FCC Intervention in WYGG 88.1FM Dear Senator Menendez: I have had a radio show, Asbury Radio (previously Restore by the Shore and Restore Radio), on WYGG 88.1 FM, which would've been on the air 7 years this June. The station is a low-band, minority owned arrangement that broadcasts largely in Haitian Creole. (Abner Luima bought and held the license until recently.) In mid-November Steven Desena, a field engineer with the FCC based on Varick St., in NY, claimed to be driving by our studios at 601 Bangs Ave., in Asbury Park. Mr. Desena gained entrance to the building and examined the antenna without WYGG present. DeSena phoned the station manager, Jean Guy Henry, and pretended to be a cable installer who needed the transmitter turned down to work on the roof. He then summoned Henry to the roof and brow beat Henry to try to get him to turn off the transmitter. Eventually, according to Henry, Desena turned off the transmission himself, which Iâm told is a violation of FCC rules. The station remained off the air from just before Thanksgiving until February of 2007. Desena told Henry heâd have to move the station, which he did during January. The station was relocated to a house owned by and adjacent to the French Haitian church at 414 Asbury Ave. The FCC granted a temporary permit to allow the station back up on the air, but that permission expires in early April. The management gradually reintroduced programming to the station, with the exception of my show. Henry told me in March that heâs afraid that my show is the real target of the FCCâs attentions. (Desena visited again at the new location on Jan. 28th.) This makes three or four visits to a 100- watt station in roughly two months. Despite this, there is no record on the FCC's web pages for listing Notices of Apparent Violation. On a recent visit, Desena reportedly asked specifically about my talk show and, granted this is second hand, told Henry that it may be the publicâs right to talk about this stuff but they (?) donât like it. Desena told Henry that all guests have to sign in, have to be listed prior to show time as well, with their topics and how long they intend to be on. Is this really Federal FCC Regulation? I can clearly see where such rules would have a possibly chilling effect on free speech. My second question is: Can you find out who or what formed the initial catalyst for Desenaâs visit in November? By the way, it may mean nothing, but my last show to air over WYGG was about the awakening potential of voters from Asbury Parkâs West Side. Naturally, this protracted situation has only given fuel to speculation. Other subjects covered on my show have been random violence against Latino workers, Eminent Domain, Abolition of the Death Penalty, environmental and tenants' rights, etc. Again, if you could confirm these FCC requirements; and if you could find out the reason for the FCCâs spontaneous visit and termination of the signal, I would be most grateful. New Jersey's Higher Education funding was cut $250 million this month. Rutgers alone was forced to cut 800 courses, 600 staff 150 faculty members. When the rest of us are told to toughen it out, it's nice to see a part of the State budget that's actually growing, and the town that SHOULD have tourist dollars propping up the economy doesn't have to make any tough decisions. Lighty, I respectfully disagree. Last year I brought my 3 kids to the arcade on Asbury's boardwalk a dozen or so times, because I thought it was a fun, safe place to play. Now, when they want to go to the Arcade, I'll take them to the Freehold Mall, where they can run around and be kids, and I don't have to witness the same BS I saw on the Asbury boardwalk, where kids hustle other kids for money. The last time I was at the Asbury beach was during the Guitarbeque weekend. The repeated incidents my kids had to walk through from Second Ave beach to Bradley Park I hope no family has to go through again. From the dope dealers, to the whores, to the general dirtbag hustler throwing the F bomb like its going out of style. As much as I thought Asbury Park would be for family entertainment, I hate to say it, but I will never again bring my kids to Asbury Park. The city can have its baby parade. Hell, Fishman can bring Elmo into Convention Hall. My kids will be forbidden to go there. The city made their choice. They do not want family entertainment. Figure a housing unit is the size of approximately 20 cars, you're looking at $63.40 for the space. A Nashville band called Rascal Flatts shot a video for their song Feels Like Today in Asbury Park last year. Notice the touches this band added to the decrepit landscape: namely a carousel a guy walking around taking pictures. It's amazing how little Duh Partners care about Asbury's legacy. The fifth summer season they've had