Last I heard the redeveloper was trying to put them into the old A&P (or 
whatever it was); wasn't a done deal but the Gale group are real developers, 
Belmar is a solid location and the town knows it needs to act.

This is an actual letter sent to a man named Ryan DeVries by the
Pennsylvania Department of Environmental Quality, State of
Pennsylvania. This guy's response is hilarious, but read the State's
letter before you get to the response letter. 


SUBJECT: DEQ File No.97-59-0023; T11N; R10W, Sec. 20; Lycoming County 

Dear Mr. DeVries: 

It has come to the attention of the Department of Environmental
Quality that there has been recent unauthorized activity on the above
referenced parcel of property. You have been certified as the legal
landowner 
and/or contractor who did the following unauthorized activity: 

Construction and maintenance of two wood debris dams 
across the outlet stream of Spring Pond. 

A permit must be issued prior to the start of this type of activity. 

A review of the Department's files shows that no permits have been
issued. Therefore, the Department has determined that this activity is
in violation of Part 301, Inland Lakes and Streams, of the Natural
Resource and Environmental Protection Act, Act 451 of the Public Acts
of 1994, being sections 324.30101 to 324.30113 of the Pennsylvania
Compiled Laws, annotated. 

The Department has been informed that one or both of the dams
partially failed during a recent rain event, causing debris and
flooding at downstream locations. We find that dams of this nature are
inherently hazardous and cannot be permitted. The Department therefore
orders you to cease and desist all activities at this location, and to
restore the stream to a free-flow condition by removing all wood and
brush forming the dams from the stream  channel. All restoration work
shall be completed no later than January 31, 2006. 

Please notify this office when the restoration has been completed so
that a follow-up site inspection may be scheduled by our staff. 

Failure to comply with this request or any further unauthorized
activity on the site may result in this case being referred for
elevated enforcement action. 

We anticipate and would appreciate your full cooperation in this
matter. Please feel free to contact me at this office if you have any
questions.

Dear Mr. Price, 

Your certified letter dated 12/17/02 has been handed to me to respond
to. I am the legal landowner but not the Contractor at 2088 Dagget
Lane, Trout Run, Pennsylvania. 

A couple of beavers are in the (State unauthorized) process of
constructing and maintaining two wood "debris" dams across the outlet
stream of my Spring Pond. While I did not pay for, authorize, nor
supervise their dam project, I think they would be highly offended
that you call their skillful use of natures building materials
"debris." I would like to challenge your department to attempt to
emulate their dam project any time and/or any place you choose. I
believe I can safely state there is no way you could ever match their
dam skills, their dam resourcefulness, their dam ingenuity, their dam 
persistence, their dam determination and/or their dam work ethic. 

As to your request, I do not think the beavers are aware that they
must first fill out a dam permit prior to the start of this type of
dam activity. 

My first dam question to you is: 
(1) Are you trying to discriminate against my Spring Pond Beavers, or 
(2) do you require all beavers throughout this State to conform to
said dam request? 

If you are not discriminating against these particular beavers,
through the Freedom of Information Act, I request completed copies of
all those other applicable beaver dam permits that have been issued.
Perhaps we will see if there really is a dam violation of Part 301,
Inland Lakes and Streams, of the Natural Resource and Environmental
Protection Act, Act 451 of the Public Acts of 1994, being sections
324.30101 to 324.30113 of the Pennsylvania 
Compiled Laws, annotated. 

I have several concerns. My first concern is, aren't the beavers
entitled to legal representation? The Spring Pond Beavers are
financially destitute and are unable to pay for said representation --
so the State will have to provide them with a dam lawyer. The
Department's dam concern that either one or both of the dams failed
during a recent rain event, causing flooding, is proof that this is a
natural occurrence, which the Department is required to protect. In
other words, we should leave the Spring Pond Beavers alone rather than
harassing them and calling their dam names. 

If you want the stream "restored" to a dam free-flow condition please
contact the beavers -- but if you are going to arrest them, they
obviously did not pay any attention to your dam letter, they being
unable to read English. 

