Didn't know you were/are, an attorney.  I think the 2 of you combined,
are a formidable force!  You both, seem to know the ins and outs, of
the Abbott decision and how one person, CAN make a difference.  Are
you willing to take this on?  You both, seem to want the BEST, for our
kids!  I'm eternally grateful, that this town can boast of such
professionalism and expertise, in matters, such as this.  Can you go
after the State, for allowing their actions and where does the ACLU,
fit, into all of this?  I pray, that the current slate on the board
STAYS, to finish the job, they've started and that the thieves in the
administration GET, what's coming to them!  It'll be a sin, if this
town isn't vindicated for all of the mess, wrought by greedy
administrators.  They should get their comeuppance!  Will there be
forums, like there were, from the last big election?  If so, I can't wait!

I agree to the above statement, too, but how?  It takes money and lots

 Last week I posted here and asked that all of you go to Randy 
 Bergmann's Blog (he is Editorial Editor fo the Asbury Park Press).  
 He blogged about he school report cards, and I ended up in a 
posting 
 argument with others about closing APHS as a way to desegregate it.
 
 There ended up being 30 posts, mostly between me and a couple of 
 others. One was an intelligent fellow. One was an extreme bigot 
that 
 said just build more jails for Asbury's youth.  Scumbag.
 
 I digress.
 
 Today in the Asbury Park Press, they printed an editorial, with the 
 postion that Asbury should close as a way of desegregating the 
 district.
 
 They took my argument almost to the letter, including where to send 
 the kids.  The only thing they forgot to do was credit me, but who 
 cares.
 
 The good idea is finally catching on!  See below:

 There seems to be no end to the depressing stories coming out of 
the 
 Asbury Park School District. In the past two weeks alone, there 
have 
 been allegations of padded enrollment figures and bid rigging, a 
 vote of no confidence in the high school administration by the 
 teachers and a document raid on the Board of Education offices by 
 investigators sent by the U.S. Attorney.
 
 Add to that the stubbornly low test scores despite the highest per-
 pupil costs of any K-12 district in New Jersey and a student-to-
 staff ratio of more than 5 to 1 at the high school. The violence in 
 and around the schools. The on-again, off-again sniping on the 
 school board. The disastrous lack of leadership at the middle 
school 
 and the chaos in the halls and classrooms there and in the high 
 school. The superintendent the board tried to fire, was forced by 
 the state to hire back, then tried to oust again, suspending him 
 instead with pay at the insistence of the Department of Education.
 
 There have been some glimmers of hope over the past several years, 
 but they have proved fleeting. For the most part, the school system 
 has been a disaster. It is broken. Stronger leadership might help. 
 But finding it — and keeping it — has been a persistent challenge. 
A 
 state takeover isn't the answer either, as experience in other 
 districts has shown. Given the hurdles the district faces, 
 dismantling it and starting over offers the best chance of 
providing 
 the city's students with a quality education.
 
 It's time for a new approach to educating children in Asbury Park — 
 one that involves creating a desegregated regional district that 
 includes Asbury Park, Monmouth Regional, Ocean Township and 
 Manasquan. Asbury Park High School should be turned into a county 
 magnet school for the arts. The middle school should be converted 
 into a trade school under the jurisdiction of the Monmouth County 
 Vocational School District. At least two of the elementary schools 
 should be left open, but operated by the regional district and 
 desegregated. And Asbury Park students should be sent in 
 proportionate numbers to other schools in the newly created 
regional 
 district — along with increased per-pupil aid.
 
 At the same time, steps should be taken to separate those students 
 who are not interested in learning, or who prove disruptive to the 
 learning environment, from those seeking a good education. That 
will 
 likely require expansion of the county's alternative high school, 
or 
 the creation of a branch of the high school at a central location 
in 
 the newly formed regional district. The state must ensure the 
 regional district creates an environment in every school that is 
 conducive to learning.
 
 State officials can't allow the Asbury Park schools to continue to 
 fail the children they are responsible for educating. They can't 
 continue to waste taxpayers' money by pumping

The school has been pretty bad for an awfully long time.

You also have a great idea (really great) about making this an issue 
for the upcoming school board election.

We should start pressuring candidates now.

