It has certainly been poor leadership and decision making. An
unwillingness to consider the 'state of the art' in redevelopment and
economic sustainability. Failure to protect public assets and the
public's interests.

I predicted many of the current problems as far back as 2000. I think
part of being wernerized' is that they can not stand that my
critiques, commentary and recommendations have been correct.

They will never admit to any errors and would rather 'kill the
messenger'.

The developers constantly do things that are incompatible Don't
realize that it lowers the overall value of their investment
Simple design issues go ignored as are sound recommendations.

Sorry Tommy but being almost 10 years older than you I have many more memories 
of The Casino.  The concerts did not come until later years ---When we were 
young we used to go ice skating there and loved going on the carousel.  My 
mother would dress us up and it would be a very special occasion---she even 
made us wear the little white lace gloves from our Holy Communion outfit! (I'm 
surprised my dad didn't make us carry the little white plastic prayerbooks). 
I think it is beautiful in the evening the way it is lit up and gives me a 
very special and proud feeling when I ride through the waterfront at night.

Debbie I'm in no way minimizing your personal reminiscence.  
Everyone in the world has them of some place.

But I can't see yours, and you can't see mine.

The generations to come won't know of them at all.  They won't get 
that feeling you get when you ride past there at night.

Did Asbury Park really miss a perfect opportunity to build something 
of world-class proportion so folks like you and I can get a fuzzy 
feeling when we ride by?

Personal nostalgia is no reason to save any building.

Asbury Park missed a big opportunity.

I'm willing to bet Gary M would agree in private.  I public he can't 
look sour on the plan that was passed before he got here.

The last State funded project toward Historic Preservation in Asbury
Park was to rebuild the Water Tower on the Paramount Theater.

That was a very painful and drawn out matching grant program that
flagged Asbury Park as dysfunctional in protecting cultural assets as
far back as 2 decades ago.

Yeah, I saw people putting money into the meters all weekend.
Recently, I saw signs on some of the meters pointing out that the fee was 
suspended,
but it looks like most, if not all of those signs are gone.
I think it's pretty bad form on the city side to not keep up on informing 
people that 
parking is free for now.

[AsburyPark] MM and the $60 or $160 or $500m

1. HOw much is their cut of each sale to rent? How much per drink? Sell 
enough booze on the boardwalk and around town and you can do ok-  as 
long as you draw people in. MM has an incentive to bring people to 
their side of town - they have to empty everyone's wallet.

2. AS far as what they spent to buy Kush out, that could become a 
lingering qusstion. They have to sell those units or think about 
renting them out if they don't move more of them to acount for being 
the top bidder of Kush property by a pretty good number. Fromt he looks 
of it, Kush got out ok, but who knows?

No one really nows the real deal int he partnership.

ALl I know is if someone gives you money to invest, the goal is to 
provide a return. Otherwise, you're thinking like rest of america using 
credit cards and home equity-  it ain't my money so let's party.

developer was, you'd think they print out a couple of signs or wraps 
around the meters...free parking courtesy of The City of Asbury Park 
ends March 1 or whatever date

and be sure to double the rate from .50 to $1 when it kicks in again.

I'm gonna disagree with you on that, Oak.

Right now the American people are getting whooped by Fascist bialouts - 
(Fascism = socializing business losses through government while keeping 
profits privatized.  It's not Socialism - it's Fascism).

Government and business converting your money to their uses with 
nothing back to you.  That's Fascism.  Were it socialism, something 
would at least be coming back to you (redistributing).

Maybe Asbury would be better off advertising a bailout backlash or 
a bailout for people.

No beach fees.

No parking fees.

Half the sales tax (UEZ).

No hotel room tax.

No tourist taxes whatsoever.

Free outdoor concerts.

Free entertainment in the green spaces (like Werner once pointed out - 
jugglers, acrobats, mimes, strongest man in the world types [note: 
saw a guy in AP with that show when I was a kid], etc.)

Asbury Park - where you spend your money on yourself.