In my humble opinion, the Spring Pond Beavers have a right to build
their unauthorized dams as long as the sky is blue, the grass is green
and water flows downstream. They have

exterior shell should have been weather proofed a long time ago.  Wood
exposed to the wet conditions we have had will develop mold, fungus
and mildew problems."

It's just part of the master developer's aesthetic to age the project
by developing a bit of a patina on the exterior.  Even a hideous
design will look better with age.

[AsburyPark] Tommy DeSeno Is he better -- I think not.

1913 Art Deco theatre. I don't think we have anymore of those in town.
Have we not lost enough? Have we learned nothing? Tommy D, you're
better than that article."

On this board I think Dan to be one of our best contributors and I
give great weight to his opinions, statements and observations; but on
DeSeno he is wrong, excepting for Tom's love of The Fishman.  However,
that infatuation is primarily mercenary; Tom bought a unit in the
Grant last year, hence if Larry's greedy deal succeeds Tom's purchase
looks a comparative bargain.  

I've experienced Tom DeSeno (aka bluebishop82) in various modes during
the last 4 or 5 years; I believe Tom to possibly be bright but clearly
a hard working guy of little imagination, surprisingly narrowly
defined interests, aesthetics, socialization and any capacity for
empathetic understanding and growth.  His writings reflect this
analysis, to my surprise his behavior in court, he is a lawyer, is a
repetition of his prose.  

In both written and, even more so, oral argument, he is consistent
only in having failed to learn when to shut up.  Tom writes not to
stir thought or debate but to release demons, which still possess him;
as the last of the Neanderthals, my apologies to those people, he
provides proof that not all dinosaurs are dead.  Having appeared
against him once in court, I can attest that his oral argument is
equally thoughtless, illogical and pointless as are his writings.  

He's managed to convince himself that he's of the spirit or lineage of
"daughters of the American Revolution" despite being of Italian
immigrant stock; he's most comfortable with fellows of the extreme
right of the Republican Party, despite that party's recent disavowal
of the Hitler youth and other extreme trappings of the fascist period.  

Obviously high energy searching for an outlet; initially he thought it
law, has given us way too much of his short diversion as writer and
now haunts the Republican Party believing himself to be the 2nd coming
of Christ.  

Curiously, for a guy trapped in antiquity, he has no appreciation for
things old, is infatuated by the trappings of today's consumerism and
becomes quite aroused at the prospect of meeting his dream machine—the
biggest, baddest, most fuel guzzling of monster trucks.   

Is he better than his most recent regurgitation on" the paper that
[wishes it] cares"?  I think not.

Council signed the deal, has forgone enforcing terms favorable to the
city's "best interest" and has been re-elected on this basis; the only

You have fallen for the myth that Asbury Partners are developers;
they're real estate speculators and although I've no problem with
speculation, I do have a problem with those who counseled this council
into selling the rights to build 3000 waterfront condos, worth $375
million (Larry's price in 2004) plus $18,000/unit infra structure plus
7% of the final selling price, for $12 million (only half in cash) and
structured the deal as an option to buy or blight at 2001 prices for
30 years.  

Knowing the history of the advisers, the only question I have is why
this has not been challenged as a fraud against the citizens of
Asbury?  Reflection on this sorry bit of dealing unavoidably points to
how we prefer to conduct business in this state; we pay to play.

As a dual citizen of Canada and the US, I am perhaps overly sensitive to
the ease and frequency with which Americans belittle the `great
white north'.

Of particular note, and I suspect primary cause, the near daily bitching
about the Canada Goose (Branta Canadensis/ Bernache du Canada), which is
native to the Great Plains and due to its mimicry of the Snow
Bunting's (Plectrophenax nivalis) yen for travel combined with its
affinity for abusing the hospitality of its hosts; has become by both
residency and sheer numbers, the American Goose. The Canada (aka
American) Goose is unique in being non-migratory, in comparison to the
other subspecies; therefore so long as its adopted neighbors insist on
creating ideal habitat, lush freshly mown lawns accompanied by lakes and
ponds, and an absence of significant predation, they'll not leave.