What a terrible idea. The identity of a community's children and young adults 
is tied to the 
educational system. Bus them out of town, make really feel like they are not 
wanted here?

Certainly there are better social solutions that closure. Privatization was 
discussed here, a 
'high tech' and vocational school was proposed by me.

Right Werner, because kids from Spring Lake, Sea Girt, Interlaken and 
the rest suffer such great identity problems from being bused out of 
their towms to go school.  You can just see it in the way kids from 
those towns struggle in life.  Just no identity to be proud of.

Good grief.

Let me tell you something right now.  The worst thing that could 
happen to this debate is to let psychobabble about community identity 
obfuscate this issue.

How many generations of Asbury Park kids would you like to see suffer 
in the name of this identity issue you raise?

Besides, pride comes from being a part of something good. This school 
situation is not good for them.

I'm with you on this one Tom.  I've been advocating state takeover 
but that's no great solution either.  I think this is a better way to 
go.  Bottom line is that this is so broken there's no fixing it as it 
is today.  The reccomendation you have been advocating, and now 
apparently the APP is, seems like a viable solution to proving better 
learning opportunities for APP kids.

And Werner, I would tend to believe it is better to provide a good 
educational opportunity regionally then to fail our kids because we 
are worried about the identity of a community's children being 
sacrificed.  How many decades does it take to demonstrate that this 
school system will not solve it's own problems.  How many generations 
of kids should we sacrifice to keep local control?  What is the 
community identity left for these kids by a failed school system?  

Tom makes a good point below about the other towns who don't have 
their own HS - doesn't seem to be a problem there.  So why would it 
be for our kids?

Denise you are right to point that out.

Under my plan, the High School Students get split among 7 area 
schools:

Manasquan, Wall, Neptune, Ocean, Long Branch, Shore Regional and Red 
Bank Regional.

Also some of the Charter and specialty schools could be utilized.

I'm betting we could get the number of students each school as to 
absorb down to 15 to 20 per grade, so as not to overburden any 
school with too much immediate growth.

I am glad to see that there is finally a spirited debate in regard to 
the Asbury Park School District.  I guess we can call it the Tommy 
Plan?  As for the school being dismantled, that is absolutely 
insane. It will never happen.  We all know it and it is ridiculous to 
think it will happen.  Regionalization may considered way down the 
line, but it will take years to happen.  Especially with the pitviper 
lawyers out there chomping at the bit to get a piece of this legal 
action from the surrounding towns.  Tommy, you know that's going to 
happen.  It isn't possible for this to happen in 4 months.  We need 
to have a plan in place now.

The High School, Middle School and Alternative Middle School are in 
chaos.  Without strong leadership from the top down, this will never 
be fixed.  Lewis was the cause of this entire debacle.  When he took 
over in 1999, the scores began to plummett, drastically.  There has 
been no strong leadership in this district in any of the years that 
Lewis has been in charge.  We need strong leaders in all these 
schools.  He has constantly hired weak links that he could control.  
This is a total recipe for disaster.  We need the strong leaders in 
here now to begin to fix the problems.  As for hiring a Ferina from 
LB, the staff fear him, they don't necessarily like him.  You can't 
run a district on fear and intimidation like Lewis did for all his 
years here.

I believe that people that are interested in the well being of the 
staff and students, they need to run for the BOE.  The filing 
deadline is 4pm today.  You need 10 signatures.  This is a pivotal 
year.  5 seats are up and it can totally change.  It's time to get

learning environment, from those seeking a good education.

1. Problem is now, there is NO place to stick the troublemakers - other 
then to mainstream them. Like castro emptying out trouble to the us.

2. Long branch has extra capacity and so does neptune. 

3.OT already has 30 plus kids per class and no place to stick the 
trouble makers and the high school can't handle the problems it has 
today. 

4. Is the state going to supplement the receving schools - or are the 
resident taxpayers going to get stuck trying to fix waht over 1 billion 
didn't?

5. What is the plan over the next 5 years to ELIMINATE the misuse and 
abuse of the Abbott Systems. Eliminate the attorneys representing the 
Abbott districts and there would be over $20 million more that could 
gotto education instrad of defending and covering up the abuse.