 Free outdoor concerts.

 Free entertainment in the green spaces (like Werner once pointed out -
 jugglers, acrobats, mimes, strongest man in the world types [note:
 saw a guy in AP with that show when I was a kid], etc.)

 Asbury Park - where you spend your money on yourself.

Ok.

Whose gonna bailout the city to cover for it all?

If the developer,whose using someone else's money is willing to pay for 
all that free stuff you propose, like lifeguards, gate guards, police, 
lighting, signage.

If a room can go for $150-$250 night...or a drink $11 (at least my blue 
was only $5)or dinner $30 plus appetizers, drinks, deserts etc or a 
knick knack old propeller decoration is $3,000...

BASED ON EXPERIENCE over the years on the boardwalk when things got 
depserate, FREE BEACHES did bring people in and helped the merchants 
out some BUT did nothing to help out the city. 

They still had to pay the bill.

So it's ok for an individual business owner or developer with debt free 
money to profit at the expense of the city?

I think asking everyone to contribute $1 or $2 isn't the worse thing in 
the world to help AP climb out of hibernation. 

If I (or anyone else) can for over money for booze, paying $1 for 
parking or another $5 on a room for $150 isn't the end of the world.

And the landlords of the city should just give free rent? Remember, the 
city is one giant landlord - collecting rent to cover and provide the 
essential services so that their residents (tenants) can propser.

No John, not the whole Right;  just me.  I'm beating the drum to 
call it Fascism because I want the nation to at least be correct 
about which ism we are tending toward economically.

Of course the charge I'm making is against the Bush administration.  
The new President isn't in charge yet.  Hopefully he'll give me 
nohting to complain about.

But lets not go off on a purly political tangent.  

I brought it up in relation to a an advertising blitz I think AP 
could benefit from if they advertise a backlash against other people 
taking your money.

[AsburyPark] Topic change to Taxes and Free Beaches....

And the problem created when FREE BEACHES took place...

The african americans and spanish came to town.

That was the unofficial problem created by free beaches.

Beach fees help the problem.

BUT, as a merchant who sold cheap beach buckets (or gave them away 
cause I hated to here someone say you ain't getting that, shutup...) 
or one who was taught early on that people with money to spend are 
good people... the more people with money to spend, the more you make.

That, I was taught not in college, but on the boardwalk from every old 
guy there was.

We all take our out of shape asses and sit on the chair for free and 
try to look good

ADvertise on the lifeguards chairs and ON the lifeguards backs or 
asses...

Having attended the meetings I can tell you that complaints about
having to PAY were never the issue.

The issue was - the machines not being easy to understand, not giving
change, getting tickets... etc.

There is absolutely a need to have people paying, there is debt
service on the cost of the system.

There is potential revenue (+cash flow) to be realized going forward.
This has become another silly exercise without clear goals and flawed
policy making.

The meeting discussion started out about SUSPENDING ENFORCEMENT...
Then morphed into announcing that parking was free. Silly...

I maintain the opinion that the Public has a right to be privy to any
dealings Asbury Partners has with 3rd parties.

The entire basis for their involvement in Asbury Park is the Public
declaration of a Redevelopment Zone and their acceptance as a Redeveloper.

That all involves the Public trust and partnership with the City.

The Public has every right to know what they do on the Public's
behalf. Perhaps a legal action to compel disclosure is needed?

Exactly.

No reason to make it free.

$1.00 to park should be FREE, but to go pay at least $80 for a bite 
and a drink?

PRemium outlets wanted 8.00 to valet your car. and there were 
people who had their cars valet parked.

The merchants can always give a $1.00 off the final bill if they felt 
it really made a difference.

Good service, good food, drinks, weather or something else you offer 
brings people in if you don't have people want, they aren't 
coming in. Another fact of life in the business world.

I think that any Sub-Developer agreements that APartners engages in
would be open to examination. The 'developer/sub-developer'
characterizations are derived directly from public law and public
policy making.

They are acting only under the rights granted to them by the Public
(City Council).