control of the boardwalk, and all we get is an arcade a few beer joints. And yet, they plan to sell condos to a year round community. The way I understand the PILOT agreement, the tax assessment changes with every resale. For example, if an original owner buys at $400k and sells 3 years later for $500k, the new assessment is based on the $500k figure. This works in reverse as well, and in a declining condo market, you could have residents who are locked in at an assessed value of $300k or $350k. When the agreement was put into place, I brought up the hypothetical of a husband selling to a wife for a below-market rate. I'm sure there will be a few of these going on as well. Since the city's costs will be fixed, the revenue from the waterfront will decline in a declining Condo market, and every asset has been sold, the only way to bridge a budget gap is to increase the taxes on the non-abated property in town. Just more to my original point: To get prices similar to Spring Lake will take much more than buying property waiting. Prices in Bradley Beach are closer to Asbury's than Spring Lake, while Deal's are much higher. Now consider the fact that the waterfront abatement is tied to actual sales prices in the secondary market. In a down real estate market it's a pretty good bet you'll be paying a HIGHER tax rate in 10 years as you bear the municipal burden for the buyers who get the condos at fire-sale prices along the way. WILCOX, Staff Writer Foreclosure activity in California and other Western housing markets is on the increase in part because high-risk adjustable-rate loans are beginning to reset to fully amortized payment schedules, a property tracker said Monday. During the year's first three months, all types of foreclosure activity in California jumped an annual 33.6 percent, to 28,550 incidents, said Sacramento-based Foreclosures.com. Notices of defaults, one of three indicators tracked and the first step in the foreclosure process, increased 36.5 percent, to 20,515 incidents. And the number of real estate-owned properties, the final step in the process and notification that there is a new owner, increased 27 percent, to 1,41l. I think it's all the washing of the market, said company President Alexis McGee. And activity was expected to pick up since levels sank to record lows as the market peaked. Now home sales are softening, appreciation is not as robust as a year ago, interest rates are rising and inventory is building. McGee also said the creative adjustable loans that helped buyers jump into high-priced markets such as Southern California will continue to impact foreclosure activity as the market continues its shake-out. I don't see those low numbers coming back, she said. Analysts have noted that of the six Southern California counties, San Diego is the furthest along in the cycle. McGee said that in recent years more than half of home purchases were financed with interest-only adjustable loans or option adjustables with very low teaser rates. A recent study by Christopher L. Cagan, director of research and analytics at First American Real Estate Solutions in Santa Ana, found that most of the trouble should come from teaser-rate loans that will reset in 2007 and 2008. The people who bought in '03 or '04 tend to have equity so they can usually work something out. Next year and the year after next is when things will get sticky, Cagan said. Someone who paid about $500,000 for a home in the San Fernando Valley last year and got a teaser rate of 1 percent would have initially paid $1,608 a month. If that loan resets next year at 6.5 percent, the payment soars 96.5 percent, to $3,160. Buyers with hybrid loans are not at as much risk. If prices are going up 20 percent a year everyone is a genius and mistakes are forgiven. The problem is when prices level off, Cagan said. Homeowners who bought near the peak face the most risk and the economic fallout will be limited. It will not break the economy, Cagan said. It sounds like a good idea, and in a perfect world it makes a lot of sense. But lets be realistic here. This city has not been able to get its house in order, and this Council has consistently used City owned property to rearrange the deck chairs on the economic Titanic. Nothing they have done in 5 years has shown they have the ability to successfully redevelop anything. Why don't they start small see if they have the wherewithal to put an actual plan together to make Springwood a viable destination where there is none, rather than giving them more prime property to shove Condos on? Maybe this is the perfect opportunity to get some volunteers from New Brunswick's DevCo to offer opinions, since they seem to have a knack for putting unwanted property back onto the taxrolls getting it to thrive. Property will always become available. It