I find this particularly ironic in light of recent fears expressed re
Mexican migration, which this government seems to think the building of
walls will rectify; to stop geese will require the addition of a roof.

There I was worried that some of my writing might go over the heads of
members of this group; thanks to the traderdubie I now know my work to

comes as news to me, for in my mind I simply point out
inconsistencies, sloppy reasoning and the writing which follows.  

Thanks now to the dubie one, I now know that I need not think before I

have been what can be loosely described a a "liberal." Are there ills
in a capitalistic society?  Sure. Is everything the fault of those in
the upper income brackets?  No. Your views are obsolete. While it is
difficult to get out of urban, minority poverty, it is possible and
there is plenty of help available. All the money in the world is not
going to get a person out who merely wants a handout. I have lived and
worked my entire life in racially-mixed, urban environments. I don't
have that white, suburban fear of minorities. I have ridden the
subways my entire life to work and for the most part, being white, I
was the minority. I know that the vast majority of "minorities" are
upstanding, working citizens. It is only a very small percentage of
minorities in poor urban areas that some in white America use as their
perspective for minorities as a whole."

Steve is an angry displaced person, unable to earn a living in his
former field of endeavor, he has recast himself as a born-again
protector of others that society in its perpetual process of
rediscovery, has similarly shortchanged.  

He carries a lot of baggage from the experience of being downgraded;
this presents as a strong bias, even hatred of those who've not
suffered his pain.  

Rather than attempt to deal, understand or engage him in his endless
list of societal ills; you would all do well to ignore the ranting of

Why is it that enforcement appears to be strictest not where danger
lurks but rather where "fish in the barrel" are known to congregate;
why is it that DWI checks rarely, if ever, catch police officers known
to become impaired at the same bars as other citizens; why it that
ticketing and the ballooning revenues generated appear to be issued
primarily for infractions that are easily metered or calibrated rather
than the more difficult tail-gating, sleeping in the passing lanes, or
reading, writing and applying makeup while behind the wheel?

To blunt opposition to its proposed Atlantic Yards project in
Brooklyn, Forest City Ratner promised to make half of the rental units
affordable for low- and moderate-income families.

To gain neighbors' support for its new cancer care center, Yale-New
Haven Hospital agreed to create an outreach program for children with
asthma.

And to smooth the way for its Gateway Center retail project, which
will replace the Bronx Terminal Market, the Related Companies pledged
to bar Wal-Mart as a tenant.

In New York and around the country, it has become standard practice
for developers of major projects to negotiate with neighborhood and
other groups to forge so-called community benefits agreements —
contracts that almost always contain wage and hiring goals and may
also include a grab bag of concessions, like a day care center, a new
park, free tickets to sports events and cash outlays to be
administered by the groups themselves.

In New York, in contrast with many other jurisdictions, the city
itself is not a party to these agreements. Theoretically, at least,
the pacts are not supposed to play a role in the city's zoning review
process.

Since 2001, when a comprehensive community benefits agreement was
struck for a hotel-and-entertainment project now being developed in
Los Angeles next to the Staples Center sports arena, the trend has
quickly spread to other cities, including Denver, Milwaukee, Chicago
and Washington. Advocates of C.B.A.'s, as they are known, see them as
an outgrowth of the Smart Growth movement — the idea that development
decisions should address a broad range of social and economic issues
like transportation, jobs and housing.

In New York, however, some critics are wondering if this trend is
threatening to distort the planning process. They say the danger is
that local groups will agree not to oppose the projects in exchange
for favors that may be unrelated to the project's impact on the
neighborhood.

Critics of the Atlantic Yards (whose developer is a partner to The New
York Times Company in its new headquarters building on Eighth Avenue)
and other agreements have questioned whether the groups signing the
document really speak for the community. "Groups pop up and you're not
sure who they represent," said Patricia A. Jones, the co-chairwoman of
the Manhattan Community Board 9 task force on Columbia University's
expansion in Manhattanville. Ms. Jones contends that development plans
ought to be reviewed by community boards, which are currently excluded
from the C.B.A. process, before the benefits are meted out. "They can
look at the bigger picture," she said.