Opening tenants leases and agreements with property owners to public
scrutiny I think would be a stretch however.

 It has certainly been poor leadership and decision making. An
 unwillingness to consider the 'state of the art' in redevelopment 
and
 economic sustainability. Failure to protect public assets and the
 public's interests.
 
 I predicted many of the current problems as far back as 2000. I 
think
 part of being wernerized' is that they can not stand that my
 critiques, commentary and recommendations have been correct.
 
 They will never admit to any errors and would rather 'kill the
 messenger'.

Developer gets stay on Asbury COs

ASBURY PARK — The city's new stores and restaurants are open this weekend and 
most 
days of the week, but attempts by the city and beachfront developer Madison 
Marquette to 
settle how they'll share waterfront revenues ended up in Superior Court Friday.

Madison Marquette appeared before Judge Patricia Del Bueno Cleary, who 
restrained the 
city from acting on expired temporary certificates of occupancy for the 
boardwalk tenants 
until a full hearing is held, probably in early December. The temporary COs 
expire today.

The city has tied permanent COs for dozens of year-round venues to getting a 
redeveloper's agreement between the two sides in place. It was to have been 
finished by 
last Memorial Day before Madison Marquette started rolling out the first of the 
renovated 
pavilions. Over the summer and fall, the city agreed to new deadlines, first 
Sept. 15 and 
then today.

The real issue here is, we've been attempting to get a subsequent developer 
agreement 
for a year, City Manager Terence Reidy said Friday night.

Both sides indicated Friday that a divide between the two at this point focuses 
on parking. 
The city appears determined to gain financial self-sufficiency and needs to 
make money — 
50 cents an hour — with new parking meters.

When summer ended, Madison Marquette and boardwalk tenants asked that the city 
not 
enforce the paid parking in the winter. Madison Marquette also does not want 
paid 
parking in the evening hours next summer.

The city in October agreed to shut down parking for the winter but did so with 
the 
understanding Madison Marquette would offset some part of the city's loss.

For 10 to 12 weeks, the city's allowed to charge for parking, and the entire 
rest of the 
year, we're not, Reidy said. That allows Madison Marquette to control our 
destiny.

In a letter to Madison on Thursday, Nov. 13, Reidy summed up that the city had 
responded 
a month earlier to the impact of the changing outside market conditions on 
Madison 
Marquette's ability to finish the agreement at that time.

And he indicated some form of agreement had been reached for Madison Marquette 
to 
give the city a payment for the lost parking revenue, for the city to give the 
developer 
some form of 30-year payment in lieu of taxes on new construction and for the 
temporary 
COs to stand for three more months until negotiations concluded.

Reidy said a subsequent proposal from Madison Marquette had made those areas of 
agreement elusive and as of today, the temporary COs would be up, and the 
company 
would be leasing the pavilions illegally and would get daily fines.

Madison Marquette could still stop the city from acting by making a $75,000 
payment for 
the lost parking revenues, Reidy said in the letter. The city would still offer 
the 30-year 
payments in lieu of taxes on new pavilion constructions, and the temporary COs 
would be 
good until Feb. 15.

Gary Mottola, president of investments for Madison Marquette, turned that down 
and said 
Friday he went to court instead and obtained the injunction until a full 
hearing is held.

Basically, the judge separated the tenants' rights to utilize their space from 
any issues 
involving the developer and agreements between the developer and the city, 
said 
Madison's attorney, Roger Roisman.

It's the parking, said Deputy Mayor Jim Bruno. We can't get past the 
parking.

parties better than the current mall-on-the-sand plan. 

 Just the construction of such a grand building and the anticipation 
 it would bring would be it's own adverstising.

In your opinion perhaps. I actually found the Casino to be more inviting than 
CH, if only 
because of the pseudo-Mediterranean curves of the roof and the tall windows 
overlooking 
the beach. There's nothing wrong with CH, but visually it's a bit more blocky, 
more Lego-
y. It's slightly more utilitarian, whereas the Casino always looked like it was 
trying to make 
an artistic statement. 

 and while you might 
 name one or two acts that played there, it really wasn't the big of 
 a place for shows.  