6. HOw will school budgets be voted on - bussing doesn't FIX the 
homelife and social aspects of going home to a vacant home, a drug 
infested home or no home or to a gang mom either.

another crop of people can fight with the administration while the 
kids go nowhere?

We're way past that.

It's time to end it all.  No sense wasting more youth while we check 
our watches waiting for developments that might come  way down the 
road.  Been there done that.

We can give these kids better schools by sending them to better 
schools right away.

It's the best plan for the kids.

Don't worry, there will be plenty of placement for union members in 
the other schools. ;-)

You bring up a good point that was covered alot on Randy Bergmann's 
Blog.

We are talking about resources.

When a school has a vast majority of kids who need no special 
attention, then they will have plenty of resources to deal with the 
few kids that need attention.

Now look at Asbury Park High School.  Judging from the report card, 
8 out of every 10 students needs extra help right now.

We have our heads in the sand if we think one school can handle its 
problems when 8 out of 10 needs attenion.

Breaking up the students to other schools, where the resources from 
all the schools can be used, and the amount of kids in each school 
being diluted, is the best way to garner those resources and help 
the kids.

You make a good point Fred, which is why I advocate a Federal Civil 
Rights lawsuit to desegregate the schools.

There is no political will on either side to tackle it.  Absent some 
miraculous change of heart by the towns and politicians, we are 
going to need that Federal Court Order.

I'm certain we can get it.  The suit has to be filed.

All we have to do is convince Frank and the Board it is worth 
filing.  

For the amount of $ we spend on the school board attorney over the 
past few years, this suit should have been included in the price.

Be real.  Your family is from this district and my family is from 
this district.  You all graduated from the High School.  Do you 
really want to see your alma mater dismantled?  And have all these 
kids sent all over the county?  Some of the comments are right.  The 
kids in these other towns have no identity to a town that has no 
school system; ie: Interlaken.  The solution is not to run, the 
solution is to get involved.  If running is getting involved, than so 
be it.  I am in the system everyday.  I know there is no leadership, 
nor has there been any real leadership in the High School and Middle 
School for years.  Maybe, if some people get involved, and make the 
right recommendations, there can be effective change put in place.  
that's what it takes.  

Let's get back to the real issue.  Dismantling is not going to 
happen.  And it's not just because I represent these members and 
would not want them to lose their jobs.  We also stand up for the 
saftey and well being of the students too.  You that we try to get 
involved in as many positive projects as possible in this district.  
There needs to be a core group of people that come together, 
community, clergy, politicians, staff members, and business owners to 
begin to come up with solutions to the problems that plague the 
district.  If getting behind candidates is the solution to fixing the 
problems, than that's what has to be done.  Everyone needs to be

I'd take that 30mill the first year, lease and fit out a nice school. 
The 2nd year with that 30mill, I'd hookup all the kids with funding for 
college.

I'd keep 1% for my own pocket.

I would love to agree with you that getting involved is the answer.  
I tend to agree with Tom that the problem is so pervasive that we're 
well beyond that.  It seems that you are oversimplifying the issue - 
this isn't about Lewis although he clearly was a problem.  These 
problems have existed way, way before Lewis and continue after his 
departure.  The system is just far too broken and the only real 
losers (beyond the local and state taxpayers) are the kids.  How many 
more generations should we sacrifice trying to get it right one board 
member and one administration at a time?

it.

That's not my alma mater.  I went to a desegregated school with 
white kids, black kids, rich kids and poor kids.]

That school is gone; there is a racially segregated school there and

advocating Brown v Bd of Educaiton ;-)

By the way how ironic Marshall was the attorney on Brown v Bd. of Ed 
which made racial segregation of schools illegal, and we name a school 
after him in a district purposfully segregated by race.

we've said it before, you can bus the kids to private schools as well. 
At 10k per kid - give themeven $12k per kid.

Then whomever wants could pocket the other $8k per kid.

There should be a federal lawsuit against the BOE for failing to 
educate for 10 years and squandering Abbott money.

Bus them out.

And save money.

Then you can start with a whole new school system. 

New schools, new employees and a new outlook.

