ave.  I'm not sure what the acronym
QSAC stands for—something like Quality Standards Assurance
Committee, but it is a new State mandate for all school districts
where a team of folks from the State come in and interview all the
Board members, administrators, representatives from the staff, and
then they walk through the schools and observe what is going on.  They
then have a public forum to elicit input from the community.  There is
a report that they write, which should be very interesting!  Everyone
is invited, of course.   The Board also voted to have their regular
monthly board meeting on the 4th   (not necessarily the last)