Irrelevant now that it's gone. And Convention Hall wasn't built to take the 
constant 
pounding of amplified performances. A new, 21st century Casino could be. 

 We had this conversation before.  You have to be pretty old to even 
 remember seeing a significant act there.

If age and personal connection to past glory were prerequisites for 
preservation, we'd have 
no Count Basie Theatre, Loews Jersey, Independence Hall, Pantheon, or Great 
Wall.   
 
 But alas, the Nostalgia Nazi, comprised mostly of people who never

What about the whole concept of the cities investment in the parking meter 
equipment?
It's pretty obvious that people don't really have a hard time paying to park, 
since they are 
still doing it, even though it's currently free.
I sincerely doubt that the rather tiny cost of parking is going to keep people 
away.
The bigger problem is having a year round boardwalk that has enough of an 
attraction to 
keep going year round. As it stands now, I don't see that happening.

 Right now the American people are getting whooped by Fascist bialouts - 
 (Fascism = socializing business losses through government while keeping

 nothing back to you.  That's Fascism.  Were it socialism, something 
 would at least be coming back to you (redistributing).
 
 Maybe Asbury would be better off advertising a bailout backlash or 
 a bailout for people.
 
 No beach fees.
 
 No parking fees.
 
 Half the sales tax (UEZ).
 
 No hotel room tax.
 
 No tourist taxes whatsoever.
 
 Free outdoor concerts.
 
 Free entertainment in the green spaces (like Werner once pointed out - 
 jugglers, acrobats, mimes, strongest man in the world types [note: 
 saw a guy in AP with that show when I was a kid], etc.)
 
 Asbury Park - where you spend your money on yourself.

I'm 100% certain that the masses that came to the city on Saturday for a 
concert would've 
happily paid to park. It comes with the territory of going to see a show.
If you are going to MSG for a concert, you'll pay for parking. Same thing in 
Newark and so 
on.
The city lost an opportunity this weekend.
The city is also letting MM do whatever they want, because they are blinded by 
the glow of 
their celebrity and .
In the end, somebody is going to make a lot of money, and it's not going to be 
the city of 
Asbury Park. MM will be laughing all the way to the bank.

The typical season was 110 days.

And with that, you hoped and prayed for nice weather. YOu were on 
your own with no backing.

Here's a major developer and retailer asking for and getting a break 
on .50 hour parking fees. 

How do you construct retail with NO parking. every major developer 
HAS to provide parking as per any town regulation. So ,many spots per 
1,000 sq ft so the developer gets to use city property for their 
benefit and gain (rent) while the city gets

It's not the city's responsbility to make money for the investor.

They bought CH. They bought the rights.

They bought the rights to make money. 

The city and developer(s) signed agreements.

And once again, the success of a musical weekend in AP proves, once again, that 
music is 
pretty much the number one draw that's going to bring people to the boardwalk.
And this is where the redevelopment has made a wrong turn. High end retail, 
year round, 
on the boardwalk is totally wrong.
If the acres of empty lots were developed into music venues, and eateries, we'd 
be headed 
in the right direction, big time.
Too bad that's not going to happen, and we going to live with C-8 part 2 for 
who knows 
how long?

Train (20 plus) to MSG or parking at javits or a NYC show $48 or 
more


The thinking is if they don't have to spend $2.00 to park for FOURM 
hours, maybe they'll spend that money in the bar...

Let MM run their lots as they want, even hanging FREE parking signs. 
The city should give them the permits for those lots AND TAX them 
acordingly - not as vacant land.

Let those free lots get filled then let whomever else wants, pay to 
park.