can be an instant anchor for whatever stores we can build there near it. This story needs bigger national attention. Under normal circumstances, a homeowner would not need a lawyer in an eminent domain action of this sort, because a recent arms- length sale of the subject property is the best evidence of value. But this transaction, like others we¡¦ve seen in Long Branch and Asbury Park, is driven by greed. The developers are dictating the terms, and their objective is to buy the property as cheaply as possible. The municipality is complicit in this arrangement as they will institute eminent domain proceedings to acquire the owner¡¦s site, absent an agreement with the owner. This scenario, while outrageous, is by no means unusual where the unholy alliance is at work., i.e. developers and compliant politicians. The settled rule in New Jersey and other states is that any increase or decrease of the market value of the property acquired or caused by the project of the condemning authority should be factored out of the market value determination. See the following cases: X Jersey City Redevlopment Agency v. Kugler, 58 N.J. 374, 379 (1971); X Housing Authority, Atlantic City v. Atlantic City Expo., 62 N.J. 322 (1973) X Jersey City Redevlopment Agency v. Mack Properties Co. No. 3, 280 N.J. Super. 553, 568-69 (App. Div. 1995); X State, Dept. of Environmental Protection v. S. The initial redevelopment efforts by Carabetta and Vaccaro were stopped as a result of Carabetta¡¦s bankruptcy in 1992. Asbury Partners LLC, using money from M.D. Sass Company, purchased Carabetta¡¦s rights in the bankruptcy proceeding and paid the City of Asbury Park $6.5M for tax liens on the properties. These funds were desperately needed by the City of Asbury Park to stave off its own pending insolvency. For these payments Asbury Partners took over Carabetta¡¦s project and developed a new plan. Carabetta, it should be noted, never completed anything. He left a rusting structural steel monument at Ocean Avenue and Second Street for the last fifteen years. Asbury Partners LLC also have not completed anything, although they have grandiose plans. I was screaming about New Brunswick DevCo 3 years ago. New Brunswick's Redevelopment Worked. Camden's Redevelopment Failed. Both have Multinational Corporations based in the city (JNJ CPB). Both have Major Universities. (Rutgers) Both have Major Medical Centers (UMDNJ Cooper) One has a DevCo. One entrusted the city government to handle redevelopment. The parallels between New Brunswick Asbury Park are not that far off. New Brunswick was DEAD in the late 80s/early 90s. Rutgers was a suitcase school, emptying out on weekends. Of the 30-odd thousand students, 80% of them lived within 20 miles of campus. The only thing open on George Street was pawn shops bars. Driving down George Street during the day, you were solicited for crack. At night, you were solicited for sex in between gunshots. Today you can walk from College Avenue to Douglass Campus and pass young affluent professionals transplanted from Hoboken and a booming retail community built up to service them. These aren't college kids. These aren't JNJ employees. The college kids can't afford the restaurants shops, and the JNJ employees have on-site restaurants amenity services. The parking decks aren't filled with college kids, who can park anywhere they want on campus on weekends. They aren't filled with JNJ employees who have an underground deck between George Albany and free use of the Hyatt deck. Yes, but there were MANY conflicting interests, and they were able to hammer out a beautiful redevelopment, housing density, commercial activity, and a brand spanking new Route 18 to bring day-trippers there. It may have been coincidental that the redevelopment worked, but I personally think DevCo inspired an honor among thieves mentality. Of course, 15 years from now Terry Weldon may be hailed as a visionary genius as well. Using conservative leverage that's 20 times your money in 5 years. Knowing what the Waterfront is worth and wanting what the Waterfront is worth are two different arguments. How does selling it to a developer to build 5,000 sq ft McMansions benefit a younger family trying to buy their first home? One of my childhood friends is a farmer's daughter down in Vineland. He's forced to sell his 140 acre homestead to developers building an age-restricted community. I told him about the Monmouth County Open Space program. He would love to keep it open space, even at a discount, but Cumberland County has no such program and he doesn't want a distress sale of the farm after he's gone. I'd love to see an end to towns selling their COAH credits, and remove age-restricted developments from qualifying for those credits. That would do more to providing affordable housing than limiting