Ross F. Moskowitz, a real estate partner at the law firm Stroock &
Stroock & Lavan, said developers would like the procedures to be
clearer and more predictable. "The danger of a C.B.A. is that it is
outside the process," he said. "There are no guidelines, no controls.
The transparency is not there. You just don't know what you're walking
into."

In California, leaders of the community benefits movement say New
York's agreements lack the protections that are standard elsewhere.
"In the C.B.A.'s we work on," said Julian Gross, the legal director of
the California Partnership for Working Families, an advocacy group
that has negotiated a number of agreements, "the city is closely
involved in the negotiations. There's no point in the community group
and the developer negotiating a lot of stuff that the city doesn't want."

Outside New York, benefit agreements are usually incorporated into the
developer's agreement with the city, adding another layer of enforcement.

The local redevelopment agency was "intimately involved" in the C.B.A.
that J. H. Snyder, a Los Angeles developer, negotiated for NoHo
Commons, a 1.5-million-square-foot mixed-use project centered on a
subway stop in North Hollywood, said Clifford Goldstein, a senior
partner. "It's a very open process," said Mr. Goldstein, who is
currently working on another C.B.A. for a project in South Los Angeles.

Carl Weisbrod, the president of Trinity Real Estate in New York, said
that the government should be involved in any agreement that pertained
to a subsidized project to ensure that "the services and the
organizations that are being given money to provide the services are
fully in keeping with government priorities."

There are signs that Mayor Michael R. Bloomberg's administration is
rethinking its position on community benefits agreements. A year ago,
it was the mayor himself who trumpeted the Atlantic Yards agreement
between Forest City Ratner and eight community groups.

But in April, the mayor reacted angrily to the suggestion that the
Mets would negotiate a C.B.A. for its new ballpark. "Every development

operating by 2010. As to free beaches, let Asbury Partners/Marquette
front the money to the city and the get it back from the retailers.

(city jobs). Plus we have seen how they maintain things, and if they
do, they'll start thinking they own the beach too. How about residents
and homeowners get on the beach free and everybody else pays?"

Larry's hands have been very busy milking every nickel in site; if he
now considers the historic buildings an asset; I suggest it's only for
the short term –next few years– after which he faces major
expenditures to restore that which he knows not what to do with. 
After which be on the lookout for a provident outbreak of fire, which
will maximize his assets.  

As to free beaches (and parking), Asbury needs the draw; keep it free
till demand threatens availability then revisit price.

facilities. It is one thing to take care of your own town's problem,
and even pick up some of the outside area's problems, but it is
another to become a dumping ground."

Doesn't this issue owe its existence to the colossal failure of our
courts, policing and system of incarceration?  

In almost every instance the courts exist to tax those caught breaking
any one of an ever growing list of societal taboos; everything from
child predation to the nickel and diming of parking meters, speed
traps, drinking and driving, which now includes operating a bicycle
and ever more ludicrous acts which share one thing in common.  How
much money can judge and prosecutor extract from the fool before them?  

Clearly this has proven profitable for government treasuries but at an
ever growing cost of greater disrespect for the courts.  NIMBY is part
of this but the greater problem is the failure of sentencing to
address the ill health of those caught; shipping them further down the
road is akin to sticking your head more deeply in the sand.  

Why not insist government clean its own house and deal with societal
problems?

ego's need to fly in the face of that which limits or constrains
"everyman".  

For the ruling class, the spending of money is proof positive of

an excellent source that Paramount has joined Metro in disbelief at
their gullibility believing Larry's promises to restore and improve
the waterfront.  

The Fish's deceit, greed and incompetence leave his sub developers
with the nightmare of convincing buyers that all is well and one day
(somewhere in the next 25 years) "a new day" will indeed arrive at the
waterfront; meanwhile the market cools and few if any of the presales
are binding on buyers.  

You want fireworks; that day may soon be at hand.