What about the concept of the City stepping up to the plate and having the balls
to show MM who the boss is?
Obviously, MM thinks they are. I had pretty good evidence of that when I saw 
Mottolla 
playing cop on the boardwalk by telling a women, who was walking her dog on the 
deserted boardwalk one day, that she had to leave, that dogs weren't allowed 
here.
If that ever happens to me, Mottolla is going to have to call the cops, because 
he has no 
right to do that. He's overstepping his bounds, but that's just evidence of how 
MM views 
their role in the city. They have us by the balls.

WHY??

1. Stay open past 9pm and people will come. It's the summer.

2. IN MOST tourist towns, at NIGHT is when parking fees go UP. The more 
people, the more you charge.

YOu see, if you make the parking meters FREE, then they would get 
filled up first and the city gets ZERO dollars.

BUT then, since the free spots are taken, then the boardwalk merchants 
would complain there's not enough parking so people have to walkso 
then MM rolls out their own VALET SERVICE at $10 or more per car as 
cars pull up to Stella or Tims or for an event and guess what, MM makes 
$10,000 grand parking cars peak days and the city gets the benefit of 
knowing they offered FREE parking.

And you don;t think they would valet the cars in the free city owned 
spots

I can get dragged up to C21 Department stores in Morristown and park 
in the garage connected to C21. 

You get your ticket validated probably for the first couple hours 
then pay so much per hour ( .50 hour). The place is packed.

Then we leave, drive down the street and park again to eat. I look at 
the sign, the meter (see if I got one with time) and then dig for 
change.

Or... I can go to C21 in Paramus and park for free - that is if  you 
can find a spot.

See there oak, other places you get to park for freeyea, I know, 
but those are privately owned shopping centers, where the tenant is 
paying a portion of their rent to care of the parking lot, for the 
benefit of the tenant. 

One of the best selling points I can make if I had to sell a shopping 
center that had muni parking lot and not their own look - ZERO 
parking responsibilityit's all public parking lot owned by the 
county or city...

Guess how much it cost just to have a lot plowed?

Do you think the city before winter tenants knocked themselves out on 
Ocean Ave?
No.

Now who's going to get plowed first this season? And whose going to 
pay for it - you just can't plow it now - you have to shift it 
around...

It all costs money. 

MM snow removal costs will be near zero other then from their own 
storefronts..

I suspect (hope) the city will stand pat. I counseled so last year
with regard to the Wesley Grove purchase and the city got its money.
It takes two to tango. We have a right to have metered parking. Lease
all the metered spots to MM for the greater of $500K per annum or 10%
of the parking revenue.  If they want to give it away fro free let
them but we get paid. If it is metered, we can talk about enforcement
for a split of the profit on tickets.

No. Park and walk or sit out west there and play in one of those mud-
holes or come and enjoy the ocean.

There's free beaches in the area - in deal where you can park and sit 
on the sand for free. If you bring a boogies board, you can even go 
in the water for free without getting a ticket for swimming. Free.

Just no lifeguards if you choose to go the free route.

Belmar charges around $18 jsut to put a boat in the water in the 
marina...long branch has a free drop..

You have to respond to the market and the market is still local.

As soon as they started charging to park in AP we went elsewhere.  
Came back when they stopped.

Same will be true next year.

that are really, in the Internet world, micropayments.

Who's plowing snow off Cookman Ave? The City

Who's plowing snow off The Boardwalk and Ocean Ave? The City?

Who has to provide fire and police?

Meanwhile, the city can't generate meaningful property taxes nor 
other revenues on their rights to an asset - the boardwalk, ocean ave 
and the water and sand.

Actually the last major snowstorm we had a couple years back the 
City couldn't respond.  We downtown businesses couldn't get there.

After a day Henry Vaccaro showed up with his equipment and cleared 
the streets.

 
 Meanwhile, the city can't generate meaningful property taxes nor 
 other revenues on their rights to an asset - the boardwalk, ocean 
ave 
 and the water and sand.


Nor will they if they keep giving folks more reasons not to come.

And for everyone that decided not to come because of the meters, three
others took their place. This year we charge for parking and it is
almost impossible to get a space near the beachfront. Last year, no
meters and much more parking available - under better market conditions.

