Werner, I have been reading your posts now for months. I can't help but get offended when you imply, and not subtly, everyone is an idiot but you. I have read your posts and heard you speak and while I think you are brilliant on many issues emotional growth, I imagine, is not one of them. You can explain the issue in simplistic terms with out implying people are stupid for not understanding it. I was at the council meeting and while you had the last 4 years to attend every meeting and committee that took place in Asbury regarding the redevelopment many of us were working full time and were unable to attend. I want to mention that Property Law is a complex issue. I took many classes in it at law school and it continues to befuddle me. And it is not only me. Property Law questions asked on the bar exam in all the states are the lowest scored questions. There are six subject asked for the bar; torts, constitutional law, property, criminal law, contracts, evidence. Property law questions are always the questions that most people get wrong. Encroachments, adverse possession, easements, easements by prescription, eminent domain each one of these issues are complex and then adding city ordinance to them manages to make them a little more confusing. ERROR: Found in unapproved, revised waterfront plans CITY OFFICIAL: Mistake won't derail redevelopment Asbury: Developer sent wrong plans to DEP Posted by the Asbury Park Press on 10/21/05BY NANCY SHIELDSCOASTAL MONMOUTH BUREAU ASBURY PARK — The city is correcting a mistake made by the waterfront developer's planner that allowed the wrong version of the 2002 waterfront plan to be sent to the state for the Department of Environmental Protection's approval.City Manager Terence Reidy said an analysis of the plan approved June 5, 2002, by the City Council and a different version that had been disseminated to the public and the state showed that differences between the two plans did not affect the state's analysis before they issued the Coastal Area Facility Review Act permit in March 2004.Officials say that Asbury Partners' planner, Clark Caton Hintz, came in with a different version at the last minute when the council approved the plan on June 5, 2002. But the city's redevelopment attorney, James Aaron, did not allow the council to act on it because the plan with the changes had not been through the Planning Board.The planner made the mistake by later releasing the wrong version for the city and public's use and also attached that version to the CAFRA application."You're not going to get away with this," said Daniel F. Sciannameo, a New York City appraiser who owns a home in the city, when he spoke at a City Council meeting Wednesday night. "I'm the one who blew the whistle on you and asked the DEP to shut you down. You're working with an illegal CAFRA permit.""Mr. Sciannameo, I know you are the one who called. . . . You uncovered it," Reidy told Sciannameo later in the meeting.The city met with the DEP on Wednesday and is to send a letter to make a modification that could take about two months to complete, Reidy said. Construction on waterfront projects already under way can continue in the meantime, although any new construction will have to wait.The mistake came to light after one of the beachfront builders, Metro Homes of Hoboken, learned it could not use the abandoned 1989 condominium steel skeleton between Third and Fourth avenues known as C-8 on planning maps because the pilings could not be certified as safe.The waterfront plan the city says it approved would allow Metro Homes to build its planned 224-unit Esperanza to the same 16-story height of C-8. The plan that Hintz distributed and sent to the DEP said that if C-8 came down, the height of its replacement was limited to eight stories.The city did not have its own in-house planner at the time the mistake was made, and Reidy, who also was not yet hired as city manager, believes the city's current planner, Donald Sammett, is a safeguard against such mistakes in the future.A group of critics, who often say the city has given away too much of the waterfront to the developers, jumped on the mistake. That is not what is at issue here. What is is legality and possible fraud. I did not start this. I can't make believe that I did not see the corpse in the closet. I did and I must say it. If, as I now suspect, that it was NJDEP that required the additional language about demolishing C-8, that explains why the Developer put it in the June plan. That also conforms to the Cty's story that it did not request the language. What it does not explain however, is whether the wrong plan was given to NJDEP intentionally, and if not, why, when Aaron told the Developer that the June plan could not be adopted, the Developer did not inform NJDEP. It also doesn;t answer why when the City knew it was the wrong plan that it did not contact NJDEP. That's why I claim credit for it the other night, not to be boastful, but not to let it appear as if the city approached NJDEP on its own. That was how it was being conveyed and was not how it happened. Finally, if NJDEP did require that language, they should not let the CAFRA permit stand without having that language, which the adopted plan does not according to the city. To have it in there, the plan has to go back to the Planning Board. They all brought this on themselves. I am not persecuting them or trying to stop development regardless of what Nancy Shields puts n her editorials. She was given the scoop on this before and could have broke the story but didn't. Ms. Denson, I know people who are familiar with you and the services you give to the community. I, for one, know that. When Asbury Park Candidates for Office were having the forums at Mt. Carmel Catholic and Asbury Park Middle Schools, I saw you videotaping these events and we spoke. I also saw RadioAsbury.com, 88.1, also there. What I'll do is print this email and give it to the President of my Auxiliary. My Post and Auxiliary, give 50 Thanksgiving baskets each year and my daughter and I give two, 1 each to a family