1.Close the highschool in 08. (my 4 year phaseout)
2.Bus them to private schools - anywhere they want to go - families as 
well. Fund them with NJ state money for any kid from 9-12 grade.
3.kids from 5-9 grade - send them to private schools as well. This way 
they might have a shot. 
4.Take the rest - prek-4th grade and concentrate and the kids AND THEIR 
family situations. Work both. 
5.That gives you 5 years to decide where to send those kids when they 
reach 9th grade - either a new highschool - or to private schools.
6. Give the parent the choice of a private school. Those 4th graders 
and their families, in 5 years, might have an idea.

through this here one time.

I'd love Frank and John to give me their thoughts.

I take no issue with the actions of parents.  Move where you wish, 
pay for private school if you wish, and you have my full support and 
blessing for both.

I also am not a big believer in busing kids from one district to 
another (although sometimes to end de facto segregation it needs to 
happen).

None of the above is what happened to Asbury.

It was not the actions of parents that segregated this school 10 
years ago, nor am I suggesting we take kids from other districts and 
bring them here.

Here is what happened:

Asbury's High School District is half of Belmar, Avon, Bradley, 
Asbury, Allenhurst, Deal and Interlaken.

Those kids' home High School is Asbury Park.  If you aren't in 
private school (which I support) Asbury is where you come.

And come here they did.

I believe it was 1996 (don't hold me to the date; I'll check) Asbury 
noticed there was a drain.  Suddenly many of the kids from the other 
towns were being bused OUT OF DISTRICT TO ANOTHER PUBLIC HIGH 
SCHOOL - RED BANK REGIONAL.

Note well that no one ever changed the district.  The district was 
still the same.

Asbury Park sued in a venue where the State Commissioner of Eduction 
gets to make the ruling.

Asbury's lawyer never raised the segregation consequences, which the 
Commissioner could have raised himself.

The Commissioner ruled that because Red Bank has such a fine music 
program, kids who wanted to go there from Asbury Park's District 
could apply to study music there.

However, he never changed the district.  He simply said let them 
leave if they want and go to Red Bank if accepted. The district 
remained the same.

So on a legal analysis, what the Commissioner created was a 
situation where little Johhy Whitebread has a right to learn the 
oboe that outwieghs the Constitutional Right of black kids in Asbury 
Park to be in a desegregated school. Which of course will never hold 
up in Federal Court.

After the ruling, every white kid from Belmar to Deal became a music 
major and went to RBR.  Each school even has an administrator to 
help with the application process to get the kids around AP and into 
Red Bank.

I saw a statistic a few years back.  There were 67 High School aged 
kids in Avon who normally would be in Asbury Park High, but 66 of 
them were not there; most were at Red Bank Regional.

Understand the effect of this.  I'm not suggesting we take kids from 
a different district and bring them here for desegregation.

I'm pointing out the opposite happened:  We took all the white kids 
FROM OUR DISTRICT and bused them away to a different district.  
That's reverse busing that caused the segregation; not the usual 
opposite.

The school district never changed;  the kids in Asbury's district 
were bused to a different public school district.  Our sending towns 
did not change (although I understand Avon recently was approved to 
start sending kids to Wall).

That left Asbury Park segregated, and it was done by the State 
Commissioner of Education.  That is state action, which is why it 
can be attacked constitutionally in Federal Court.

Ahh. Two issues: 1) will the unions allow incentive pay (but how do 
you mark performance for someone teaching troubled youths, etc.) 2) 
are our teachers allowed to teach.

Plenty of blame to go around. No easy fixes. Fix what needs to be 
fixed in the classroom. Fix what needs to be fixed on the street and 
in the home.

Children need a safe environment to learn. Those preventing such an 
environment, on both sides of the desk, need to be removed. For 
troubled homes etc., pay or tie assistance to attendance and 
performance. People cannot be thrown in the water without a lifeboat. 
Yet in the same vein, people can't constantly wander out into 
dangerous waters during a storm and expect always to be saved. 
Accountability on both sides.

Please check your information.  I believe it was an Asbury Park  resident who 
suggested to Belmar, Bradley Beach, Interlaken have your children  take music 
and the arts as a major subject.  Then went to Red Bank and was  paid to help 
create a music and arts program.  It was challenged I believe  in court by 
Asbury Park and because there was no music or arts program at the  high school. 
 