Perhaps what you hear is a note of disappointment that while most
agree C8's coming down is good, any celebration ignores the many
residents and businesses forced to pay the piper, so as to give
obscene millions to The Fishman and his band of thieves.  

After all, C8 represents the fastest of the once proclaimed "fast
track" projects, and after 4 years of Larry's do nothing agenda, its
removal merely signifies "a new day" wherein something twice as tall
will supposedly thrill us in the midst of the despair and disrepair of
a very fishy waterfront; drink up, you may well need it.

Sounds to me that a real estate owner, selling participation in
projects such as these, would do so under a limited partnership; the
investor is not promised a rate of return, but rather a prescribed
share in the profitability of the project(s).  

The seller (real estate owner) appears on title and has unlimited
liability; the buyer's (investor's) liability is limited to his
investment or equity contribution.

I think what Dan asks is not what's wrong with Bruce; rather, what the
hell's wrong with council and Fishman?  

That question is similar to Gary's position (which I'll summarize with
poetic license as) when you have an invaluable resource, name
recognition, branding and fond memories world-wide; what genius would
ignore or destroy that wealth so as to enable a half-assed strategy to
build 3000 condos for people who'll have nothing to do but shop, dine
or drink in Larry's Land or grab a bus out of town.

As the boardwalk buildings continue to rot, visitors grow increasingly
weary of Asbury's slogan "wait till next year" and those condos most
dependent on the failed retail reflect in price the bad buys they are,
Larry, Moe and Curly will be forced to take what they can get to
unload this mess.  

Only then will the waterfront stand a chance of realizing its "new
day"; unfortunately, that'll be around 2022.  Looks like Asbury's
Beirut is in no danger of being forgotten.

As we all know, Larry doesn't do restoration, hell he doesn't build,
develop, market or sell, he eminent domains, paints, burns or
demolishes.  

Any restoration of these properties will be done by his tenants, and
since he offers leases no longer than 3 years, there are severe
restraints on how much he can milk these poor bastards.

What are you on man?  In the past I've jocularly questioned your
reading comprehension but now wonder are you so obtuse as to think
that statement was about you.  

I guess on the surface it's a tossup, which of Larry and you would be
the poorer choice to entrust waterfront development; however, The
Fishman's total inadequacy as a deal maker, landlord, real estate
marketer, builder, developer or his dearth of financial resources,
failure to honor his word, abuse of those who trusted him, especially
city council and his mumbling dissembling when called to account for
his near total failure to perform under the development agreement
surely places him in a universe shared by no other.  

Christ man, didn't the Porsche put the final nail in the coffin?

Earth to Tom; I suspect you've been reading the 3villageTimes too long.  

Who do you think the "business world" expects to meet when it visits
Asbury Park−Rumson?  Despite your buddy Dan's assertions that Asbury
is to become a world-class center of design, new-age bohemian
lifestyle and groovy stuff, it remains what it has been for too long,
a model of failed and incompetent local government, whose best suit is
the quick buck deal, usually at the expense of its residents.  

Unfortunately, the course of action the city has taken to redevelop
the beachfront, remains true to that heritage; further, I guess the
fool they've entrusted development to, meets your personal measure of
competency.  He drives a Porsche, wears groovy suits, bullshits his
way through business deals and stiffs naïve lawyers for business
lunches.  

Sadly this is the Asbury the business world still expects to encounter
and GM can't build enough Cadillacs to make it any different.

"If you went on a job interview you wouldn't wear your best suit?  I
hate to disappoint you but in the business world you often have to be
who the buyer is expecting, or he'll buy elsewhere.  
By your thinking Asbury Park should not redevelop the beachfront. It
won't be reflective of the rest of the town, or the struggles faced by
the West Side.  
So to "keep it real" and "be honest about who Asbury Park is," in
front of the business world we are trying to attract, we should have
our leaders tear holes in their cloths, speak with poor diction and
perhaps pay for the business lunch with food stamps. That's someone
else's view of AP; not mine. I think we are better than that and we
should act like it."