the Open Spaces program. Good luck in your pursuit! Let's do the math here. The most any town in NJ received is $200,000. Let's call that maximum gain. Asbury Park has received nothing. Right now that's the maximum loss. Wow, if we could only get half the maximum gain, that would be great, right? Well, looky here. Along comes a lawyer willing to give you half of the maximum gain. Well, actually not GIVE. He's going to try his hardest to get you half of the maximum gain. Let me explain. If you give him $100,000, he will try to give you $200,000. Put another way, the maximum gain becomes $100,000 ($200,000 minus the $100,000 you gave him). Your maximum loss is $100,000. (You give him the money and the lawsuit is thrown out of court.) Actually, when you factor in taxes, your maximum loss is closer to $113,000, but let's just keep it simple. Which begs the question: if you are looking to give $100,000 to get $100,000, why do you need a middleman? Please BB, humor me and explain how a $100,000 transfer payment to you will allow you to suck the US Government dry of $88 million. Considering the total amount given to NJ in 2005 is $21.7 million and Monmouth County's share of that is $734,235, you've either found the plans to a printing press or the Master Developer has shown you new ways of getting golden eggs from geese. I'd counter that the municipalities in the 11th District are too incompetent to put a Grant Proposal together. The State's HS money was allocated according to specific grant requests made by the municipalities. For example, Manalapan is using their $187,337 to allow FEMA to create and train Community Emergency Response Teams, or CERTS for short. Each CERT member is trained on disaster preparedness, basic disaster medical operations, fire safety, light search and rescue, and other essential topics. In the event of an emergency, CERT members can provide immediate assistance to victims, assist in organizing spontaneous volunteers at a disaster site and provide critical support to first responders. In light of recent news events, I'd argue every town should have a team of CERTs ready to react when disaster strikes. I'll make you a deal. Asbury Park applied for a grant through the state's HS fund. What exactly was it for, and how would it have been used to protect AP citizens from Al Qaeda? You prove to me that Asbury Park's grant request was to address a legitimate HS issue denied, and on the day after Election Day I will gladly cut a check DIRECTLY to the City of Asbury Park equal to my family's cut of the $187,337 given to Manalapan. I don't want to hear about Wall protecting their rich guy airport or NJNG using government subsidies to pay for insurance on their headquarters. The 11th Legislative District is 25 towns from Atlantic Highlands down to Brielle, almost all of them on the Shore. Well, those towns together were awarded $0.00 in Homeland Security Funds. Just north of us in the 12th District, check out some of these numbers: Freehold was awarded $157,000.00; Manalapan was awarded $187,000; Marlboro was awarded $196,000. I'm not begrudging these towns getting the money, but it makes no sense that the Shore towns get nothing. Why did this happen? I have to talk about parties here for a moment, but I promise I will get right off it because I won't let this get partisan. The Democrats have the Governor's chair and the legislature. If you look at what happened statewide: 90% OF THE MONEY WENT TO DEMOCRAT DISTRICTS; 10% TO REPUBLICAN DISTRICTS The 11th is a Republican District so Asbury Park and the other 24 towns got $0.00 (Freehold Manalapan and Marlboro are in the Democrat controlled 12th). The Press Conferences I had today in AP and Trenton was attended by the AP Fire and Police Departments as well as Democrat and Republican elected officials from around the 11th District. Here is the plan: I am suing the Governor and the Attorney General seeking an injunction from turning over the money, to give all the towns a chance to have the funds reallocated. I am going to employ the services of Drinker, Biddle and Reath, one of New Jersey's top law firms regarding public financing (they successfully sued a prior administration over a funding issue and prevailed). As all of you know, Justice is open to the public like the Ritz Carlton is open to the public. It costs money. The last time Drinker Biddle sued the state the fees were approximately $100,000.00. Therefore, that is my fundraising target. The purpose of both press conferences today was to request donations for this lawsuit. Here we go with the revisionism again. Duany had his meetings in April 2002. The Plan was adopted October 2002. The Plan calls for a Hotel to be constructed in the Entertainment District opposite the Casino, at the western edge of the forecourt. The Plan also