I learned a long time ago NEVER to be the lowest bidder. What are you
saying about yourself? For many years I will not even be part of a
bidding process.

If I'm replaced by 3 tourists then good for Asbury Park Boarkwalk 
vendors!

I'm just willing to bet there would be 4 of us with free parking.

Not one tourist is coming BECAUSE there is metered parking.

Some (like me) will stay away because of it.

Remember, when I don't pay 50 cents to park, I also don't buy $15 
worth of beach passes.

One of those tourst families is going to have to park for 30 hours 
that day to make up for me not buying beach tickets.  Or all three 
of them for 10 hours each, where the City breaks even but the 
vendors lose my business.

Here's the inquiry then:  

If the City and the vendors on the BW can make more money from the 
meters than from those of us who will stay away, then the Meters 
have passed the risk/utility test.

If that's the case, then no one can complain.  Me in particular.  
It's a smart move on the City's part if they make more money from it.

Query though why the developer opposses it?

I'll be at the free beaches...

You can justify it any way you want.
Staying away from AP because of a tiny parking charge as a principle makes no 
sense at 
all.
The only justification is that;
A) you are cheap
B) you are broke and those 50 cents is all that stands between you and 
starvation

And in the same vein, why not make it free access to the beaches, I am
sure the developer would welcome that as well. In fact, maybe not only
making parking and the beaches free, if we really wanted to increase
visits and please MM, maybe the City should start PAYING people to go
to the BW?

to me. No (even the best) developer is your (City) friend.

Free parking meters = $0 City revenue.


That math seems pretty simple to me. Oh yeah, beach badge revenue

metered parking this year).

Advertise for a couple of weeks around the state that that Saturday 
will be free parking.

Then compare the revenue for daily beach badges.

If you have about $1,000 more, the meteres aren't worth it.

Not perfect, but a close enough experiment.

They charge a lot for parking. In NY we know that parking is NEVER free.
There is ALWAYS a cost for parking.

The city has costs to maintain the streets. Certainly that could be

are attracting so many people (to spend money) by free parking. But MM
wants to have its cake and eat it too.

AP had free parking for years. Few came. We charge for parking and
droves show up (except for a few cheapskate lawyers). Go figure.

Charge for parking. Less parking becomes available. You have to move
here so you can walk to beach instead.

We allowed magic to happen to multiply the number of liquor licenses
in AP so they could make money. Let us have the parking or pay us to
keep it free. And  sign a redeveloper's agreement.

4) use MM lots outside Wesley Grove for temporary stables for the 
city's horses and sell feed to tourists and let them get their 
picture taken with the horses...

you mean sold condos where a CO was issued 
finished and not sold = 0 to the city and 0 to the local businesses 
hoping that people would be in them - at least in the summer. 

You can have all the condos you want, but if they are summer 
only...then you have to figure out your winter and how to draw from 
outside the area.

What's more valuable - 63 full-time rentals at the steinbach or 30 or 
40 with only 10 or 15 year round?

We need to know how much, what the trend has been for the past several
years, what the basis or valuations are for the buildings, etc...

Are the collections actually being done? Are mandatory payments

i never should have typed it. i was responding to tommy's wifes joke,
which i didn't read as a joke. i didn't get it, still don't. but it
sounded to me like the whole world is against asbury park and that
is the reason for its struggle. not asbury park. the world, the riots,
the economy. now the fault is MM. not ap decision makers.

so, if asbury were a person (apparently a pretty dysfunctional one)
the reason for its dysfunction is the global economy, MM etc, not AP
itself. which sounds to me like something an addict would say. 

it just sounded like someone placing the responsibility for ap's
insane drama on everything else but itself. something republicans
criticize individuals for all the time.

Asbury seems insanely dysfunctional to me right now. That last APP
article that Jack posted tipped me over the edge. WTF is up with this
place? Is there anyone competent in charge?  I just wish I could
understand it. I feel like I have a responsibility to try to, but it
just doesn't seem worth it sometimes.