"Look, the guy is the main business face of Asbury Park.  He shows up
to a meeting in a jalopy, someone will figure they have him right
where they want him from the start.  I don't mean to be shallow but
the poeple you deal with in life can be shallow and you can't ignore
them. Some people in business will judge a man just on what kind of
shoes he's wearing."

There's certainly an element of truth in "some people" judging content
by its packaging and "someone" might think they've an edge or
advantage through such shallow reasoning; however, there's an equal
case to be made against the guy whose primary strength is his wardrobe.  

The test comes down to whom do you think you're kidding?  You may not
like this or want to hear it, but whoever represents Asbury Park in
business or politics will fool no one by showing up in a Cadillac; the
city is a financial basket case, it has consistently shown poor
business sense in negotiations and little proof that it has learned
from past experience.  

I like and respect Terry Reidy but suspect he is paid a rate, both
competitive and sufficient; to have attracted and to keep him here; if
the Jeep was part of that package, so be it, but in the final
analysis, putting him in a Rolls won't fool anyone.

The below named residents, business persons and friends of Asbury Park
ask for clarification of your efforts, hopes and view of where this
city is headed.

We note the following:
Council submitted the wrong WRP to the state for CAFRA etc. 
You appear unable to get our master developer to develop. 
Although Asbury receives regular local, regional, even national
exposure, the failure of the waterfront developer to develop, merely
showcases our worst face; the city needs a strategy for and the will
to act to carry through with redevelopment. 
It seems obvious that the city may have to raise taxes (again). 

We ask the following:
Let's stop accepting mediocrity.  
Let us begin to support those private citizens who have, and seek to
continue to, put their money where their mouths are (Fasano, DePetro
et al.). The City needs to cease fighting them and putting obstacles
in their path.

Where are we going and where will you be when we get there?

Who in their right minds would endanger their kids by bringing or

That's one of the primary reasons the abatements were given; look at
"Section II-A: abatements, bribes and everything else we can get away
with" of the MOA, it states clearly that only the non-reproductive,
non-adoptive and brain dead will be marketed to.

In all fairness to Weldon, Aaron and council, they had no choice; look
at the mess that the waterfront is, who in their right minds would
consider living there, much less pay in excess of a million bucks for
the dubious privilege, without the incentive of hard cash.  

Hell, everyone knew that the 56 acres were worthless; only a fool,
from out of town, having no experience as a developer would have paid
a nickel for this eyesore.  My fear is that without generous subsidies
from all of Asbury, perhaps in perpetuity, all of those really neat
condos will ultimately turn into a humongous ghetto by the sea.  

Think of it (figuratively) as the price we must pay for the sins of
our fathers.

The proposed redevelopment of the Great Falls Historic District of
Paterson, a win-win proposition that was designed to become the
much-needed catalyst for this city's rebirth, has reached a
standstill. The Herald News, along with other voices in the community,
have disseminated a myriad of misrepresentations that have discouraged
Dornoch Holdings and our talented redevelopment team from pursuing the
project.

It is a disappointment that our dream for the Great Falls will go
unrealized. Our expertise and passion is restoring underutilized
properties, to bring them back to their market value and to make
improvements that have a positive impact on the community as a whole.

In the case of the Great Falls Historic District, our dream was a
virtual mirror image of the redevelopment plan unanimously approved by
the Paterson mayor and City Council in October 2003. It included new
housing and retail, new recreation, improved pedestrian and vehicular
movement and new access to the Great Falls and river. Our plan called
for the building of 973 residential units, 60,000 square feet of
retail space and an 83,000-square-foot hotel and convention center.

We shared our vision with Mayor Jose "Joey" Torres and the council,
and our proposal reflected their vision. The key was restoration of
the neighborhoods surrounding the falls in a way that would enhance
access to the greatest natural attraction in North Jersey. We
envisioned the Great Falls Historic District as a site that people
would flock to year-round.

We also envisioned the positive impact the redevelopment would have on
Paterson's economy – the jobs and income it would create during and
after the redevelopment. The totals were significant: an estimated
1,980 person-years of construction-related employment over the
seven-year period it would take to complete the project and another
220 permanent retail jobs upon completion.