permits the Berkeley Empress to stay. I don't know what the capacity for the existing hotels are, but why would a THIRD hotel be proposed by the Developer unless he expected demand to exceed the supply of existing hotel rooms? Once again, who has a bigger stake in being correct, Duany or Fishman? I'm a very big College Football fan, (Upstream Red Team to anyone else who is) and TiVo every mention of College Football. On Monday, there was a show on the Travel Channel called College Football Towns where they profiled Athens, GA. Did you know, both REM the B52s were discovered in the same Athens bar??? Neither did I, but the next time my Knights face the Georgia Bulldogs, I'll make sure I get a picture of me in front of the bar where both REM the B52s were discovered. Actually, because I am a fountain of useless knowledge, whenever I'm in Atlanta I'll remember there is a bar where both REM the B52s were discovered. As a matter of fact, I'm willing to bet the next time any of us are in Atlanta, (which is 70 miles away, according to the show) if we ask 10 30-something locals on the streets where REM was discovered, at least 1 of them would be able to give us the best way to get to that unnamed bar in Athens. Picture yourself on the streets of NYC. Not 5th Ave, but around 20th and First. If you asked 10 40-something locals Excuse me, can you tell me where Bruce Springsteen plays? How many would tell you to go to the Stone Pony? How about 40-something locals on Market Street in Philly? Would you concede that there ARE some European tourists wandering around NYC Philly looking to find Bruce shrines? Well, Exit 116 is only 16 miles away from the Parkway Exit to Asbury Park, where Bruce Springsteen had his big break. And as a matter of fact, there are plenty of things to do on Exit 116. Why, you can visit the Vietnam Veteran Memorial, where your great grandpa gave his life for a meaningless war in the '60s. Lighty, don't give up the good fight. I'm actually involved with an organization looking to relocate the College Football Hall of Fame to New Brunswick from South Bend, IN. (Did you know, the first college football game was held in New Brunswick, between Rutgers Princeton?) The State wants to put it on a Turnpike Rest Stop. The committee has agreed that the CFHOF is better off starving in South Bend than thriving on Exit 8A. Actually the museum that we are looking at the closest for a model for the New Jersey Music Hall of Fame is the Georgia Music Hall of Fame. That museum has had tremendous success in building up the state's musical heritage to a larger audience. Of course, the way things are going with Asbury Park not wanting tourism, I guess we may be forced to look elsewhere for a home. It's a shame because Asbury Park shouldn't seek to be the next Bradley Beach - it should be seeking more. It has too much going for it to settle into the next little family town on the Jersey Shore... One more note of just how much success Belmar is having with their move to residential. The town council voted to have our parking meters run from May to the end of September. Why is this important? Because for decades those meters were ONLY used during the summer. Dear North Jersey natives: Please stay out of Ocean City! There is nothing to see or do there, and as someone mentioned, it's a ghost town. Thank you, JerseyJohn but seriously, Ocean City was my family's Hyannisport/Kennebunkport for about 70 years. Had a nice sized house on 12th Wesley. It was sold in the early '90s, and is now the proud site of a 16 unit condo complex. Hurts to even think about how much each of those places are going for. In regards to year round residential. Ocean City DOES have year round residents, they just live in Somers Point during the winter. I have a cousin who is 31, lives in SP and operates a Jet Ski rental biz out of a trailer on the Bay in OC. He works from May-September grosses $200k. The scary thing is there are 5 other rental places on that strip. OC is perfectly happy being a summer destination, and paying for the vital necessaties through Property Taxes cops who obviously get paid commissions for every ticket they write or car they tow. Good question, and I'll try to give my interpretation. When discussing religion, I'm Catholic and my wife kids are Jewish. (darn, I gave away the answer to the psychic waitresses). I consider religious beliefs an adjective, not a noun. So I don't consider myself A Catholic. (heck...neither do most Catholics). I'd probably be offended if someone referred to my kids as Jews, but honestly religion rarely comes up in polite conversation. Using the Liberty Bell example, again, I can list dozens of businesses that draw tourists to towns that aren't getting their fair cut of the pie. With apologies to a respected poster on this board, I believe