at the Little People At Work, Pre-School. I will ask the Auxiliary, to either bring food in, or give cash ,so that food can be replenished, at the The Chant Food Pantry and any posters out there, can contact you to help also. What you could do, is make a flyer and get it out to the local businesses here, or contact them and ask if they'd be willing to place a box, at their front door, asking for contributions. Sad huh, what a catastrophe brings on other communities. Didn't know that Asbury Park, Neptune and low-income people, were affected here. I humbly apologize for anything I said, adverse to the wonderful job you do in this area. I know also, that Red Bank, had a program called Lunch Break and St. Augustine's Episcopal Church, on Prosepect Ave. Has their Feeding Program for the homeless and Trinity Church, in Asbury Park,also has a food program, too. Have they been affected by Katrina/Rita? Now, Florida is preparing for Wilma! What's next? Does any other churches in this area have similar programs? If so, can I get a list of them? To the Fish: No, it shows a vigilant, alert, smart, if nothing else, citizenry, that is watching to see if all the I's are dotted and the T's crossed! So should one of our citizens being called out for being on point? Just goes to show that if we aren't vigilant, we get the redevelopment, we deserve. I certainly know NOTHING, shy of a minus sign about what exactly, Asbury Park wanted. I can't fault Terry, for a plan, Weldon had in place, when he was hired. Can't say if he asked whether the Plan needed going over, or if Aaron, the attorney, consulted with him on exactly what the deal was. Giving Mr. Reidy a bye, on that one, however, isn't that what we HAVE Aaron for, or is it another attorney's responsibility to bring the new City Manager up to stuff on where the City was at the point Mr. Reidy was brought in. Remember, Wilbert Russell, died, while on the job, so it was incumbent upon SOMEBODY, to bring the new hire IN on exactly what the deal was, knowing Asbury residents. There are some really smart, savvy, residents here who SHOULD be on the Committee but are unfortunately, NOT! Who may I ask is responsible? The Redevelopment Attorney, who is PAID to act on OUR behalf? The City Clerk? The Council, Tax Assessor, WHO? I am not an OWL, but WHO, dammit! Everyone mentioned is a hired HACK, except the Council, who is elected by the people. So YOU elected this council, now, DEAL with them! You GET who you elect! I can't understand why everyone is bent out of shape with the council. Not being fecetious, either! These are the people you elected! The elections are over, not everyone I voted for, got in, but I'm willing to work with what we have, as long as what they do, is legal! Plain and simple! Dan, I feel you are falling for the bait and switch and I'm really surprized. It is not a FACT that the wrong plan was submitted. The preponderence of the evidence is that the correct plan WAS submitted. Affirming and repeating what the City claims,(wrong plan)only serves to further whitewash this whole affair. At issue is that the city wants to now substitute a less restrictive plan for the one that is for all intents and purposes the adopted plan and is more restrictive. The battle cry should be Why is the City attempting to substitute a plan that is more favorable to the developer by claiming now that a 'mistake' was made? If the C-8 were not declared 'un-finishable' this issue would never have come up and the current plan (now declared a mistake) would have went forward without question into the forseeable future. And rightfully so, since it is the plan accepted/adopted/submitted, etc, up to now. The only event that took place is the revelation (according to the plan,now claimed to be the wrong one) that C-8 would need to be redesigned to conform to the bulk standards of 3/4/8 floors. I took many classes in it at law school and it continues to befuddle me. And it is not only me. Property Law questions asked on the bar exam in all the states are the lowest scored questions. There are six subject asked for the bar; torts, constitutional law, property, criminal law, contracts, evidence. Property law questions are always the questions that most people get wrong. Encroachments, adverse possession, easements, easements by prescription, eminent domain each one of these issues are complex and then adding city ordinance to them manages to make them a little more confusing. Well, Now that we have introductions out of the way, let's meet for coffe/lunch/drinks and get to work figuring out if private property owners should be permitted to use or build on City property adjacent to theirs. A good Historian and a good Lawyer is just what Asbury Park needs. So while you seem to have a grasp on it all please stop implying people's inability to fully understand what is going on are ignorant. If in fact DEP required the language and the official plan does not have it (as the City claims) then it cannot be issued a CAFRA permit. Also, if DEP wants the language then we as a City could not even allow rebuilding if we wanted to. What I do know is that that language is in there because someone wanted it included. I know the Developer did not do it if it wasn't required. I also know that the planners would not do it on their own. It is in there because either the DEP or City required it. Only additional evidence will show where the truth lies. I wish some that were on the Planning Board would come forth and help. But I suspect that there will be an extensive investigation which will turn up everything. I hope we can settle this before people have to be dragged onto the perp walk. Yahoo! I know also, that Red Bank, had a program called Lunch Break and St. Augustine's Episcopal Church, on Prosepect Ave. Has their Feeding Program for the homeless and Trinity Church, in Asbury Park,also has a food program, too. Have they been affected by Katrina/Rita? Now, Florida is preparing for Wilma! What's next? Does any other churches in this area have similar programs? If so, can I get a list of them?