Our experts projected the redevelopment would contribute an additional
$6.6 million in net tax revenue to the city and school assets each
year, based on an increase of $274 million in market value once the
project was completed. All of this was planned without the taking of
any properties through eminent domain and with us paying market value
for all city-owned property.

The plan was conceived to improve the quality of life for the people
of Paterson, something that already is being realized in our
development activities on land we own. On Ellison Street, our work is
producing a new public access Cablevision studio on a site that sat
vacant with rusting steel for the past decade. Now, in addition to the
studio, the property will include a computer resource center and
retail outlets as well.

Quite simply, the Great Falls Historic Redevelopment was something
that would breathe new life into Paterson culturally, financially,
physically and socially.

Everything was on track until November, when some people began
questioning our intentions. The mayor and council postponed action on
the City Redevelopment Agreement with the Dornoch Paterson
redevelopment team.

And on Dec. 27, this newspaper published a story that identified the
disgruntled builder as the same individual who, over the past few
years, had filed a number of lawsuits in Asbury Park, challenging the
Asbury Park Waterfront Redevelopment Plan without success. The claims
denied the progress that has been achieved in the waterfront
redevelopment in Asbury Park and diminished the success of the
public/private partnership between Asbury Partners LLC and the city of
Asbury Park. And it seriously misrepresented the process and proposal
that resulted in Dornoch Paterson.

It is time to set the record straight.

First: my brother, Larry Fishman, who has a minority interest in
Dornoch Holdings, manages Asbury Partners. I have a minority interest
in Asbury Partners. The connection between Asbury Partners and Dornoch
ends there. We are neither affiliates nor sister companies.

Second: The renaissance of the waterfront redevelopment in Asbury Park
has progressed at a record pace. The developers rebuilt the city's
famed boardwalk and launched the first phase of $60 million in
infrastructure improvements that have resulted in new roads, sidewalks

I question the city and developer's actions regarding what I had
thought a standard clause in real estate agreements.  

Real estate agreements generally contain an actual or implied warranty
that time is of the essence.  

It is one thing for the city to gift The Fishman Asbury's lands over
30 years; however, this action brings with it an onus to act.  That he
chooses to under bid, speculate or land bank the property of others
bears a time cost to him.  

On those lands where he failed to act, forthwith as of signing the
redevelopment agreement of October 2002, he can not expect to buy at
the then appraised value, but must pay the price real estate has
inflated since; anything less is unfair to those he holds in this odd
purgatory of Weldon and Aaron's making.

Expansion spansion; so what?  

You get yourself into trouble by your too often use of "you always"
and in this case "everyone"; the world actually isn't that way, the
people in it certainly are not that consistent, even I've had to admit
that some among us aren't always blind.  

Werner is, I suspect, gruff and irascible when it comes to matters
concerning Asbury's historic buildings and its abominable planning,
this has simply grown worse with the botched negotiation of the
waterfront deal and council's ineffective attempts to make right what
even they now see as a disaster.  

Rather than working yourself up over Werner why not lighten up on your
self importance, you may find life a bit easier to take.  

Ps I'll take that bet any day; never, no place, no where will everyone

You can't lay our problems on the disastrous planning and political
power of suburbia; it wasn't they that gave away 56 acres of Asbury's
best, that catastrophe is home grown.  

The continuing urbanization of Asbury isn't a second best option, it
is the path to an enhanced quality of life and greater economic power,
but neither demands the elimination of all open space; that and
specifically the demise of the triangles was Weldon's and Aaron's doing.  

Were urbanization nothing more than "rack'em pack'em and stack'em"
Manhattan wouldn't have Central Park nor any other open spaces.

no idea the amount of land, but think it secondary to zoning, which
apparently allows 134 units, hence my value of $75K/unit.  

That said, show me a site anywhere in Monmouth County 2 blocks from
the ocean the equal of the triangle, fronting on the Atlantic and Deal
Lake; there isn't one.  