there is an author's restored house in Asbury Park that fits this category. Did you ever buy a piece of art, or even better, get an autograph of someone you admired? Did you do this because you expected it to go up in value? I have autographs of about 50 baseball players from a trip to Hank Aaron's enshrinement in Cooperstown in the early 80s, and I could care less what they are worth. (Hmmm..I even remember fondly the day my Dad drove me 8 hours up into Nowhere, NY. Wow...nice racket Cooperstown has going). To me my autographs are a connection to the past, a reminder that I met Joe DiMaggio Ted Williams, who both retired 20 years before I was born, and got a smile from them. They are not for sale. They are scribblings on cardboard to some people on this board, they are goldmines to some others on this board, but they are mementoes of MY childhood, not theirs. Also, considering Werner's post, wherein the new plan is concededly residential and not for tourists (absolutely correct, and the point most lost on people like Save Tillie, etc.), your concern for attracting tourists is misplaced. Our concern is a year-round economy supported by Monmouth County towns (a population larger and wealthier than Boston). And yet Boston has denied the Red Sox plans 5 years ago of tearing down Fenway Park rebuilding a modern 60,000 baseball stadium. What the heck are those Bostonians thinking??? They'd increase ratables by 50% just from shoving more people in their to watch the Red Sox lose. Just because we are larger wealthier, doesn't necessarily make us smarter. History will judge that. The Pony can stay or go and it won't make a bit of difference to the redevelopment of Asbury Park. I disagree about the bit of difference. The Pony staying means the difference between the other businesses surviving or ridiculously thriving. You grew up in Asbury Park, so you probably know who Arthur Pryor was. I have no freaking clue who he is, and if you told me he was Richard's dad, I'd believe you. You take away that bandshell, and Arthur Pryor fades away with the memories of the Greatest Generation Trivial Pursuit players. I remember the day an Asbury Park Historian (who certifies these people anyways?) who also runs a law practice told me the story of the Mayfair being torn down. I think the Mayfair would have an easier job of seperating this tourist from his suburban cash than an antique shop or an ethnic restaurant. You take away the Pony, and my kids (who in all likelihood will think Bruce is a dork just because their dad listens to him) have absolutely no reason to visit Asbury Park instead of Bradley Beach in 20 years. There's no hope of any amusements aside from an arcade, so the City has already lost the under 16 crowd. This Redevelopment is sacrifiicing Asbury's future revenue streams in return for a quick fix solution to make the town not appear empty. There I said it. The Pony doesn't matter. Do a little research on Lucy the Margate Elephant, for an example of Save CRUMMYOLDBUILDING that works when you have a local government that realizes they are merely custodians of the City's treasures for the next generation. If you feel the Pony is better off dead than saved if not profitable, do you feel the same regarding Convention Hall? Please give me an example of a similar venue anywhere in NJ that is in private hands? Apparently Asbury Partners is going to disprove economic theories that have been around since Titus held his first Gladiator Games in the Colosseum around AD 80. If I was a betting man, my money would be on the dead guys. Heck, I AM a betting man...anyone wanna lay odds? As for all your Bruce facts, you forgot one: Bruce was never, ever a booked act at the Pony. Not once. Not in the 70's, 80's or 90's. The first time his name ever graced the marquee was in 2001 for a benefit show. I sure hope the Rock and Roll Hall of Fame doesn't find out about that little tid-bit. I always correct people when they claim the Pony launched Bruce or vice versa. Technically, he was launched at the old YMCA in Freehold, but we'll just build up these Asbury Park myths get tourists spending here before the Freehold Center Partnership figures out how to market him. Does the Liberty Bell make a good profit in Philly? Does a zebra crossing on Abbey Road in London generate enough revenue to cover its maintenance? What a ridiculous question. My kids aren't exactly covering their fair share of the mortgage or their food bills, but I'm not throwing them out on the street because I'd make a better profit renting their rooms out as a brothel. If you get a chance, take a look at the Visitor Books a lot of merchants have around town. The Visitor's Center on the Boardwalk in the last 2 weeks has entries from Manchester, England, Houston, TX, Los Angeles, Unpronounceable, Sweden.