Red Bank could take any of the students.  But there is  more I believe Asbury 
Park in some cases had to pay Red Bank for these students  going to there if 
they were Asbury Park residents.
 
Like I said it needs to be checked out first.  We can go on and on  about who 
is the blame but you can have people using this district as a cash cow  and 
not have these kind of results with our students doing poorly.
 
One last question to put out there:  If you work on a job and every  year 
your 70% of  your product could be sold how long would you have your  job?

district as we speak.

The Commish is busing them to another.

That isn't fleeing by parents;  thats segregation by the State.  If

Are they being forced to go somewhere else or is that by choice and 
they are being allowed to? That is what your post suggested. If that 
is so, it is fleeing. I only followed this line of whites/blacks 
because of your segregation post. Segregation is race-defined. Should 
we be talking about this? Someone could look in and suggest we are 
saying that the color of one's skin has a direct correlation to a 
school's performance. I don't think we should go there.

Please check your own information.  Mine's been checked.

I have the ruling in my hot little hands.  It is from the State 
Commissioner of Education.  It was not brought to Court in a Federal 
Civil Rights Action as it should have been 10 years ago.

You are correct about the ruling - it was based upon the music 
program.  That means it will not outweigh the segregation 
consequences in Federal Court.  We have a slam dunk in our laps and 
we aren't taking it.

So no, nothing has to be checked out first.  I already know who to 
blame (State Dept. of Education).

All that has to happen now is for the Board of Education to instruct 
their lawyer to start the action.

Now you are disagreeing with Brown v Bd. of Ed. (I don't think you 
intend to). 

Schools that are segregated by race via State action, be it 
intentional or de facto, is forbidden in America.  Performance being 
down only helps our cause.

I don't think there is any question that the ruling by the Commish 
de facto segregated the schools - just look at the rolls, and 
compare them to before.

It shouldn't stand. The Board of Ed should have brought suit 10 
years ago.  It's never too late - no statute of limiations on 
segregation.

Absent a lawsuit, you would have to solve this by political 
actions.  Sorry but the grand tradition of liberal activism of 
Marshall, Bobby Kennedy and MLK, Jr. that focused on PEOPLE is gone.

Today liberals want to save trees, whales, spotted owls and crap 
like that.

Today's conservatives won't be jumping on this ship with me either.

We need the lawsuit.

The parents are electing where to send their kids.

From what you say, some convinced to get their sending district changed 
to Wall. If that failed, don't you think they would of just sent their 
kids to private schools - like St. Rose or RBC.

Others elected, in 8th grade, to let their kids learn the oboe, if they 
so chose. I wish my daughter learned the oboe instead of dealing with 
the problems in OT. One more year of that mess. BUT, I am still working 
on my son to convince him that dramatic acting may be his calling. 

Then again, I heard the RBR isn't all it's cracked up to be.

The RBR deal for all the districts, especially Deal, Interlaken and 
Allenhurst is a copout for those towns.  It's a loophole that I have 
questioned in Interlaken for several years.  When I questioned it 
for the sake of making these parents either send their kids to AP or 
send them to a school they have to pay for, I was told we can't do 
that.  I don't know all the legal aspects of this situation.  You 
would know better than me.  All I can tell you is that somehow, they 
are allowed to do this.  The lawyer, at the time, was Sandy Brown, 
for the Interlaken BOE.  What I resent is the fact that as a 
taxpayer, I have to subsidize a music Program for students 
attending RBR, when we all know that none of these students will 
ever be majoring in music.  It's a bunch of b.s.--- In

Sounds better than what we have and I say, KEEP, the 1%, if it works!
I know Conti, too!  He was an excellent Football Coach at AP, for
years!  He knew me, from my Pop Warner days.  On Thanksgiving Day, I'd
take one boy from Asbury and 1 from Neptune, to the LM Diner, on the
Circle.  All of the coaches from Ocean TWP., were there, also.  It was
to teach, Sportsmanship!  For me, Football, was just a game!  For
the kids?  It was bragging rights!  I did this from 1977 through
1989.  My last child graduated, June, 1989 and I moved on.  The kids
who were the recipients, never forgot and they became friends for
life and found out that Neptune and Asbury Park, are ONE and the
SAME!  I'm glad that I had the opportunity to spend time with these
great athletes, who were just, kids!
I wish these adults, would be half, of what these kids, were and are!