As for how many units to build; that depends on who sells, if it's The
Fish flipping a buy at $175 or $490K, you likely have trouble
squeezing in units and required parking .  If it's the city realizing
$10million, you negotiate a larger building envelope.

Council's problem re The Fishman, remains that of spurned lover;
having been courted seduced and bedded by Larry, council simply is
unwilling to surrender all hope that things still might turn out well.  

What the city needs is a brand new suitor, one capable of rekindling
those glorious moments of what might have been; fortunately I have a
wooer, eager to take council to even greater heights of excitement and
ecstasy.  

All council need to do, to explore this opportunity, is signal its
readiness to re-enter and play the game.  Arranging this coupling
requires but a few simple basic steps; council must declare its
readiness to dance, once again, by putting The `scoundrel' Fishman in
default, cease rubber stamping Larry's list of candidates for eminent
domain and announce itself open to bids on the triangle, sewer plant
and various other parcels not yet seized by The Fish; these steps
would immediately realize offers of $10 million for the triangle,
roughly the same (per unit price) for the sewer plant and additional
sites in the waterfront redevelopment area.  

Downside, Larry would be really pissed off and pout; upside, Larry
would be really pissed off and pout, Asbury would collect a slug of
dough and the NY Times could write an article about, and visitors
would see, actual development.

Observers, reporters and speakers of truth understand that Rome was
not, and Asbury can not be, built in a day; that there are many
pitfalls on the road to creation or rehabilitation and that glossing
over bullshit is nothing more than a more visible variant of marking
behavior.  

Unfortunately these markers not merely identify, they stink and stain.

Truth and consequences; Asbury residents, the financial stepchild of
the jersey shore, are overtaxed and underserved; it is painfully clear
that the west side has had, and continues to get, the short end of the
stick of expenditures, services and improvements.  

Financially distressed, it must constantly juggle the books to find
funds for basic services, so that when discretionary spending is
called for, choice often appears capricious.  Clearly council feels
obliged to provide services to ameliorate the east/west disparity;
when it does so, it seems obvious to increase the impact of spending
by availing itself of whatever grants that may be available.  

Unfortunately, the grant process distorts the spirit and costs of
these services.  

This distortion is compounded by a council that means well, but has
few tools to value the cost/benefit of alternatives and whose staff
and consultants are far from the best.  The result too frequently, the
continuing bumbling that Asbury Park has become so well known for.  

Cost certainly is the issue, unfortunately, past sins of omission and
commission cloud current decisions and the fear of repeating history
prejudges performance.

Joe, overall I think you are a valuable piece of what makes Asbury –
Asbury; that said, no one is without fault.  Some are simply more
faulty or faultier; and that said, most of your attack on Jerry is
meritorious (his entire black/white woman bit is abominable), but
then, as with so many wielders of truth, in their own eyes, conviction
and enthusiasm, you go too far, you mount a stallion to do battle,
only to tilt at a wind of your own making and an ill wind it is.  

I gather from many of your positions, expressed in posts herein that
your primary affiliation is to the gay community; that experience
certainly should have by now enlightened you to the burdens and
travails of others, which causes me to wonder how one supposedly
knowledgeable, would choose language positioning him to state so inane
a quote as "that white woman"?  

Were that not enough, you compound the faux pax with "when are you
going to stand up for your constituency"; are we not all of the same
tribe, do we not all have the same feelings and hurts, do we not all
bleed when injured, cry when hurt laugh when humored, are we not each
and every one brothers and sisters to each?  

You would have Jerry "stand up for your constituency", which one?

My sources elaborate a more Machiavellian rendition of these facts.  

Seems not only has Larry not performed the agreed upon painting, for
which he was paid, but he initiated a complaint to the buildings
department, specifying the rundown condition of her home.  Apparently
he thought he could get the property declared "blighted"; while that
strategy failed, it did result in a buildings standards work order, a
summons for failure to comply, hefty fines for no-show and a lien on
her property.  

Barring the appearance of a white knight, Larry may scoop up mom's
house in the next year; stay tuned for updates.