The State is letting it happen, when they are the ones who are

What about parents from those towns who elected to rent a winter 
home in such towns as ocean to wall twp - so their kids went there??

daughter to AP high?

It was called discipline. He is now the OTHS vp of discipline. But 
his hands are tied. 

The town of deal is 99% Jewish and don't even reside in town during 
the school year. Those that do go to Hillel or elsewhere. Deal 
elementary is a class act - but they should be merged away - cause 
you don't need a super/principal for 100 kids. Merge away.

Interlaken, Belmar and the rest were almost Irish or Italian - 
Catholic. St. Rose and RBC-  for years - not the past 10.

1. Clean up your town 2.clean up your schools. 3.Clean up the crime 
(1 and 2 go together) 4. Get rid of the attorneys looking for free 
abbott money. (add 4 to 3)

Run the schools like a biz.

do you really think placing white kids in the system will the others 
smarter???  We have plenty of dumb or kids who could care less in 
Ocean. I vote to move all the dumb,non-caring white kids out - to AP.
Give me all the caring kids from AP.

Then I want to pick 30 kids from around the state, based on their  
Geppas, and mainstream them yo work with my kids.

That's not the problem.

The problem is the entire cycle and it's starts in the home.

There are plenty of poor, poor districts around the country that do 
extremely well. Some are urban most are rural -deep south. But they 
survive.

Read, read, read to succeed. 

How about turning the highschool into a career school - for wannabe 
attorneys? then you can get all the kids you want from those rich 
attorney families to AP. Heck the building looks like a court house.

Dan I believe a citizen can, but the undertaking will be long and 
expensive (otherwise I would do it myself).

You know how these suits work, but for others reading:

You have to gather the facts on paper.  

That means sending subpoenas for records for enrollment records and 
performance records before and after the Commissioner's ruling in 
1996.  Not just Asbury, but the sending Districts too.

Then you'd have to get similar discover from Red Bank Regional.

Certianly then there would be depostions to clear up matters in the 
paper record.

Then you need to get it all to an expert witness to give you a 
report on the facts, and whether in his opinion there resulted 
segregation from the Commissioner's ruling.

Briefs have to be written on the balacing test that weighs the right 
for Blacks to be in a desegregated school and the right of the 
others kids to learn the oboe (obviously I jest, but that would be 
the crux of the legal analysis).

When you prevail, and go through the appeals (another huge process) 
you end up with an order that tells the State to desegregate the 
school.

Then the decision would HAVE to be made as to whether the other kids 
come back or the Asbury kids get split up and go out.

1000 to 1 odds says the political will shall be that we close Asbury 
and send the kids out to many schools.  1000 to 1.

Lot's of money to prosecute that claim, but well worth it.

I like how you are thinking there, but this would take more than the 
$25.00 a pop funderraising that SUFA does.

Since Asbury Park's annual budget is around $80 million and I've 
seen them pay their lawyer as much as $750,000 in 15 months, then 
$500,000 in the next 12 montsh, they can afford it.

I say, let's do it!  For $18,000, you can send a kid to private
school, pay for uniforms and transportation.  AP, can purchase the
buses and use them on weekends for seniors!  I'll bet we get back,
better educated kids!  I'm with you, Lady!  Turn the High School, into
an Arts Center, Live Theatre, and let the K-8th grades, use the
stadium and track ovals!

We are talking about resources.

When a school has a vast majority of kids who need no special 
attention, then they will have plenty of resources to deal 
with

few kids that need attention.

Now look at Asbury Park High School.  Judging from the report 
  card, 
8 out of every 10 students needs extra help right now.

We have our heads in the sand if we think one school can 
handle 
  its 
problems when 8 out of 10 needs attenion.

Breaking up the students to other schools, where the 
resources 
  from 
all the schools can be used, and the amount of kids in each 
  school 
being diluted, is the best way to garner those resources and 
  help 
the kids.
